consideration paid by the party of the second part, docs hereby grant and release unto the party

TOGETHER wiih an casement for passage between Pcconic Bay Boulevard and Pcconic Bay
over a certain 10 foot right of way, in common with all others now having such right of way

The easterly line of subjcctl0 foot right of way is described as follows:
BEGINNING at a point on the southerly line of Pcconic Bay Boulevard, 200.20 feet westerly
ale'ng said line from the northeasterly corner of land of Haggerty Estate; and
RUNNING along land of Haggerty Eslalc on a line parallel to the easterly line of said land of
Haggerty Estate and 200.00 feet westerly therefrom, South 20 degrees 23 minutes 00 seconds
East, 500.00 feet, more or less, to ordinaty high water mark of Great Peconic Bay: the
westerly line of said 10 foot right of way is parallel to and 10.00 teet wcsterly from the
easterly line herein described and runs from Pcconic Bay Boulevard to Great Pcconic Bay.
Said easement is subject to the following covenants and conditions:
1. Said casement is for foot travel only.
2. It sbaU not be obstructed in any way and it shall be the joint responsibility of all those
having a right to use said right of way for the time being.
3. Said casement shall be perpetUal and shall run with the land but no casemenl or rights
in said right of way shall vest in the general public. It shall be a private righl of way.
BEING AND INTENDED TO BE the same premises conveyed to the party of the first part by
deed dated 11111185, and recorded 113/86, in the Office of the Suffolk County Clerk in Liber
9948, Page 433.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any
sll'1ects and roads abutting the above described premises tD the center lines thereof; TOGETHER
with the appurtenances and all the estate and rights of the party of the firsl part in and to said
premises; TO HAVE AND TO HOLD the premises herein granted unto the party Df the second
pal1. the heirs or suceessors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered
anything whereby the said premises have been encumbered in any way whatever, ell.ccpt as
aforesaid.
AND Ihe party of the first part, in compliance with Section 13 of the Lien Law, covenants that
the party of the first part will receive the consideration for this conveyance and will hold the
right to receive such consideration as a trust fund to be applied first for the purpose of paying the
cost of the improvement and will apply the same first to the payment of the cost of the
improvement before using any part of the total of the same for any other purpose.
Th,c word "party. shall be construed as ifit read "parties" whenever the sense of this indenture so
relluires.
