STRICT APPLICATION OF THE ORDINANCE would produce UNDUE HARDSHIP because This property comprises 16 acres of woodland, and has a front footage of only 132 feet. The woodland growth comes up to the road line. The woodland has not been cut in over fifty years and the timber is thick. No sign, placed 35 feet back from the road line, is readily visible from the public. thoroughfare. 2. The hardship created is UNIQUE and is not shared by all properties alike in the Immediate vicinity of;.thjs' property arid .in this use district beco.use. Thi1s property is unique in that it has not been cut over recently and the timber is so thick, a sign is not readily visible from the 35 ft. distance required by the Ordinance. 3. The Variance would observe the spirit of the Ordinance ond WOULD NOT CHANGE THE CHARACTER OF THE DISTRICT because The sign is a small dignified sign. The appeal is based on, and solely on, the fact that the dense woodland comes up directly to the road right-of-way. To erect a sign back 35 feet from this line will mean it cannot be seen by the public passing by in automobiles. This appeal has been submitted with the hope that a variance may be allowed so that the small sign, formerly erected, may be erected again. Terry Building Inspector Southold, Long Island, N:ew York Dear Sir: Upon my return this week; I have a Form V Order, signed by you, concerning my property on Indian Neck. I was rather taken back with the wording of the violation, which intimated to me that you had not seen the so-called violation. We are not selling lots, or a sub-division of any kind. This is purely selling a piece of property as a whole and no sub- divisions whatsoever. Furthermore, this land consists of woodland, which comes up to the road line, and I do not see how a sign could be put up that could be seen from 35 feet back of the building line. However, I wish you would reconsider this so-called violation and, if it still needs changing, send me Article III, Section 3, Sub 10, so that I may understand thoroughly how I can put a sign up on a piece of property without violating your code. From tne map you will realize that the woodland comes up to the building line. My problem seems to be there is no visible place to see a sign from the road, erected thirty- five feet within the woodland. Perhaps I don't understand the situation, so would you kindly show me on the map where I may put a sign which will conform to your code and still be visible from the street?
