EDWARD J. SKIREL. JR., residing at 2120 Wickham A venue, Mattituck, Town of
Southold, Suffolk County. New York 11952, and BRUNO J. SKlREL, residing at
2120 Wickham Avenue, Manituck, Town of Southold, Suffolk County, New York
11952, equally, reserving to JENNY T. SKlREL, residing at Mallituck. Town of
Southold. Suffolk County, New York I 1952, a life estate in the premises
party of the second part,
WITNESSETH, that the party of the first part, in consideration of Ten Dollars and
other valuable consideration paid by the party of the second part. does hereby grant
and release unto the party of the second part, the heirs or successors and assigns of
the party of the second part forever, in
PARCEL I:
AU, that certain plot, piece or parcel of land, with buildings and improvements
thereon erected, situate, lying and being in the Village of Mattituck, Town of Southold,
County of Suffolk and State of new York, bounded and described as follows:
BEGINNING at a C(lDcrete monument set at a Northerly corner of Farm Road and
Wickham Avenue and running in 0 Northerly direction 103 feet along Wickham
A venue, thence running in an easterly direction 127 feet along the property formerly of
Gustav Bayer to a concrcte monument. thence running in a southerly direction 92 feet
along the property formerly of Gustav Bayer to a concrete monument; thence in a
westerly direction 120. I I feel along property formerly of Gustav Bayer to Wickham
Avenue, the point or place of beginning. being the greater portion of "Plot A" as
shown on map of Mattituck Heights, Subdivision Map property formerly of Gustav
Bayer. situate at Manituck, Suffolk County, New York surveyed by Otto W. Van Tuyl,
Licensed Surveyor, Greenport, New York, February 19", 1927 and filed in the office
of the County aerk of Suffolk County, New York, March 25,1927, File 192.
TOGETHER with the use of a private right of way fourteen feet wide to and from
Grant Boulevard and Wickham Avenue.
TOGETHER with the use of a right of way eight feet wide to and from Wickham
Avenue to Long Creek, a branch of Mattituck Bay to pass and repass on foot only;
said right of way commencing at the northerly junction of Middle Road and Wickham
Avenue; at a concrete monument, running in a westerly direction eight feet, thence
running in a northerly direction one hundred thirty feet parallel with the boundary line
now or formerly of Hubert W. Klein and Gustav Bayer, to mean high water mark of
Long Creek, thence running in an easterly direction along Long Creek to land now or
formerly of Hubert W. Klein; thence running in 0 southerly direction along the
western boundary now or formerly of Hubert W. Klein 130 feet to 0 concrete
monumenL the northerly junction of Middle Road and Wickham A venue, the point or
place of beginning.
PARCEL II:
ALL that certain IDL piece or parcel of land as shown on "Amended Map of Mattituek
Heights, Propeny formerly of Gustav Bayer at Mattituck, Suffolk County, New
York," filed in Suffolk County Clerk's office under file No. 1184 on the 24'ti day of
July, 1935, consisting ofall the land adjacent to Plot A in Farm Road, and that portion
of Plot E on said map, lying west of the extension southerly of the easterly line of Plot
A as shown on said map. SUBJECT, HOWEVER, to any rights of others of, in and
to said Farm Road. across said premises.
BEING AND INTENDED TO BE the same premises conveyed to the Grantor by
Deed of Edward J. Skirel and Jenny T. Skirel, his wife dated August 19, 1967 and
recorded on August 22. 1967 in the Suffolk County Clerk's Office in Liber 6206 page
460. the Grantor being the same person described as the Grantee in soid Deed.

Together with all right. title and interest, if any, of the party of the first pan in and to
any streets and roads abutting the above-described premises to the center lines thereof;

Together with the appunenances and all the estate and rights of the pany of the first
part in and to said premises;
THE GRANTOR HEREIN RESERVES A LIFE ESTATE in the premises and
funher reserves the power to appoint. in whole or in part. the property conveyed
hereunder to or for the benefit of anyone or more persons with the exception of the
Grantor, the Grantor's estate, creditors of the Grantor or creditors of the Grantor's
estate in such proportions. outright or upon such trusts, terms and conditions as the
Grantor may specif)' by his last Will or Codicil making specific reference hereto.
Failure to record notice of any such exercise of this power in the Suffolk County
Clerk's Office within sixty (60) days of the Grantor's death shall be conclusively
treated as a default in the exercise of power. A release of the power reserved
hereunder, in whole or in pan, shall be effective when recorded with the Suffolk
County Oerk's Office. Any exercise or release of the foregoing power may be made
by the Granror's attorney-in-fact, acting under a durable power of allomey;
To have and to hold the premises herein granted unto the party of the second part. the
heirs or successors and assigns of the party of the second pan forever.
And the party of the first part covenants that the pany of the first part has not done or
suffered anything whereby the said premises have been encumbered in any way
whatever, except as aforesaid.
And the party of the first part, in compliance with Section 13 of the Lien Law,
covenants that the pany of the first pan will receive the consideration for this
conveyance and will hold the right to receive such consideration as a trust fund to be
applied first for the purpose of paying the cost of improvement and will apply the
same first to the payment of the cost of the improvement before using any part of the
total of the same for any other purpose. The word "party" shall be construed as if it
read "partics" whenever the sense of this indenture so requires.
