RESOLVED, that the Southold Town Board of Trustees APPROVE the Amendment to
Wetland Permit #6871 to construct a 4'x59' catwalk with a 4'x4' stairway at the seaward
end, and as depicted on the revised site plan prepared by Christian Fokine last dated
January 28, 2009, and received on Mamh 5, 2009.
Any other activity within 100' of the wetland boundary requires a permit from this office.
This is not a determination from any other agency.

Please accept my apology for not being able to attend the hearing on 3118/09, in
mfereece to amending our current dock permit #6871 dated 5/21/08, tax map ~1000-70-04-
t8.
The amendment was necessary due to changes in dock length requested and
granted by the DEC as per Mr. George Hammmth Permit Admi. istrator. The lengttt
approved by the trustees was 67' 0" including a 4' stairway, The length has been reduced
to 63' 0" including the 4'stairway. All other dlmenslo~s and specifications remain
unchanged as you previously approved.
This amendment will only lessen the environmental impact and navigability
of Jockey Creek Canal.

NATURAL RESOURCE PERMIT CONDITIONS - Apply to the Following
Permits: TIDAL WETLANDS
1. State Not Liable for Damage The State of New York shall in no case be liable for any damage or
injmy to t~ structure or work herein authorized which may be caused by or result from future operations
undertakt~ by the State for the conservation or improvement of navigation, or for other purposeg~ and no
claim 0r right to compensation shall accrue from any such damage.
2. Approved Plans Site plan and crossview drawings by Christian Fokine stamped "NYSDEC
Approved 2/12/09". Site plan dated 5/23/08, last revised 1/28/09. Crossview dated 5/23/08, last revised
2/2/09.
3. Notice of Commencement At least 48 hours prior to commencement of the project, the permittee
and contractor shall sign and return.the top portion of the enclosed notification form certifying that they
are fully aware of and understand all terms and conditions of this permit. Within 30 days 0f completien
of project, the bottom portion of the form must also be signed and returned, along with photographs of
the completed work.
4. Catwalk Size and Construction The catwalk shall not exceed 4 feet in width, shall be a minimum
of 3.5~feet above grade (as measured from the ground to the bottom of the catwalk decking) over the
tidal wetland areas and shall be constructed of open-grate material.
$. No Floats This permit does not authorize the installation of floats.
6. Docks ai Property Lines Docks/catwalks/floats must not:
a. extend laterally beyond property lines,
b. be placed so that docked boats extend laterally over adjacent property line,
c. interfere with navigation, or
d. interfere with other landowners riparian rights
7. No Permanent Structures on Dock No permanent structures shall be installed on
dock/catwalk/float Without first obtaining written Department approval (permit, modification, or
amendment).

8. Use of Treated Wood The use of wood treated with pentachlorophenol or other wood treatment not
specifically approved by the department for use in wetlands and/or marine waters, is strictly prohibited
in the construction of structures that will be in contact with tidal waters.
9. No Disturbance to Vegetated Tidal Wetlands There shall be no disturbance to vegetated tidal
wetlands or protected buffer areas as a result of the permitted activities.
10. No Construction Debris in Wetland or Adjacent Area A~y debris or excess material from
censtmction of this project shall be c0~Pletely removed from the adjacent area (upland) and removed to
an approved upland area for disposal. No debris is permitted in wetlands and/or protected buffer areas.
11. Conformance, With Plans All activities authorized by this permit must be in strict conformance
with the approv~Plans submitted by thc applicant or applicant's agent as part of the p~it application.
Such approved Plans were prepared by Christian Fokine stamped NYSDEC Approved 2/i2/09. Site plan
dated 5/23/08, last revised 1/28/09. Crossview dated 5/23/08, last revised 2/2/09..
12. Stat~May Order Removal or Alteration of Work If future operations by thc State of New York
require ~ alteration in the position of the structure or work herein authorized, or if, in the opinion of thc
Dep~ent of Environmental Conservation it shall cause unreasonable obstruction to the free navigation
of said waters or flood flows or endanger the health, safety or welfare of the people of the State, or Cause
loss Or destruction of the natural resources of the State, thc owner may be ordered by the Department to
remove or alter the structural work, obstructions, or hazards caused thereby without expense to the State,
and if, upon the expiration ur revocation of this permit, the stmcture,~fill, excavation, or other
modification of the wat~ursc hereby authorized shall not bc completed, the owners, shall, without
expense to th~.~(~; and to such extent and in such time. and manner as the Department of
Envirpnm~tal Conservation may require, remove all or any portion of the uncompleted Structure or fill
and restore to its former condition thc navigable and flood capacity of the waterC°ursc. No claim shall
be made against thc State of New York on account of any sUch removal 6~ alteration.
13. Precautions Against Contamination of Waters All necessary precautions shall be taken to
preclude contamination of may wetland or waterway by suspanded solids, sediments, fuels, solvents;
lubric~ts, epoxy coatings, paints, concrete, leachate or any other environmentally deleterious mat~als
associated with~e projeet~
14. State ~ Requi~6 Site Rest6rati°n Ifup0n the expiration ~ rev0cati0h 0fthis permit, the
project hereby authorized has not been completed, the applicant shall, without expense to the State, and
to such extent'~d in such time and manner as the Department of Environmental Conservation may
require, remove all or any portion of the uncompleted structure or fill and restore the site to its former
condition. No claim shall be made against the State of New York on account of any Such removal or
alteration.

