TERMS AND CONDITIONS
The Permittee Vincent & Eileen Flahertv. residing at 177 Inlet Wav. Southold. New York as
part of the consideration for the issuance of the Permit does understand and prescribe to the
following:
I. That the said Board of Trustees and the Town of Southold are released from any and all
damages, or claims for damages, of suits arising directly or indirectly as a result of any
operation performed pursuant to this permit, and the said Permittee will, at his or her own
expense, defend any and all such suits initiated by third parties, and the said Permittee .
assumes full liability with respect thereto, to the complete exclusion of the Board of
Trustees of the Town of South old.
2. That this Permit is valid for a period of 24 months, which is considered to be the estimated
time required to complete the work involved, but should circumstances warrant, request for
an extension may be made to the Board at a later date.
3. That this Permit should be retained indefinitely, or as long as the said Permittee wishes to
maintain the structure or project involved, to provide evidence to anyone concerned that
authorization was originally obtained.
4. That the work involved will be subject to the inspection and approval of the Board or its
agents, and non-compliance with the provisions of the originating application may be cause
for revocation of this Permit by resolution of the said Board.
5. That there will be no unreasonable interference with navigation as a result of the work
herein authorized.
6. That there shall be no interference with the right of the public to pass and repass along the
beach between high and low water marks.
7. That if future operations of the Town of South old require the removal and/or alterations in
the location of the work herein authorized, or if, in the opinion of the Board of Trustees,
the work shall cause unreasonable obstruction to free navigation, the said Permittee will be
required, upon due notice, to remove or alter this work project herein stated without
expenses to the Town of Southold.
8. That the said Board will be notified by the Permittee of the completion of the work
authorized.
9. That the Permittee will obtain all other permits and consents that may be required
supplemental to this permit, which may be subject to revoke upon failure to obtain same.

Dear Ms. Costello:
The Board of Town Trustees took the following action during its regular meeting held on
Wednesday, May 21, 2008 regarding the above matter:
WHEREAS, Costello Marine Contracting Corp., on behalf of VINCENT & EILEEN
FLAHERTY applied to the Southold Town Trustees for a permit under the provisions of
Chapter 275 of the South old Town Code, the Wetland Ordinance of the Town of
Southold, application dated April 30, 2008, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council and to the Local Waterfront Revitalization Program Coordinator for their findings
and recommendations, and,
WHEREAS, the LWRP Coordinator recommended that the proposed application be
found Inconsistent with the LWRP, and,
WHEREAS, the Board of Trustees has furthered Policy 6 of the Local Waterfront
Revitalization Program to the greatest extent possible through the imposition of the
following Best Management Practice requirements: a 33' small stone retaining wall with
filter cloth and an 8' return in lieu of a low-profile bulkhead, re-vegetate any disturbed
areas, and
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said
application on May 21, 2008, at which time all interested persons were given an
opportunity to be heard, and,

WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standards set forth in Chapter 275 of the
South old Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that for the mitigating factors and based upon the Best Management
Practice requirement imposed above, the Board of Trustees deems the action to be
Consistent with the Local Waterfront Revitalization Program pursuant to Chapter 268-5
of the Southold Town Code, and,
RESOLVED, that the Board of Trustees approve the application of VINCENT & EILEEN
FLAHERTY to remove the existing stairway to beach and kayak rack; remove 63' of
existing west bulkhead and replace in-place; construct a 33' small stone retaining wall
with an 8' return on the west end, with the condition to re-vegetate any disturbed areas,
and as depicted on the site plan prepared by Costello Marine Contracting Corp. last
dated June 4, 2008, and received on June 6, 2008.
Permit to construct and complete project will expire two years from the date the permit
is signed. Fees must be paid, if applicable, and permit issued within six months of the
date of this notification.
Inspections are required at a fee of $50.00 per inspection. (See attached schedule.)

Wetland Permit to remove the existing stairway to beach and kayak rack. Remove 63' of existing

The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the
Town of South old Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. Based upon the information provided on the L WRP Consistency Assessment Form
submitted to this department, as well as the records available to me, it is my recommendation that
the proposed action is INCONSISTENT with LWRP policy standards and therefore is
INCONSISTENT with the LWRP.
The proposed action includes the construction of a new 33' low-profile bnlkhead on West
end. Onlv in-place replacement of existinl! functional bulkheads (as defined in IS 275-2) is
permitted. In addition the proposed 33' low-profile bulkhead on the West end potentiallv
could alter the sand deposition and tidal rel!ime in the channel.
Policy 6 Protect and restore the quality and function of the Town of Southold
ecosystem.
6.3 Protect and restore tidal and freshwater wetlands.
A. Comply with statutory and regulatory requirements of the Southold Town Board of
Trustees laws and regulations for all Andros Patent and other lands under their
jurisdiction
I. Comply with Trustee regulations and recommendations as set forth in
Trustee permit conditions.

