(x) (x) ) REASON FOR APPEAL A Variance to Section 280A Subsection 3 A Variance to the Zoning Ordinance Applicant proposes to lease a plot approximately ,s requested for the reason that 218' on L.I.Sound x 200' to RCA Laboratories,who will construct a temporary research laboratory not ~arser than 16 x 30 in approximate center of lot,north of old seawall,about 125' from Sound. ~ornoratio~ P~oses'also to grant permission to tenant to lay a 0Trier er C~e ca~e from Sound to Bay,traversing Route 25 via conduit, ~Q~eeding on the north from property to be leased in a S.E.dlrection. Tenant will also erect a 40' antenna pole and will have permission to ' ~eek f~esh water anywhere on Stephenson Beach Property except area REAS~N..FOR APPEALwhich has beenCT~A~ to Town of Southold. Water requirement is for coolin~ & will be returned to point of withdrawal. 1. STRICT APPLICATION OF THE ORDINANCE would produce UNDUE HARDSHIP becau~ Since the requirements noted above are for urgently needed Defense Contract Research on a Federal project,there is. some question whether the Board,.of-Appealshas jurisdiction on this type of Federal project. However,in view of the limi~e~ uses available for the iow-ileln~ beach areas of the corporation,itwould seem an undue hardship to deny one of the fe~.u~es presently available to'the..S~ePhensOn Beach Corp. Tenant may properly be regarded as performin~ for the federal ~nvermnent,a governmental function,namely,Defense. 2.. ~he.h~rdshipcreatedis UNIQUE andisnotshared by oil properties alike in the immediate vicinity of thi~"pr6pe'rty and in this use district ~cause the area chosen is .~quely situated for a cable crossln~ and for the location of a temporary defense research project,probably at least 800' from nearest residence at closest point.No .other, area:.within.a distance of many miles so peculiarly fits the purposes of the proposed tenant in this highly ~lassified project. ,. , .... 3. The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE the proposed structure will in no way CHARACTER OF THE DISTRICT because chan~e..the char~cter.of.,the:~e~hborhood.