GENERAL CONDITIONS - Apply to ALL AUthorized Permits:
1. Facility Inspection by The Department The permitted site or facility, including relevant records, is
subject to inspection at reasonable hours and intervals by an authorized representative of the Department
of Environmental Conservation (the Department) to determine whether the permittee is complying with
this permit and the ECL. Such repres, entat~ve may or~ ~e work suspended pursuant to ECL 71- 0301
and SAPA 401(3).
The permittee shall provide a person to accompany the Department's representati~e~during an inspection
to the permit area when requested by the Department.
A copy of this permit, including all ~eferenced maps, drawings and special conditions, must be available
for inspection by the Department at all times at the project site or facility. Failure to produce a copy of
the permit Upon request by a Department representative is a violation of this permit.
z. Re!~fionship of this Permit to Other Department Orders and Determinations Unless expressly
provided for by the Department, issuance of this permit does not modify, supersede or rescind any 6rder
or determination previously issued by the Department or any of the terms, conditions or requirements
contained in such order or determination.
3. Applications For Permit Renewals, Modifications or Transfers The p~ittee must submit a
separate written application to the Department for permit renewal, modification or transfer of this
permit. Such app~li~tion must inclUde any forms or supplemental information the Department requires.

4. Submission of Renewal Application The pevmi'ttee must submit a renewal application at least 30
days before permit expiration for the following permit authorizations: Tidal Wetlands.
5. Permit Modifications, Suspensions and Revocations by the Department The Department
reserves the fight' t0 modify, suspend or revoke this permit. The grounds for modificatiOn, suspension or
revocation include:
a. materially false or inaccurate statements in the permit application or supporting papers;
b. failure by the permittee to comply with ~y terms or conditions of the permit;
c. exceeding the scope of the project as described in the permit application;
d. newly discovered material information or a material change in environmental conditions, relevant
technology or applicable law or regulations since the issuance of the existing permit;

noncompliance with previously issued permit conditions, orders of the commissioner, any
provisions of the Environmental Conservation Law or regulations of the Department related to
the permitted activity.
6. Permit Transfer Permits are transferrable unless specifically prohibited by statute, regulation or
another permit condition. Applications for permit transfer should be submitted prior to actual transfer of
ownership.
NOTIFICATION OF OTHER PERMITTEE OBLIGATIONS
Item A: Permittee Accepts Legal Res~0nsibility and Agrees to Inde~ifieation
The permittee, excepting sta~ 0~ federal agencies, expressly agrees to indemnify and hold harmless the
Department of Environmental Conservation of the State of New York, its representatiges, employees,
and agents ("DEC") for all claims, suits, actions, and damages, to the extent attributable to the
permittee's acts or ~issions in connection with the permittee's undertaking of activities in connection
with, or operati0n and maintenance of, the facility or facilities authorized by the permit whether in
compliance or not in compliance with the terms and conditions of the permit. This indemnification does
not extend to ~y claims, suits, actions, or damages to the extent attributable to DEC's own negligent or
intentional acts or omissions, or to any claims, suits, or actions naming the DEC and arising under
Article 78 ~fthe New York Civil Practice Laws and Rules or any citizen suit or civil rights provision
under federal or state laws.
Item B: Permittee's Contractors to Comply with Permit
The permittee is.responsible for informing its independent contractors, employees, agents and assigns of

