and to said premises,
TO HA VE AND TO HOW Ihe premises herein granted unto Ihe party of the second part, Ihe
heirs or successors and assigns of the party of Ihe second part forever.
AND Ihe party of the first part, covenants that the party of the first part has not done or suffered
anyIhing whereby Ihe said premises have been encUInbered in any way whatever, except as aforesaid.
AND Ihe party ofIhe first part, in compliance wiIh Section 13 of the Lien Law, covenants that
the party of Ihe first part will receive the consideration for this conveyance and will hold Ihe right to
receive such consideration as a trust fund to be applied first for the purpose of paying Ihe cost of the
improvement and will apply Ihe same first to Ihe payment of Ihe cost of Ihe improvement before using
any pan of the total of the same for any oIher purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so
requires.

ALL that certain plot, piece or parcel of land, with the buildings and
improvements thereon erected, situate, lying and being in the Village of
Cutchogue, Town of Southold, County of Suffolk and State of New York, which
on a certain map entitled, "Map of Eugene Heights owned by Jacob F. Bowers
situate at Cutchogue, New York" filed in the Office of the Clerk of Suffolk County
as Map No. 856 on October 29, 1928, are known and designated as and by the
Lots 38, 39 and 40 and which are more particularly described as follows:
BEGINNING at a point on the Easterly side of Oak Street where the same is
intersected by the division line between Lots 40 and 41 on said map, said point
being distant 55.72 .feet Southerly as measured along the Easterly side of Oak
Street from the corner formed by its intersection with the Southerly side of Pierce
Drive;
RUNNING THENCE along said division line North 82 degrees 01 minutes 10
seconds East 258.5 feet to the mean high water line of Eugene's Creek;
THENCE Southerly along said mean high water line 75 feet, more or less (tie line
on a course South 4 degrees 32 minutes 50 seconds East a distance of 75.13
feet) to the division line between Lots 37 and 38 on said map;
THENCE along the division line between Lots 37 and 38, South 82 degrees 01
minutes 10 seconds West 254.0 feet to the Easterly side of Oak Street;