~ 275-11 Construction aud operation standards.
B. Shoreline structures. The following standards are required for all operations relating to
shoreline structures on residential properties. Operations conducted on properties zoned MI or
M2 may be given greater flexibility in these requirements given the water-dependent nature of
their use. [Amended 10-11-2005 by L.L. No. 17-2005]
(1) Bulkheads, retaining walls, revetments and gabions.
(a) Only in-place replacement of existing functional bulkheads (as defined in
~ 275-2) is permitted. In-kind replacement relates to the position and
dimensions and does not necessarily require or allow for the use of the same
materials. At its discretion, the Board may allow for a one-time projection of the
replacement structure seaward of the original, only if such placement will not
project the proposed structure seaward of adjacent, neighboring structures and if
the proposed installation is in close proximity to the original structure. Any
subsequent repair or replacement following the first replacement requires the
structure to be built on or landward of the original structure,
It is recommended in the event the proposed action is approved pursuant to Iii 275-11 and to
fnrther L WRP sub-policy 6.2. The scheduline activities of any proposed action with in this
New York State Desienated Sienificant Coastal Fish and Wildlife Area should be avoided
durine the nestine and fledeline periods (March 15 throueh Aueust 15) of shorebirds
inhabitine Cedar Beach Point.
Policy 6 Protect and restore the quality and function of the Town of Southold
ecosystem.
6.2 Protect and restore Significant Coastal Fish and Wildlife Habitats.
A. Protect Significant Coastal Fish and Wildlife Habitat values from uses or
activities that would:
1. Destroy habitat values associated with the designated habitat through:
a. direct physical alteration, disturbance, or pollution, or
b. indirect effects of actions, which would result in a loss of habitat.
The Town of Southold is rich in habitats that support diverse and often large wildlife
populations, many of which are of commercial or recreational value. The importance
of these habitats has been recognized through the state designation of nineteen
Significant Coastal Fish and Wildlife Habitats in Southold:
Reach 7 Cedar Beach Point
These habitats cover the full range of habitats typical on the East End of Long Island
and include dunes, beaches, wetlands, islands and open water. The Town of Southold
recognizes the importance of protecting and enhancing these wetlands and habitats.
All of these habitats have experienced and continue to experience human disturbance.
This includes the effects of bulkheadinf!. filling and dredging, removal of vegetation,

adjacent land uses, and recreational activities and facilities, such as fishing, hunting and
boating and the associated marina and boat launch facilities. These impacts do not have
to destroy or impair the natural resources of the habitats. In addition to avoiding
incompatible use of the habitats and adjacent land, many management measures can be
taken to ensure that negative impacts do not occur.
CEDAR BEACH POINT IS DESIGNATED AS A NEW YORK STATE SIGNIFICANT
COASTAL FISH AND WILDLIFE HABITAT: Cedar Beach Point is a small coastal wetland
area. similar in nature to many other ooints around the Peconic Bavs shoreline. but imoortant as a
habitat for various fish and wildlife soecies. Construction and maintenance of shoreline
structures. such as docks. oiers. bulkheads. or revetments. in any Dart of this area. may have a
significant imoact on the fish and wildlife resources of Cedar Beach Point. Nestin!! shorebirds
inhabitin!! Cedar Beach Point are hi!!hlv vnlnerable to disturbance bv humans. eSDeciallv
durin!! the nestin!! and fled!!in!! Deriod (March 15 throu!!h AUl!Ust 15), Significant oedestrian
traffic or recreational vehicle use of the beach could easilv eliminate the use of this site as a
breeding area and should be minimized during this oeriod.

Our proposal is consistent with this policy. Presently there is an existing bulkhead that is showing
signs of age. Our proposal is to reconstruct this existing structure and to extend it a little further to
fully protect the area. This project area is residential and this project is reasonable for the area.

This project location has no significant historic resources.
Enhance visual quality and protect Selenic resources throughout the Town of Southold.
Our proposal will not have a negative impact on the visual quality or scenic resources. This proposal

Our proposed dock facility will have minimal effects on the ecosystem. During the initial construction
of the section of bulkhead there will be a disturbance to the backside of the bulkhead where
excavating will be needed to place the backing system. Best management practices will be adhered
to so that the ecosystem is protected as much as possible.