Pursuant to the provisions of Chapter 275 and/or Chapter 111 of the Town Code of the Town of
Southold and in accordance with the Resolution of the Board of Trustees adopted at the meeting held on

TERMS AND CONDITIONS
The Permit:tee Christian & Heidi Fokine, residing at 2505 Wells Avenue, Southold~ New York
as part of the consideration for the issuance of the Permit does understand and prescribe to the
following:
1. That the said Board of Trustees and the Town of Southold are released from any and all
damages, or claims for damages, of suits arising directly or indirectly as a result of any
operation performed pursuant to this permit, and the said Permittee will, at his or her own
expense, defend any and all such suits initiated by third parties, and the said Permittee
assumes full liability with respect thereto, to the complete exclusion of the Board of
Trustees of the Town of Southold.
2. That this Permit is valid for a period of 24 months, which is considered to be the estimated
time required to complete the work involved, but should circumstances warrant, request for
an extension may be made to the Board at a later date.
3. That this Permit should be retained indefinitely, or as long as the said Permittee wishes to
maintain the structure or project involved, to provide evidence to anyone concerned that
authorization was originally obtained.
4. That the work involved will be subject to the inspection and approval of the Board or its
agents, and non-compliance with the provisions of the originating application may be cause
for revocation of this Permit by resolution of the said Board.
That there will be no unreasonable interference with navigation as a result of the work
herein authorized.
That there shall be no interference with the right &the public to pass and repass along the
beach between high and Iow water marks.
That if future operations of the Town of Southold require the removal and/or alterations in
the location of the work herein authorized, or if, in the opinion of the Board of Trustees,
the work shall cause unreasonable obstruction to free navigation, the said Permittee will be
required, upon due notice, to remove or alter this work project herein stated without
expenses to the Town of Southold.
The Permittee is required to provide evidence that a copy of this Trustee permit has been
recorded with the Suffolk County Department of Real Properties Office as a notice
covenant and deed restriction to the deed of the subject parcel. Such evidence shall be
provided within ninety (90) calendar days of issuance of this permit.
That the said Board will be notified by the Permittee of the completion of the work
authorized.
That the Permittee will obtain all other permits and consents that may be required
supplemental to this permit, which may be subject to revoke upon failure to obtain same.

Wednesday, May 21, 2008 regarding the above matter:
WHEREAS, Polywaters Permits LLC, on behalf of CHRISTIAN & HEIDI FOKINE
applied to the Southold Town Trustees for a permit under the provisions of Chapter 275
of the Southold Town Code, the Wetland Ordinance of the Town of Southold,
application dated January 14, 2008, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council and to the Local Waterfront Revitalization Program Coordinator for their findings
and recommendations, and,
WHEREAS, the LWRP Coordinator recommended that the proposed application be
found Inconsistent with the LWRP, and,
WHEREAS, the Board of Trustees has furthered Policy 5, 6, 9 & 11 of the Local
Waterfront Revitalization Program to the greatest extent possible through the imposition
of the following Best Management Practice requirements: the fixed catwalk is reduced

WHEREAS, a Public Hearing was held by the Town Trustees with respect to said
application on May 21,2008, at which time all interested persons were given an

premises in question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standards set forth in Chapter 275 of the
Southold Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that for the mitigating factors and based upon the Best Management
Practice requirement imposed above, the Board of Trustees deems the action to be

