URIST, residing at 300 Marlene Lane, Mattituck, New York 11952, as Tenants in Common, the party of the second part, WITNESSETH, that the party of the first part, in consideration of TEN and 00/100-------------- -------------------------($10.00) --dollars, and other good and valuable consideration paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs or successors and assigns of the party of the second part forever, all their right, title and interest in and to: ALL that certain plot, piece or parcel of land situate, lying and being In the Town of Southold, County of Suffolk and Stale of New York, bounded and described as follows: BEGINNING at a rail set in the southwesterly side of Love Lane where the same southwesterly side of Love Lane is intersected by the division line between the premises herein and land now or formerly of the Long Island Railroad Co.; RUNNING THENCE South 45 degrees 05 minutes 00 seconds West along land now or formerly of Long Island Railroad Co., 100.00 feet to a monument and land now or formerly of Sidor and others; THENCE North 49 degrees 17 minutes 00 seconds west along said land, 13S.00 feet to a concrete monument; THENCE North 67 degrees 03 minutes 00 seconds West still along said land, 65.14 feet to land now or formerly of Nine, formerly of Ball; THENCE North 53 degrees 33 minutes 30 seconds East along said land, 165.63 feet to the southwesterly side i of Love L.ane; and THENCE South 35 degrees 17 minutes 40 seconds East along the said southwesterly side of Love Lane 17;3.00 feet to the aforementioned rail at the point or place of BEGINNING. SUBJECT' to the reservation In favor of the lands adjoining the above described premises on the West of a right of way and easement for travel access and all utility purposes over the southerly 20 teet of the premises above described; the easement parcel being bounded South by The Long Island Railroad Co. land, North by a line of 20 feet northerly therefrom measured at right angles to the South line and parallel thereto and westerly by the westerly line of the parcel above described and easterly by Love Lane; this easement and right of way shall cease and become void in the event that the premises to the West, for whose benefit it is aeated, ever becomes merged in title with other lands fronting on Love Lane (in which event the land to the West would then have access to Love Lane without the benefit of this right of way). BEING AND INTENDED TO BE the same premises conveyed to the party of the first part by deed dated June 10, 1976 and recorded in the Office of the Clerk of the County of Suffolk on June 21, 1976 in Uber 8053, page 553. TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads abutting the above described premises to the center lines thereof; TOGETHER with the appurlenances and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second pari, the heirs or successors and assigns of the party of the second part forever. AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby the said premises have been encumbered in any way whatever, except as aforesaid. AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first part will receive the consideration for this conveyance and will hold the right to receive such consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the improvement before using any part of the total of the same for any other purpose. The word "party" shall be construed as if it read "parties' when ever the sense of this indenture so requires.
