TERMS AND CONDITIONS
The Permittee Gardiner's Bav Estates Homeowners Association. residing at Gardiner's Bav
Estates. East Marion. New York as part of the consideration for the issuance of the Permit does
understand and prescribe to the following:
I. That the said Board of Trustees and the Town of Southold are released from any and all
damages, or claims for damages, of suits arising directly or indirectly as a result of any
operation performed pursuant to this permit, and the said Permittee will, at his or her own
expense, defend any and all such suits initiated by third parties, and the said Permittee
assumes full liability with respect thereto, to the complete exclusion of the Board of
Trustees ofthe Town of Southold.
2. That this Permit is valid for a period of24 months, which is considered to be the estimated
time required to complete the work involved, but should circumstances warrant, request for
an extension may be made to the Board at a later date.
3. That this Permit should be retained indefinitely, or as long as the said Permittee wishes to
maintain the structure or project involved, to provide evidence to anyone concerned that
authorization was originally obtained.
4. That the work involved will be subject to the inspection and approval of the Board or its
agents, and non-compliance with the provisions of the originating application may be cause
for revocation of this Permit by resolution of the said Board.
5. That there will be no unreasonable interference with navigation as a result of the work
herein authorized.
6. That there shall be no interference with the right of the public to pass and repass along the
beach between high and low water marks.
7. That if future operations of the Town of South old require the removal and/or alterations in
the location of the work herein authorized, or if, in the opinion of the Board of Trustees,
the work shall cause unreasonable obstruction to free navigation, the said Permittee will be
required, upon due notice, to remove or alter this work project herein stated without
expenses to the Town of Southold.
8. That the said Board will be notified by the Permittee of the completion of the work
authorized.
9. That the Permittee will obtain all other permits and consents that may be required
supplemental to this permit, which may be subject to revoke upon failure to obtain same.

Dear Ms. Costello:
The Board of Town Trustees took the following action during its regular meeting held on
Wednesday, May 21,2008 regarding the above matter:
WHEREAS, Costello Marine Contracting Corp., on behalf of GARDINER'S BAY
ESTATES HOMEOWNERS ASSOCIATION applied to the Southold Town Trustees for
a permit under the provisions of Chapter 275 of the Southold Town Code, the Wetland
Ordinance of the Town of Southold, application dated April 28, 2008, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council and to the Local Waterfront Revitalization Program Coordinator for their findings
and recommendations, and,
WHEREAS, the LWRP Coordinator recommended that the proposed application be
found Inconsistent with the LWRP, and,
WHEREAS, the Board of Trustees has furthered Policy 5 & 6 of the Local Waterfront
Revitalization Program to the greatest extent possible through the imposition of the
following Best Management Practice requirements: the use of non-treated lumber on all
decking, the square footage on the proposed 4'x30' float is the same as a 6'x20' float,
and

WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standards set forth in Chapter 275 of the
South old Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that for the mitigating factors and based upon the Best Management
Practice requirement imposed above, the Board of Trustees deems the action to be
Consistent with the Local Waterfront Revitalization Program pursuant to Chapter 268-5
of the Southold Town Code, and,
RESOLVED, that the Board of Trustees approve the application of GARDINER'S BAY
ESTATES HOMEOWNERS ASSOCIATION to remove one 4'x48', two 3'x14', one
6.2'x16' existing floating docks and two existing anchor pilings entirely; remove existing
3'x13.5' wooden ramp; extend existing 3'x25' fixed dock 10'; reinstall floating docks and
pilings that were removed 15' further west and 10' further south than previous; reinstall
existing 3'x13.5' wooden ramp; and install one new 4'x30', one 4'x20' floating dock
section and one new anchor piling on the east end, with the conditions of the use of
non-treated lumber on all decking, the square footage of the proposed 4'x30' float is the
same as a 6'x20' float, and as depicted on the site plan prepared by Costello Marine
Contracting Corp. last dated June 5, 2008, and received on June 6, 2008.
Permit to construct and complete project will expire two years from the date the permit
is signed. Fees must be paid, if applicable, and permit issued within six months of the
date of this notification.
Inspections are required at a fee of $50.00 per inspection. (See attached schedule.)

HOMEOWNERS ASSOC. requests a Wetland Permit to remove one 4'X 48', two 3'X 14', one
6.2'X 16' existing floating docks and two existing anchor pilings entirely; remove existing 3'X
13.5' wooden ramp; extend existing 3'X 25' fixed dock 10'; reinstall floating docks and pilings

The proposed action has been reviewed to Chapter 268, Watemont Consistency Review of the
Town of Southold Town Code and the Local Waterfront Revitalization Program (L WRP) Policy
Standards. Based upon the information provided on the L WRP Consistency Assessment Form
submitted to this department, as well as the records available to me, it is my recommendation that
the proposed action is INCONSISTENT with L WRP policy standards and therefore is
INCONSITENT with the LWRP.
Pursuant to & 275-11 Construction and operation standards for docks-in the water
structures. tloatinl! docks may be no larl!er than six feet wide and 20 feet lonl! except on
Fishers Island if the need is demonstrated. The proposed action includes a tloatinl! dock
sil!nificantlv larl!er than the permitted 6' x 20' tloatinl! dock pursuant to & 275-11.
Policy 6 Protect and restore the quality and function of the Town of South old
ecosystem.
6.3 Protect and restore tidal and freshwater wetlands.