Re: Pre-application site inspection and evaluation, Jockey Creek
Board of Trusties,
We have recently purchased property at 2505 Wells Avenue (SCTM#1000/70/04/18)
bordering an off-shoot of Jockey Creek. We are looking into the possibility of
constructing a catwalk from the upland area to the creek with a float. It would be similar
to the other floats in that area of the creek.
While we understand that the formal permitting process is very involved and includes
both your board as well as the DEC, Army Corps of Engineers and the Dept. of State, we
would like to know if there are certain things we should completely stay away from as
well as what options might be possible before we start preparing a design and plan that
may not be in sync with Town.
We are including a survey of the property showing what we would like to construct. If
possible, we would like to meet at the property so that we could discuss the proposed

Permit to construct a 4'X 64' fixed catwalk and 4'X 8' stairs, using 6" treated wood pilings and
transparent plastic oralam grated decking. Located: 2505 Wells Ave., Southold. SCTM#70-4-18
The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the
Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. Based upon the information provided on the LWRP Consistency Assessment Form
submitted to this department, as well as the records available to me, it is my recommendation that
the proposed action is INCONSISTENT with LWRP policy standards and therefore is
INCONSISTENT with the LWRP.
Policy 5 Protect and improve water quality and supply in the Town of Southold.
It is recommended in the event the dock is approved and to further the above LWRP policy
5, that the Board of Trustees prohibit the use of {CCA) treated lumber in the construction
of the proposed action pursuant to § 275-11. To reduce a dock's potential adverse impacts
to the environment preservatives is prohibited for use in sheathing and decking on
structures in the wetlands as well as on any part of a structure in low tidal flow wetland
areas as determined by the Trustees. The proposed proiect description describes the use of
(20) 6" treated wood pilings. The use of treated pilings as defined in § 275-11 as (any part
of a structure) in Iow tidal flow wetland areas will be determined by the Trustees.
§ 275-11 Construction and operation standards.
C. In water. The following standards are required for all in-water operations adjacent to
residential properties. Operations conducted on properties zoned MI or M2 may be given greater
flexibility in these requirements given the water-dependent nature of their use.
(2) Docks.
(a) Standards for residential and commercial docks; general rules. It shall be the
policy of the Town of Southold that all docks shall be designed, constructed and located
so as to reduce a dock's potential adverse impacts to navigation, public safety, waterway
congestion, access to public trust lands and water, and natural resources and habitats.
The following standards will.
In order to prevent the release of metals and other contaminants into the
wetlands and waters of Southold, the use of lumber pre-treated with any
preservative, including but not limited to chromated copper arsenate (also
known as "CCA ",), commercial copper quat (CCQ), penta products, Alkaline
Copper Quat (ACQ), or homemade wood preservatives is prohibited for use in
sheathing and decking on structures in the wetlands as well as on any part ora
structure in Iow tidal flow wetland areas as determined by the Trustees. The use
of creosote is prohibited. The use of tropical hardwoods is prohibited unless it is
certified by the Forest Stewardship Council or similar organization. Materials
used for structural components shall be at the discretion of the Trustees.

Policy 6 Protect and restore the quality and function of the Town of Southold
ecosystem.
6.1 Protect and restore ecological quality throughout the Town of Southold.
6.2 Protect and restore Significant Coastal Fish and Wildlife Habitats.
A. Protect Significant Coastal Fish and Wildlife Habitat values from uses or
activities that would:
1. Destroy habitat values associated with the designated habitat through:
a. direct physical alteration, disturbance, or pollution, or
b. indirect effects of actions, which would result in a loss of habitat.
The proposed action is located with in a Tidal Wetland system in the Jockey Creek area.
This natural system is typical in the Town of Southold, which recognizes the importance of
protecting and enhancing this wetland and associated habitats. Activities during
construction can have potential negative impacts on the resource. Where destruction or
impairment of habitat values cannot be avoided~ minimize potential impacts of land use or
development through appropriate mitigation. Use mitigation measures that are likely to
result in the least environmentally damaging feasible alternative.
Mitigation includes:

b. scheduling activities to avoid vulnerable periods in life cycles or
the creation of unfavorable environmental conditions,

a. reducing scale or intensity of use or development,
b. designing projects to result in the least amount of potential adverse impact,
c. choosing alternative actions or methods that would lessen
potential impact.
6.3 Protect and restore tidal and freshwater wetlands.
A. Comply with statutory and regulatory requirements of the Southold Town Board of
Trustees laws and regulations for all Andros Patent and other lands under their
jurisdiction
1. Comply with Trustee regulations and recommendations as set forth in
Trustee permit conditions.
The applicant must demonstrate that the following dock standards pursuant to § 275-11

