Project Description: Install approximately 40' of split-rail fence on Town Open
Space property.
Findings: The project meets all the requirements for issuance of an
Administrative Permit set forth in Chapter 275 of the Southold Town Code. The
issuance of an Administrative Permit allows for the operations as indicated on the
application prepared by Scott Hilary, received on June 16, 2008.
Special Conditions: None.
Inspections: Final inspection.
If the proposed activities do not meet the requirements for issuance of an
Administrative Permit set forth in Chapter 275 of the Southold Town Code, a
Wetland Permit will be required.
This is not a determination from any other agency.

As requested by the Land Preservation Committee I'm applying for an Administrative permit
to install a split rail fence on Southold Town Open Space property. The purpose for the proposed
action is to prohibit unauthorized access to and from the Town of Southold's R-O-W to the
neighboring property, SCTM#45-5-2. Attached in support of the Administrative permit
application are a tax map, survey, aerial, and photos referencing the location of the proposed
action. The split rail fence will be installed by Southold Town's DPW.
Action:
Scott A. Hilary, on behalf of the Town of Southold's Land Preservation department requests an
Administrative permit to install approximately 40 feet of split rail fence. Located: 70380 Main
Road, Greenport. SCTM#45-5-5.
The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold
Town Code and the Local Waterfront Revitalization Program (L WRP) Policy Standards. Based upon my site
assessment and as well all the records available to me, it is my recommendation that the proposed action is
CONSISTENT with L WRP policy standards and therefore is CONSISTENT with the L WRP.
The proposed action is in compliance with & 275-5 (B) as referenced below and therefore is consistent with
LWRP snb-policv 6.3.
6.3 Protect and restore tidal and freshwater wetlands.
1. Comply with Trustee regulations and recommendations as set forth in
Trustee permit conditions.

A. Comply with statutory and regulatory requirements of the Southold Town
Trustees laws and regulations for all Andros Patent and other lands under th
jurisdiction
~ 275-5 Permit procedures.
B. Administrative permit.
2) The following operations will be considered for administrative review, in accordance
with the standards setforth in S 275-11:
(a) Construction. installation or removal of a sl1lit rail fence. ooen arbor. trellis or other similar
structure. l1rovided that such ol1eration will not have an undue adverse iml1act on the wetlands and
tidal waters of the Town. Concrete footings are not permitted within wetlands.
The installation of approximatelv 40' of split rail fence within the minimnm setback of the wetland
boundary will not have an undue adverse impact on the fresh water wetlands.
