BARGAIN AND SALE DEED WITH COVENANT AGAINST GRANTOR ACTS
THIS INDENTURE, made the October I b, 2001, between
Charles F. DiGiovanna, of 170 Dolphin Cove Quay, Stamford, Connecticut 06902,
party of the first part, and
Rosalie Mangels residing at 38 Morris Avenue, West Islip, New York 10709, and Lynda O'Grady,
residing at 1 Summit Street, Eastchester, New York 11795, as tenants in common,
party of the second part:
WITNESSETH, that the party of the first part, in consideration of one dollar and other good and
valuable consideration, lawful money of the United States, paid by the party of the second part, does
hereby grant and release unto the party of the second part, their and assigns forever, all
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected,
situate, lying and being at East Marion, Town of Southold, County of Suffolk and State of New York,
bounded and described as follows:

BEGINNING at a point on the northeasterly side of West Lane, which point is south 31 degrees 01
minutes 30 seconds East, a distance of 209.35 feet from a point marked by a monument set at the
intersection of the northeasterly line of West Lane with the southerly line of North Lane (and which point
is North 31 degrees 01 minutes 30 seconds West, a distance of 300 feet from the intersection of the
northeasterly side of West Lane with the westerly corner of land now or formerly of William V. Howard
and Wife); running thence North 58 degrees 58 minutes 30 seconds East, a distance of 130.0 feet to a
point; running thence South 31 degrees 01 minutes 30 seconds East a distance of 100.0 feet to a point;
running thence South 58 degrees 58 minutes 30 seconds West, a distance of 130.0 to a point on the
northeasterly side of West Lane; running thence along the northeasterly side of West Lane, North 31
degrees 01 minutes 30 seconds West, a distance of 100 feet to the point or place of beginning.
THE ABOVE described premises, according to survey by Van Tuyl and Son, dated February 2, 1970,
being more particularly described as follows:
BEGINNING at a point on the northeasterly side of West Lane two hundred (200) feet northwesterly of
the intersection of said line of West Lane with the northwesterly line of land conveyed to William V.
Howard and Ruth W. Howard by deed dated September 19, 1951, and; running thence northeasterly at
right angles to West Lane one hundred thirty (130) feet; thence northwesterly parallel to West Lane one
hundred (100) feet; thence southwesterly again at right angles to West Lane one hundred thirty (130)
feet to West Lane and; thence southeasterly along the northeasterly line of West Lane one hundred
(100) feet to the point of beginning.
Premises known as West Lane, East Marion, New York, and also known as Section 038.00, Block
06.00, Lot 001.000 on the Suffolk County Land and Tax Map, and being the same premises conveyed
to Charles F. DiGiovanna, Rosalie Mangels and Linda O'Grady by deed dated November 6, 1985 and
recorded in the Office of the Clerk of the County of Suffolk on November 18, 1985 in deed liber 9917
page 347.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any
streets and roads abutting the above described premises to the center lines thereof.
TOGETHER with the appurtenances and all the estate and rights of the party of the first part in
and to said premises.
TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, their
and assigns forever. And the party of the first part covenants that he has not done or suffered anything
whereby the said premises have been encumbered in any way whatever.
And the party of the first parUgrantor, in compliance with Section 13 of the Lien Law, covenants
that the party of the first parUgrantor will receive the consideration for this conveyance and will hold the
right to receive such consideration as a trust fund to be applied first for the purpose of paying the cost
of the improvement and will apply the same first to the payment of the cost of the improvement before
using any part of the total of the same for any other purpose. The word "party" or "grantor" shall be
construed as if it read "parties" or "grantors" whenever the sense of this document so requires.
IN WITNESS WHEREOF, the party of the first part has hereunto set his hand and seal the day
and year first above written.