Review and approval of dock applications. Before issuing a permit for a dock
structure, the Trustees shall consider whether the dock will have any of the
following harmful effects:
[1] ?Zhether the dock will impair navigation or be located in areas of high vessel
traffic or vessel congestion;
[2] l'Yhether the dock will unduly interfere with the public use of waterways for
swimming boating, fishing shellfishing waterslding and other water-dependant
activities;
[3] I~ether the dock will unduly interfere with transit by the public along the public
beaches or foreshore;
[4] t~hether the dock will significantly impair the use or value of waterfront property
adjacent to or near the dock;
[5] gffhether the dock will cause degradation of surface water quality and natural
resources;
[6] Whether the dock will cause habitat fragmentation and loss of significant coastal
fish and wildlife habitats;
[7] Whether the dock will result in the destruction of or prevent the growth of
vegetated wetlands, seagrasses including eelgrass (Zostera marina) and widgeon
grass (Ruppia maritima) or shellfish;
[8] IV/tether the dock will unduly restrict tidal flow or water circulation;
[9] Whether the dock will be safe when constructe&
[10] Whether the dock will adversely affect views, viewsheds and vistas important to
the community;
[11] Whether the cumulative impacts of a residential and commercial dock will
change the waterway or the environment and whether alternate design,
construction, and location of the dock will minimize cumulative impacts; and
[12] t~hether adequate facilities are available to boat owners and/or operators for
fueling, discharge of waste and rubbish, electrical service and water service

lands, and public resources of the Town of Sonthold.
Assure pubfic access to public trust lands and navigable waters.
Provide access to, and reasonable recreational use of, navigable waters and

below the line of mean high water for navigation, recreation, and other
public trust purposes, including the incidental rights of public
anchoring.
Piers, docking facilities, and catwalks must not result in
an unnecessary interference with use of public trust
lands. Alternatives to long piers or docks include use
of dinghies to reach moored boats and mooting in
nearby marinas. Dredging solely to accommodate the
draft of larger boats is not a recommended alternative.

area and its ability to support in-water development for the
water-dependent use.

by potential adverse effects on public safety.
The applicant currently enjoys access to the water body. The proposed
length of the dock structure will impede navigable waters below the line of
mean high water for navigation, recreation, and other public trust
purposes of Jockey Creek.
Due to environmental constraints of this location (tidal wetlands, 2'.6"
water depth of this area at Iow tide), the proposed action may not be
suitable in the proposed location. The applicant currently enjoys access to
the water. A mooring in an area with greater water depth is a better
alternative and would further the above policies.
Structures extending beyond the minimum necessary for access to
navigable waters impair public trust interests and open space values
associated with the water's surface. Allow such structures only in the
following circumstances:
a. when necessary for practical and convenient operation of
water-dependent industry or commerce, and provided that
obstruction of commercial navigation does not result.
b. for commercial recreational boating facilities provided that:
(i) the loss of navigable waters and use of underwater
lands is offset by sufficient public benefit, and
(ii) obstruction of commercial navigation does not result.
c. when the principal purpose of the structure is necessary:
(i) to provide public access for recreational uses
(iO for improvements for navigation
(iiO for protection from coastal hazards, or
(iv) for essential public transportation and transmission
facilities.
Ensure that navigable waters and marine navigation, whether on land
or sea, are not obscured or rendered ineffective through poorly placed
or directed lighting.
The proposed action is private~ noncommercial and will not support a
pattern of development that enhances community character nor preserves
"public" access or public recreational activities.
Policy 11. Promote sustainable use of living marine resources in Long Island Sound, the
Peconic Estuary and Town waters.
Foster the occurrence and abundance of the Town's marine resources through:
1. protection of spawning grounds, habitats, and water quality,

to the extent practicable.

