STRICT APPLICATION OF THE ORDINANCE would produce UNDUE HARDSHIP becauseI Th~s lot is now held in single and seperate ownership, but the prospective purchaser wishes to ~tnt~in it as a single lot, ~nd notes part of a co=on o~nership. It is ~mpessible to enlarge the lot in any way. 2. The hardship created is UNIQUE and is not shared by all properties alike in the immediate vicinity of this property and in this use district because l 'This is t,he only lot, her, ween prespect,iv$ purchaser and the private road to the Tow~ property ~n the rear. This is also nearly opposite the "L~ke Lodge" property. 3. The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE CHARACTER OF THE DISTRICT becausel This eeotion of. land has been laid oat, in t,his present ~aaner since 19~1, and has been ~rtisly developed as per sketch attached. this' is a unique situation as it nearly faces the Lake Lodge property and is adjoining the Town "fill pit" in the rear. On February 18, 1960 verbally; and February 27, 1960 in writing, Mr. Walter G. February 27, 1960 Southold Town Board of Zoning Appeals TowuHall Main Road Southold, New York Gentlemen: On February 14, 1960, Joseph P. Terp filed two appeals for variences on lots located on Soundview Avenue, Southold. On February 15, 1960, I forwarded my check in the amount of $15.00 to cover your charges in connection with one of these appeals, and received from the Building Inspector receipt No. 865 for Appeal #261. I understand that at about the same time Mr. Terp forward- ed his check in the same amount to cover the cost of the other appeal. Both of these appeals were promptly withdrawn and the pur- pose of this letter is to respectfully request that the sums paid, as indicated above, be refunded to the respective parties. February 18, 1960 Call from Walter Kapp. Said do not present either Terp appeal to Board of Appeals. He may wish to withdraw it ink,he future. Febuary 15, 1960 Mr. Howard Terry, Building Inspector Tosn Clerk's Office Southold, N.Y. Dear Sir; I am the owner of some property located on the South Si~ of Sound View Ave, Southold. This property consists of two lots which a~eon either side of a lot owned by ~r. Spurway. ~r Spurway is interested in purchasing these lots to add to his property, but wishes to keep them as individual lots.
