REASON FOR APPEAL
Continued
1. STRICT APPLICATION OF THE ORDINANCE would produce UNDUE HARDSHIP because: this
lot is made by an equal division of the available frontage between proper-
ties already sold and built upon. The side yard reduction requested is
necessary due to the lack of full frontage', the ,lots- either .side of this
were sold prior to the' enactment of the ordinancE!!, 'it would be an undue
hardship to deny this request as the lots cannot be enlarged.
2. The hardship created is UNIQUE and is not shared by 011 properties olike in the immediate
vicinity af this property ond in this use district becouse ~: : This is the only property
left for sale between JlDeuiously sold lots on this section W/S North
Bay View Road, that has frontage that will not divide up to meet requirement
3. The Voriance would observe the spirit of the Ordinonc'e ond WOULD NOT CHANGE THE

c. The wark covered by this applicatian may not be commenced be.fore issuance of Building Permit.
d. Upon approval of this application, the Building Inspector will issue a Building Permit to the applicant. Such

Development Corptration under Contract of Sale dated June 24, 1959.
All that tract or parcel of land situate, lying and being at Pine
Neck,Southold, in the Town of Southold, County of Suffolk and State
of New York, bounded and described as follows:
BEGINNING at an iron pipe on the westerly line of North Bayview Road
150.0 feet northerly along said westerly line from Oakwood Drive, said
point of beginning being the northeasterly corner of land of Byrnes;
from said point of beginning running along said land of Byrnes and
along land of the party of the first part, South 83 degrees 05 minutes
30 seconds West a distance of 150.0 feet; thence along said land of
