is requested for the reason that the lot has a frontage of 74.35 feet which is less than the
100 feet set forth in Zoning Ordinance. There exists a 1 family cottage and 1 car gargge
located on the lot as shown on accompanying sketch. The west boundary' line. was' established
when the land west and adjacent to this parcel was owned by Henry & Aherna Langhorst.

REASON FOR APPEAL
Continued
1. STRICT APPLICATION OF THE ORDINANCE would produce UNDUE HARDSHIP becouse lawns,
fences and plantings are established on this plot as well as on the plot .to the west and to
establish another line would upset all these conditions. To move the west boundary line to allow
for a 100 ft. street frontage would bring this newly established line to within 25 feet more or
less of an existing cottage on the property to the west. The land west of this cottage is a
swamp and would cause a hardship to them should it be necessary to establish new line.
2. The hardship creoted is UNIQUE arid is not shared by all properties olike in the immediate
vicinity of this property and in this use district because all adjacent property to the east and
north has established boundary lines and. will in no way be affected by this
variance.
3. The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE
CHARACTER OF THE DISTRICT becouse 1) Three pieces of property to the east of this plot
each have a street frontage on Madeline Road of less than 100 feet and on each piece
of property is a cottage in each case closer to the street line than the one on the
plot in question. These three lots from west to east have street frontages of 56 feet,
93 feet and 60 feet respectively.
2) The land to the west of the plot in question though now owned by West End. Land Cpo
was purchased in 1953 from Henry & Alverna Langhorst and had definite established
boundary lines, the east line of which is the west line of the plot in question.
This purchase of a piece of property abutting property already owned thus created
the condition which we-now-seek tc rectify,in otHer words, if.we did not own the
adjacent land the problem would not exist since the lineH in question were existent
prior to the zoning ordinances.
3) To grant the variance requested would permit all existing boundary lines,
plantings, lawns, etc. to remain as they have been over the past years.

In answer to your office telephone conversation RE: a lot of 74.3ft
on lIadel1neAve.; I would state that where the West End Land Co 011118 the adjoining
property to the west it would require' a variance to Article 'III, section 303 of
the Building Zqne Ordinance to seperate it out and seil as a single lot.
An applicat~onshould be made on form Zal with a sketch of the,property
'and a fee of $ 15.00. The Board 'of Appeals will act on it as Boon as possible.