CHRISTIAN & HE1DI FOKINE request a Wetland Permit to remove the existing steps, and to
construct a 4'X 51.4" catwalk using transparent plastic oralam grated decking, a 4'X 12' 10" prefabricated
metal ramp, and a 5'X 12' floating dock. Located: 2505 Wells Ave., Southold. SCTM#70-4-18
The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the To;vn of
Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based
upon the information provided on the LWRP Consistency Assessment Form submitted to this department,
as well as the records available to me, it is my recommendation that the proposed action is
INCONSISTENT with the denoted following Policy Standards and therefore is INCONSISTENT
with the LWRP.
Policy 5. Protect and improve water quality and supply in the Town of Southold.
The dock structure proposes treated lumber with the treatment unspecified.
It is recommended in the event that the dock is approved and to further the above policy that the
Board prevent the use of chromated copper arsenate (CCA) treated wood in the construction of the
structure pursuant to § 275-11. B,1 (f) Construction and operation standards below.
09 In order to prevent the release of metals and other contaminants into the wetlands and
waters of Southold, the use of lumber treated with chromated copper arsenate (also known as
"CCA "), creosote, penta products or homemade wood preservatives is prohibited for use in
sheathing and decking. Preservatives of any type, including but not limited to those listed above
cannot be applied to any bulkheads, retaining walls or revetments after installation·
Encapsulated pillngs or native nonchemically treated (untreated) lumber only should be used
in sensitive areas.
Further it is recommended that the Board require the installation of a silt boom (where feasible) pursuant
to § 275-11. (2) Construction and operation standards below.
2) Erosion control. Installation of an erosion control structure is necessary during any
building, grading, landscaping or site work activity within Trustee jurisdiction. This structure
may include, but is not limited to, installation of a silt fence, hay bales, wood chip berm and silt
booms. The placement of the erosion control structure(s) shall be determined by the Trustees or
their designee. All intertidal construction and excavation requires the installation of a silt boom
that will retain all suspended sediments within the immediate project area.
Policy 6. Protect and restore the quality and function of the Town of Southold ecosystems including
Significant Coastal Fish and Wildlife Habitats and wetlands.
6.1 Protect and restore ecological quality throughout the Town of Southold.
6.2 Protect vulnerable fish, wildlife, and plant species, and rare ecological communities.
The proposed action is located within a marine wetland. Activities during dock construction can
destroy vegetation either above or below the tide line by pulling them from the substrate or
destroying their root system. The peat beds underlying salt marshes can also be compacted through
the improper use of heavy equipment.
The proposed construction practices of the dock have not been identified. It is recommended that
the applicant identify the proposed construction practices.
6.3 Protect and restore tidal and freshwater wetlands.
A. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees
laws and regulations for all Andros Patent and other lands under their jurisdiction
Comply with Trustee regulations and recommendations as set forth in Trustee
permit conditions.
The applicant must demonstrate that the following dock standards pursuant to § 275-11.
Construction and operation standards have been met.
(d) Review and approval of dock applications. Before issuing a permit for a dock structure,
the Trustees shall consider whether the dock will have any of the following harmful effects:
[1] Whether the dock will impair navigation or be located in areas of high vessel traffic or
vessel congestion;
[2] Whether the dock will unduly interfere with the public use of waterways for swimming,
boating, fishing, shell fishing, waterskiing and other water-dependant activities;
[3] Whether the dock will unduly interfere with transit by the public along the public beaches
or foreshore;
[4] Whether the dock will significantly impair the use or value of waterfront property
adjacent to or near the dock;
[5] Whether the dock will cause degradation of surface water quality and natural resources;
The construction materials (type of timber) are identified as treated lumber with the
"treatment" unspecified.
[6] Whether the dock will cause habitat fragmentation and loss of significant coastal fish and
wildlife habitats;
[7] Whether the dock will result in the destruction of or prevent the growth of vegetated
wetlands, sea grasses including eelgrass (Zostera marina) and widgeon grass (Ruppia mantima)
or shellfish;
The applicant proposes plastic oralum decking, therefore the structure will allow Hght
penetration of the wetland vegetation and water column. The absence or occurrence of sea-
crass in the nronosed construction area is unknown~ no information has been submitted.
[8] Whether the dock will unduly restrict tidal flow or water circulation;
[9] Whether the dock will be safe when constructed;
[10] Whether the dock will adversely affect views, viewsheds and vistas important to the
community;
[11] Whether the cumulative impacts of a residential and commercial dock will change the
waterway or the environment and whether alternate design, construction, and location of the dock
will minimize cumulative impacts; and
[12] Whether adequate facilities are available to boat owners and/or operators for fueling,
discharge of waste and rubbish, electrical service and water service.

