THIS INDENTURE, made as of October 1.,2001
BETWEEN ANNA MARIE BAGNATO, residing at 7 Meadow Lane, Manhasset, New York 11030, party ofthe
first part, and
HOW ARD DAVIDOFF and LISA DAVIDOFF, His Wife, residing at 8 Terrace Drive, Port Washington, New
York 11050, party of the second part,
WITNESSETH, that the party of the first part, in consideration ofTen Dollars and other valuable consideration
paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs or
successors and assigns of the party of the second part forever, all of her right, title and interest in and to
ALL that certain plot, piece or parcel of land, with the b'uildings and improv\J,ments thereon erected, situate, lying
and being in the Town of Southold, County of Suffolk and State of New York, being more fully described as Lot
No, 6, on a certain map entitled, "Paradise by tlle Bay"; indfiledil1 the Office of the Clerk of the County of Suffolk
on November 4, 1976 as Map No, 6463, being more particularly bounded and described as follows:
BEGI1\'NING at a stake set on the easterly side of Kinlberly Lane at tlle division line between Lot 6 and Lot 5, as
shown on said aforementioned map; RUNNING THENCE along said division line north 84 degrees 22 minutes 20
seconds east, 353.48 feet; THENCE south 04 degrees 06 minutes 55 seconds east, 15,77 feet; THENCE south 16
degrees 44 minutes 30 seconds east, 136.81 feet; THENCE south 84 degrees 22 minutes 20 seconds west, 345.89
feet to a stake on the easterly side of Kimberly Lane; THENCE along said road north 18 degrees 14 minutes 10
seconds west, 153.71 feet to tlle point or place ofBEGIN'NING.
Being and intended to be the same premises described in Deed dated January 11, 1995 from Andrew G. Duerwald
and Margaret A Duerwald, as Grantors, to Anna Marie Bagnato, as Grantee, which Deed was recorded in the
Suffolk County Clerk's Office on January 20, 1995 in Liber 11711, Page 430.
Said premises known as and by the street address 1015 Kimberly Lane, Southold, New York 11971,
TOGETHER with all right, title and interest, if any, of the party oftlle first part in and to any streets and roads
abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances and all tlle
estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD tlle premises
herein granted unto the party of the second part, the heirs or successors and assigns of the party of the second part
forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby
the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first
part will receive the consideration for this conveyance and will hold the right to receive such consideration as a trust
fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the
payment of the cost of the improvement before using any part of the total of the same for any other purpose.
The word "party" shall be construed as ifit read "parties"whenever the sense of this indenture so requires.
