Gerosa. residing at 415 Alluaview Avenue. East Marion. New York as part of the consideration for the issuance ofthe Permit does understand and prescribe to the following: I. That the said Board of Trustees and the Town of Southold are released from any and all damages, or claims for damages, of suits arising directly or indirectly as a result of any operation performed pursuant to this permit, and the said Permittee will, at his or her own expense, defend any and all such suits initiated by third parties, and the said Permittee assumes full liability with respect thereto, to the complete exclusion of the Board of Trustees of the Town of South old. 2. That this Permit is valid for a period of24 months, which is considered to be the estimated time required to complete the work involved, but should circumstances warrant, request for an extension may be made to the Board at a later date. 3. That this Permit should be retained indefinitely, or as long as the said Permittee wishes to maintain the structure or project involved, to provide evidence to anyone concerned that authorization was originally obtained. 4. That the work involved will be subject to the inspection and approval of the Board or its agents, and non-compliance with the provisions of the originating application may be cause for revocation of this Permit by resolution of the said Board. 5. That there will be no unreasonable interference with navigation as a result of the work herein authorized. 6. That there shall be no interference with the right of the public to pass and repass along the beach between high and low water marks. 7. That if future operations ofthe Town of South old require the removal and/or alterations in the location of the work herein authorized, or if, in the opinion of the Board of Trustees, the work shall cause unreasonable obstruction to free navigation, the said Permittee will be required, upon due notice, to remove or alter this work project herein stated without expenses to the Town of Southold. 8. The Permittee is required to provide evidence that a copy of this Trustee permit has been recorded with the Suffolk County Department of Real Properties Office as a notice covenant and deed restriction to the deed of the subject parcel. Such evidence shall be provided within ninety (90) calendar days of issuance of this permit. 9. That the said Board will be notified by the Permittee of the completion of the work authorized. 10. That the Permittee will obtain all other permits and consents that may be required supplemental to this permit, which may be subject to revoke upon failure to obtain same. . . James F. GEROSA 415 AQUAVIEW AVENUE, EAST MARION SCTM# 21-2-5.1 Dear Ms. Dwyer: The Board of Town Trustees took the following action during its regular meeting held on Wednesday, May 21, 2008 regarding the above matter: WHEREAS, Nancy Dwyer Design Consulting, Inc. on behalf of ARIELLE S. GEROSA applied to the Southold Town Trustees for a permit under the provisions of Chapter 275 of the South old Town Code, the Wetland Ordinance of the Town of Southold, application dated March 13, 2008, and, WHEREAS, said application was referred to the South old Town Conservation Advisory Council and to the Local Waterfront Revitalization Program Coordinator for their findings and recommendations, and, WHEREAS, the LWRP Coordinator issued a recommendation that the application be found Consistent with the Local Waterfront Revitalization Program policy standards, and, WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on May 21, 2008, at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, 2 . . WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the structure complies with the standards set forth in Chapter 275 of the South old Town Code, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW THEREFORE BE IT, RESOLVED, that the Board of Trustees have found the application to be Consistent with the Local Waterfront Revitalization Program, and, RESOLVED, that the Board of Trustees approve the application of ARIELLE S. GEROSA to construct a new full second-story addition to the existing one-story dwelling, reconstruct existing deck, and increase the size of the existing septic system, with the conditions of the installation of gutters, leaders and drywells to contain roof runoff and in accordance with Chapter 236 of the Town Code-Storm Water Runoff, a 10' Non-Turf Buffer is installed along the bluff line, a line of staked hay bales is installed prior to construction, and as depicted on the survey prepared by Peconic Surveyors, P.C., last dated May 13, 2008, and received on May 15, 2008. Permit to construct and complete project will expire two years from the date the permit is signed. Fees must be paid, if applicable, and permit issued within six months of the date of this notification. Inspections are required at a fee of $50.00 per inspection. (See attached schedule.) Therefore, in accordance with the current Tidal Wetlands Land Use Regulations (6NYCRR Part 661) no permit is required. GEROSA SCTM#2l-2-5.1 Nancy Dwyer Design Consulting, Inc. on behalf of ARIELLE S. GEROSA requests a Wetland Permit to construct a new full second-story addition to the existing one-story dwelling, reconstruct existing deck, and increase the size of the existing septic system. Located: 415 Aquaview Ave., East Marion. SCTM#21-2-5.1 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (L WRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is CONSISTENT with LWRP policy standards and therefore is CONSISTENT with the LWRP; provided that the proposed action meets LWRP sub- policies 5.2 and 5.3, as outlined below. Policy 5 Protect and improve water quality and supply in the Town of Southold. 5.2 Minimize non-point pollution of coastal waters and manage activities causing nonpoint pollution. A. Minimize non-point pollution of coastal waters using the following approaches, which are presented in order of priority. 1. Avoid non-point pollution by limiting non-point sources. . . .. b. Avoid activities which would increase off-site storm water runoff and transport of pollutants. . achieve no net increase of runoff where unimpaired stormwater runoff conditions exist d. Retain or establish vegetation to maintain or provide: . soil stabilization . filtering capacity in riparian and littoral zones e. Preserve natural hydrologic conditions. . Maintain natural surface water flow characteristics. . Retain natural watercourses and drainage systems where present. . Where natural drainage systems are absent or incapable of handling the anticipated runoff demands: . develop open vegetated drainage systems as the preferred approach and design these systems to include long and indirect flow paths and to decrease peak runoff flows . use closed drainage systems only where site constraints and storm water flow demands make open water systems infeasible 2. Reduce pollutant loads to coastal waters by managing unavoidable non point sources and by using appropriate best management practices as determined by site characteristics, design standards, operational conditions, and maintenance programs. B. Reduce non-point source pollution using specific management measures appropriate to specific land use or pollution source categories. 5.3 Protect and enhance quality of coastal waters. C. Protect water quality of coastal waters from adverse impacts associated with excavation, fill, dredging, and disposal of dredged material. To further L WRP policy standards the applicant must comply with erosion control and drainal!e standards pursuant to & 275-11. ~ 275-11 Construction and operation standards. (1) Drainage upgrade. Applicants for a permit for any form of construction may be required to upgrade the site's drainage system such that all surface water generated from impervious surfaces shall be kept onsite through infdtration or retention. Applicants proposing grading or filling operations will be required to submit a drainage plan for the entire site at the discretion of the Trustees. See J 275-6A(14)for requirements. (2) Erosion control. Installation of an erosion control structure is necessary during any building, grading, landscaping or site work activity within Trustee jurisdiction. This structure may include, but is not limited to, installation of a silt fence, hay bales, wood chip berm and silt booms. The placement of the erosion control structure(s) shall be determined by the Trustees or their designee. All intertidal construction and excavation requires the installation of a silt boom that will retain all suspended sediments within the immediate project area. . . JAMES J.
