which the party of the first part has or has power to conveyor dispose of, whether individually, or by virtue of said
will or otherwise; TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the
heirs or successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby the
said premises have been incumbered .in any way whatever, except as aforesaid.
AND the pm1y of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first
part will receive the consideration for this conveytmce and will hold the right to receive such consideration as a trust
fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the
payment of the cost of the improvement before using any part of the total of the same for any other purpose.
The 'Nord "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.

ALL that certain plot, piece or parcel of land, situate, lying and being at Bayview, near Southold, in the Town
of Southold, County of Suffolk and State of New York, bounded and described as follows: .
BEGINNING at a monument set on the northerly side of an existing road or right of way known as "Traveled
Road," 1126.65 feet westerly from the corner formed by the intersection of the northerly side of said Traveled
Road with the southwesterly side of North Bayview Road;
RUNNING THENCE South 67 degrees 53 minutes 30 seconds West, 160.00 feet to land now or formerly
Toedter;
THENCE along said land North 2B degrees 06 minutes West, 25 feet to a dredged canal;
THENCE along said dredged canal the following three (3) tie line courses and distances:
(1) North 2B degrees 06 minutes West 75 feet;
(2) North 06 degrees 11 minutes 40 seconds West 129.08 feet; and
(3) North 59 degrees 34 minutes 20 seconds East 168.49 feet to land now or formerly Joseph Correll;
THENCE South 14 degrees 50 minutes 00 seconds East along said land 250 feet to the northerly side of the
"Traveled Road" and the point or place of the BEGINNING.