Provide access to, and reasonable recreational use of, navigable waters and public trust
lands under water.
Provide for free and unobstructed public use of all navigable waters below the
line of mean high water for navigation, recreation, and other public trust
purposes, including the incidental rights of public anchoring.
Piers, docking facilities, and catwalks must not result in an
unnecessary interference with use of public trust lands.
Alternatives to long piers or docks include use of dinghies to
reach moored boats and mooring in nearby marinas. Dredging
solely to accommodate the draft of larger boats is not a
recommended alternative.

its ability to support in-water development for the water-dependent use.
by potential adverse effects on natural resources and their uses, and
by potential adverse effects on public safety.
The applicant currently enjoys access to the water body. The proposed length of the
dock structure will impede navigable waters below the line of mean high water for
navigation~ recreation~ and other public trust purposes of Jockey Creek.
Due to environmental constraints of this location (tidal wetlands, 2'.6" water depth
of this area at low tide), the proposed action may not be suitable in the proposed
location. The applicant currently enjoys access to the water. A mooring in an area
with greater water depth is a better alternative and would further the above
policies.
Structures extending beyond the minimum necessary for access to navigable
waters impair public trust interests and open space values associated with the
water's surface. Allow such structures only in the following circumstances:
a. when necessary for practical and convenient operation of water-
dependent industry or commerce, and provided that obstruction of
commercial navigation does not result.
b. for commercial recreational boating facilities provided that:
(i) the loss of navigable waters and use of underwater lands is offset
by sufficient public benefit, and
(ii) obstruction of commercial navigation does not result.
c. when the principal purpose of the structure is necessary:
(i) to provide public access for recreational uses
(ii) for improvements for navigation
(iii) for protection from coastal hazards, or
(iv) for essential public transportation and transmission facilities.
Ensure that navigable waters and marine navigation, whether on land or sea, are
not obscured or rendered ineffective through poorly placed or directed lighting.
The proposed action is private~ noncommercial and will not support a pattern of
development that enhances community character nor preserves "public" access or
public recreational activities.
Policy 11. Promote sustainable use of living marine resources in Long Island Sound, the Peconic Estuary
and Town waters.
Foster the occurrence and abundance of the Town's marine resources through:

extent practicable.

LWRP CONSISTENCY ASSESSMENT FORM
A. INSTRUCTIONS
All applicants for permits* including Town of Southold agencies, shall complete this CCAF for
proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This
assessment is intended to supplement other information used by a Town of Southold agency in
making a determination of consistency. *Except minor exempt actions including Building Permits
and other ministerial permits not located within the Coastal Erosion Hazard Area.
Before answering the questions in Section C, the preparer of this form should review the exempt
minor action list, policies and explanations of each policy contained in the Town of Southold Local
Waterfront Revitalization Program. A proposed action will be evaluated as to its significant
beneficial and adverse effects upon the coastal area (which includes all of Southold Town).
If any question in Section C on this form is answered "yes", then the proposed action may affect the
achievement of the LWRP policy standards and conditions contained in the consistency review law.
Thus, the action should be analyzed in more detail and, if necessary, modified prior to making a
determination that it is consistent to the maximum extent practicable with the LWRP policy
standards and conditions. If an action cannot be certified as consistent with the LWRP policy
standards and conditions, it shall not be undertaken.