The applicant must demonstrate that the followin!! dock standards pursnant to & 275-11
Construction and operation standards have been met.
(d) Review and approval of dock applications. Before issuing a permit for a dock
structure, the Trustees shall consider whether the dock will have any of the
following harmfUl effects:
[1 J Whether the dock will impair navigation or be located in areas of high vessel
traffic or vessel congestion;
[2J Whether the dock will unduly inteifere with the public use of waterways for
swimming, boating, fishing, shellfishing, waterskiing and other water-dependant
activities;
[3J Whether the dock will unduly interfere with transit by the public along the public
beaches or foreshore;
[4J Whether the dock will significantly impair the use or value of waterfront property
adjacent to or near the dock;
[5J Whether the dock will cause degradation of surface water quality and natural
resources;
[6J Whether the dock will cause habitat fragmentation and loss of significant coastal
fish and wildlife habitats;
[7J Whether the dock will result in the destruction of or prevent the growth of
vegetated wetlands, seagrasses including eelgrass (Zostera marina) and widgeon
grass (Ruppia maritima) or shellfish;
[8J Whether the dock will unduly restrict tidalflow or water circulation;
[9J Whether the dock will be safe when constructed;
[10J Whether the dock will adversely affect views, viewsheds and vistas important to
the community;
[11 J Whether the cumulative impacts of a residential and commercial dock will
change the waterway or the environment and whether alternate design,
construction, and location of the dock will minimize cumulative impacts; and
[12J Whether adequate facilities are available to boat owners and/or operators for
fueling, discharge of waste and rubbish, electrical service and water service
Policy 5 Protect and improve water quality and supply in the Town of Sonthold.
To reduce a dock's potential adverse impacts to the marine environment preservatives is
prohibited for use in sheathin!! and decldn!! on structures in the wetlands as well as on anv
part of a structure in low tidal flow wetland areas as determined bv the Trustees. Whereas
the proposed proiect description does not describe the type of materials to be used. The use
of pre-treated lumber with anv preservatives as defined in &275-11 as (anv part of a
structure) in low tidal flow wetland areas will be determined bv the Trustees.
~ 275-11 Construction and operation standards.
C. In water. The following standards are required for all in-water operations adjacent to
residential properties. Operations conducted on properties zoned M 1 or M2 may be given greater
flexibility in these requirements given the water-dependent nature of their use.

(2) Docks.
(a) Standards for residential and commercial docks; general rules. It shall be the
policy of the Town of Southold that all docks shall be designed, constructed and
located so as to reduce a dock's potential adverse impacts to navigation, public
safety, waterway congestion, access to public trust lands and water, and natural
resources and habitats. The following standards will.
[3] In order to prevent the release of metals and other contaminants into the
wetlands and waters of Southold, the use of lumber pre-treated with any
preservative, including but not limited to chromated copper arsenate (also
known as "CCA "), commercial copper quat (CCQ), penta products, Alkaline
Copper Quat (ACQ), or homemade wood preservatives is prohibitedfor use in
sheathing and decking on structures in the wetlands as well as on any part of a
structure in low tidal flow wetland areas as determined by the Trustees. The use
of creosote is prohibited. The use of tropical hardwoods is prohibited unless it is
certified by the Forest Stewardship Councilor similar organization. Materials
used for structural components shall be at the discretion of the Trustees.

character, preserves open spllCle, makes efficient use of infrastructure, makes benef'tdal
use of a coastal location, and minimizes adverse effects of development.
Our proposal is consistent with this policy in presently there is an existing dock and with the
additional dock section will allow the members of the Homeowner's Association to cater to these
member small boats. The proposed location provides enough space for safe navigation and it is
located in an area where the wetlands are scarce.

Our proposed dock facility will have minimal effects on the ecosystem. When the pilings are removed
and reinstall there will be a disturbance to the ecosystem but nothing that will not re-establish within
a few weeks. We have submitted application to all other governing agendes (DEC, ACOE, DOS) and
we will adhere to any special conditions placed on this project in order to protect the wetlands on this
site.

Our proposal will give the property owners the ability the access their boats and engage in the
recreational use of town waters. The dock will not inhibit others ability to access these same waters.
The entire structure will not extend pass the Homeowner's Association's owned underwater lands.

dependent uses in suitable locations.
This is a waterfront piece of property. With the addition section of dock, members will be able to
safe board their boats. The members of this association will be engaging in water-dependent
activities such as kayacking, fishing, site seeing, water-skiing and swimming.
Policy 11 Promote sustainable use of living marine resources in the Town of Southold.
The proposed location was chosen to protect the tidal wetlands as much as possible. The additional
section of dock is minimal in size and will have limited negative impacts on the living marine
resources.
