AUTHORIZATION
Pursuant to the provisions of Chapter 275 and/or Chapter 111 of the Town Code of the Town of
Southold and in accordance with the Resolution of the Board of Trustees adopted at the meeting held on
July 19, 2006, and in consideration of application fee in the sum of $250.00 paid by John Corbley and subject
to the Terms and Conditions as stated in the Resolution, the Southold Town Board of Trustees authorizes and
permits the following:
Wetland Permit to maintenance dredge a 133'+/- portion of an existing boat
basin to a depth of-4' referred to NGVD29, with sides sloping upward at
approximately 1:3 to existing grade, to an overall area 140'+/- x 29'; approximately 220
cubic yards of material will be dredged and moved off-site by truck to an approved
upland disposal site not less than 300' from any wetlands; dredge to same conditions in
four additional events over a ten-year period, with the condition that all dredging be
done by barge only, no machinery on land, a silt-boom/turbidity screen is used during
dredging, and as depicted on the survey prepared by Nathan Taft Corwin III, last
dated August 25, 2007, and received on November 30, 2007.
IN WITNESS WHEREOF, the said Board of Trustees hereby causes its Corporate Seal to be affixed,
and these presents to be subscribed by a majority of the said Board as of this date.
TERMS AND CONDITIONS
The Permittee John Corbley, residing at 680 Mason Drive, Cutchogue, New York as part of the
consideration for the issuance of the Permit does understand and prescribe to the following:
That the said Board of Trustees and the Town of Southold are released from any and all
damages, or claims for damages, of suits arising directly or indirectly as a result of any
operation performed pursuant to this permit, and the said Permittee will, at his or her own
expense, defend any and all such suits initiated by third parties, and the said Permittee
assumes full liability with respect thereto, to the complete exclusion of the Board of
Trustees of the Town of Southold.
That this Permit is valid for a period of 24 months, which is considered to be the estimated
time required to complete the work involved, but should circumstances warrant, request for
an extension may be made to the Board at a later date.
That this Permit should be retained indefinitely, or as long as the said Permittee wishes to
maintain the structure or project involved, to provide evidence to anyone concerned that
authorization was originally obtained.
That the work involved will be subject to the inspection and approval of the Board or its
agents, and non-compliance with the provisions of the originating application may be cause
for revocation of this Permit by resolution of the said Board.
That there will be no unreasonable interference with navigation as a result of the work
herein authorized.
That there shall be no interference with the right of the public to pass and repass along the
beach between high and low water marks.
That if future operations of the Town of Southold require the removal and/or alterations in
the location of the work herein authorized, or if, in the opinion of the Board of Trustees,
the work shall cause unreasonable obstruction to free navigation, the said Permittee will be
required, upon due notice, to remove or alter this work project herein stated without
expenses to the Town of Southold.
That the said Board will be notified by the Permittee of the completion of the work
authorized.
That the Permittee will obtain all other permits and consents that may be required
supplemental to this permit, which may be subject to revoke upon failure to obtain same.

Dear Mr. Corbley:
The Board of Town Trustees took the following action during its regular meeting held on
Wednesday, July 19, 2006 regarding the above matter:
WHEREAS, Proper-T Permit Services on behalf of JOHN CORBLEY applied to the
Southold Town Trustees for a permit under the provisions of Chapter 275 of the
Southold Town Code, the Wetland Ordinance of the Town of Southold, application
dated March 1, 2006, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council and to the Local Waterfront Revitalization Program Coordinator for their findings
and recommendations, and,
WHEREAS, the LWRP Coordinator issued a recommendation that the application be
found Consistent with the Local Waterfront Revitalization Program policy standards,
and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said
application on July 19, 2006, at which time all interested persons were given an
opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standards set forth in Chapter 275 of the
Southold Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees have found the application to be Consistent
with the Local Waterfront Revitalization Program, and,
RESOLVED, that the Board of Trustees approve the application of JOHN CORBLEY to
maintenance dredge a 133'+/- portion of an existing boat basin to a depth of -4' referred
to NGVD29, with sides sloping upward at approximately 1:3 to existing grade, to an
overall area 140'+/- x 29'; approximately 220 cubic yards of material will be dredged and
moved off-site by truck to an approved upland disposal site not less than 300' from any
wetlands; dredge to same conditions in four additional events over a ten-year period,

The proposed action has been reviewed to Chapter 95, Waterfront Consistency Review of
the Town of Southold Town Code and the Local Waterfront Revitalization Program
(LWRP) Policy Standards. Based upon the information provided on the LWRP
Consistency Assessment Form submitted to this department, as well as the records
available to me, it is my recommendation that the proposed action is generally
CONSISTENT with the Policy Standards and therefore is CONSISTENT with the
LWRP provided that:
1. If feasible~ the installation of a silt boom/turbidity screen during construction
activities is required to minimize turbidity in the water column.
Pursuant to Chapter 95, the Board of Trustees shall consider this recommendation in
preparing its written determination regarding the consistency of the proposed action.

the character of the waterfront community, and because there are no plans to in-
crease the development of the relatively small area it is felt that there is no adverse
impact on the desired preservation of open space. Infrastructure use is not a factor
since the project is to maintain an existing facility which is accessory to and ac-
cessed from private property. The project is certainly beneficial in supporting and
maintaining an existing use of the coastal location, without any incremental in-
crease in development in the area.

toric features, and it is to be expected that the mainly intertidal nature of the project

above-ground or above-water structures and upon its completion its effects will not
be visible either from land or from the water. It is compatible with other existing
shoreline structures and activities in the area, and will not adversely affect the dy-
namic landscape elements (tidal fluctuations, seasonal vegetation changes; sea-
sonal/diurnal changes in ambient light) which might contribute to ephemeral visual
qualities.

The proposed project does not include any activity which will have a long-term
adverse effect on water quality and supply. During the dredging operation, which
will take less than one work day, the bottom within the basin will, of course, be
disturbed and turbidity will result, but experience indicates that this will be self-
correcting within about another day. Liquid or solid wastes will not be discharged
into the water or wetlands before, during, or after the dredging..

The area to be dredged is completely devoid of wetland vegetation. During the
dredging, the indigenous plants in adjacent areas will be protected insofar as possi-
ble. The project is located in a Significant Coastal Fish and Wildlife Habitat, but
the nature of the project, considering that it is the maintenance of an existing ap-
proved docking area, is such that there will be no new impacts on any of the re-
sources listed in the NYSDOS narrative for Cutchogue Harbor and Wetlands. All
statutory and regulatory requirements, at all levels of government, will be strictly
complied with. No excavat'mg or filling is proposed.
