WITNESSETH, thatlhe party of the first part, by virtue of the power and authority given In and by said last will
and testament, and no consideration ef aellafll, paid by the party of the second part, does hereby grant
end release unto the party of the second part, the heirs or successors and assigns of the party of the second
part forever, all undivided fifty (50%) percent inte~st in
ALL thai certain plot, piece or parcel of land, with the buildings end improvements thereon erected, snuale,
lying and being in the Town of Southold, County of Suffolk and State of New York, known
and designated as Lot #23, as shown on a certain map entitled "Map of Harbor
Lights Estaces, Section One, Bayview, Town of Southold, Suffolk County, NY" made
by Otto W. Van TUyl k Son, Licensed Land Surveyors, Greenport, NY, and filed in
the Office of the Clerk of the County of Suffolk, on June S, 1965, as Map No.
4362.
BEING a portion of the same premises conveyed to Vincent Heffernan snd Joan
Heffernan, his wife, by Deed recorded in the Office of the Suffolk County Clerk
on November 13, 1981, in Liber 9100 and page 49.
SAID premises being Y~own as and by the street address 450 Brigantine Drive,
Southold, New York.
TOGETHER with all right, tnle and interest, if any, of the party of the first part, In and to any streets and roads
abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances, and
also all the estate which the said decedent had at the lima of decedent's death in said premises, end also the
estate therein, which the party 01 the first part has or has power to convey or dispose of, whether Indivldually,
or by virtue of said will or otherwise; TO HAVE AND TO HOlD the premises herein granted unto the party of
the second part, the heirs or successors and essigns 01 the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been encumbered in any way whatever, except as aloresaid. .
AND the party 01 the first part, in compliance with Seclion 13 01 the lien Law, covenants that the party 01 the
first part will receive the consideration lor this conveyance and will hold the right to receive such consideration
as a trust fund to be apptied first lor the purpose 01 paying the cost of the Improvement and will apply the same
first to the payment of the cost of the improvement before using any part of the total 01 the same for any other
purpose. The word "party" shall be construed as If it read "parties" whenever the sense 01 this indenture so
requires.
