1. SPECIAL EXCEPTION. By resolution of the Board it was determined that a special exception

be reversed ( ) be confirmed because the Board finds that the public convenience

would not be substantially or permanently injured and the spirit of
the Ordinance would be observed, therefore be it RESOLVED that this
special exception be granted permitting Fishers Island Farms. Inc.,
a/c David R. Wilmerding to erect addition to non-conforming garage
no closer than 13 ft. to the south property line on oceanic Avenue,
Fishers Island, New York.
7:30 P.M. (E.D.S.T. ) , upon application of Fishers Island Farms,
Inc., oriental Avenue, Fishers Island, New York, a/c David R. Wilmerding,
Oceanic Avenue, Fishers Island, New York, for a variance in accordance
with the Zoning Ordinance, Article III, Section 300, Subsection 7 (BELOW)
2. VARIANCE. By resolution of the Board it was determined that

is requested for the reason that if the addition to the garage is put on the northwest
side of existing garage it will make the parking and turn around area too small.

REASON FOR APPEAL Continued
1. STRICT APPLICATION OF THE ORDINANCE would produce UNDUE HARDSHIP because
there is insufficeint room to locate the addition o9lthe NVside of garage
and the cost of moving this present garage or of erecting a separate garage
would be much greater
2. The hardship created is UNIQUE and is not shared by all properties,"-alike in the immediate
vicinity of this property and in this use district because
of the unusual hilly terrain which limits the location of parking space,
drive, etc.
3. The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE
CHARACTER OF THE DISTRICT because
the nearest property owner to the east with a garage :Already- has'a 2 car
garage right on the prope ty line and Oceanic Ave. and the property owner
on the west (Gordon) has barn or garage within about 15 ft. of his property
line.
