C at (No Number) Hamilton Avenue, Mattituck, New York 11952 party of the second part, WITNESSETH,that the party of the first part, in consideration of Ten Dollars and other valuable consideration paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs or successors and assigns of the party of the second part forever, ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate, lying and beingiR� at Mattituck in the Town of Southold, Suffolk County, New York, bounded and described as follows : BEGINNING at a point on the northwesterly line of land of the Long Island Rail Road, distant North 45° 05 ' 00" East, 77. 52 feet as measured along the northwesterly line of land of the Long Island Railroad, from the corner formed by the intersection of the north- westerly line of land of Long Island Railroad and the northeasterly " side of Westphalia Avenue said point of beginning also being where the northeasterly line of land of Harry Sacks intersects the north- westerly line of land of Long Island Railroad; running thence North ,` < 44° 55 ' 00" West, along said land of Sacks , 65 .00 feet to a 25 foot'' right of way (formerly Albert H. Silkworth and formerly of Henry P. Tuthill) ; thence North 451 05 ' 00" East, along said right of way, 30. 00 feet to land formerly of Albert H. Silkworth (formerly Henry P,:: Tuthill) ; thence South 441 55 ' 00" East, along said last mentioned land, 65 .00 feet to land of Long Island Railroad; thence South 45° 05 ' 00" West, along said last mentioned land, 30.00 feet to the pointe or place of BEGINNING. TOGETHER with a non-exclusive right of way 25 feet in width running from the northeast corner of said premises west along land of Sacks to Westphalia Avenue. The party of the first part herein is the same•person as the grantee in the deed dated 8/22/74 recorded 8/26/74 in Liber 7701 cp 415 . TOGET11EK with all right, title and interest, if any, of the party of the first part in and to any streets and roads abutting the above described premises to the center lines thereof; TOGETHEK with theappurtenances and all the estate and rights- of the party of the first part in and to said premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of the second part forever. AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby the said 'premises have been encumbered in any way whatever, except as aforesaid. AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first part will receive the consideration for this conveyance and will hold the right to receive such consid- eration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply`" the same first to the payment of the cost of the improvement before using any part of the total of the same for any other purpose.
