The Board of Assessment Review for the Town of Southold, has duly met to hear
Complaints or grievances on the tentative town assessment roll for the tax year 2007/08
as prescribed by law.
The Board, having duly convened, has considered each and every complaint or grievance
on the assessments for the tax year indicated, as filed with this Board, as prescribed by
law.
A majority of the Board has determined that all the changes indicated on the attached

for 2008 for the Town Southold at 9:05 am. We will sweaz in the Assessors.

My name is Frances Slezak. Al Sommerstadt. We both reside at 7405 Alvahs Lane,
Cutchogue.
Our tax map is 101.-1-16.2. I believe our house

Slezak: Thank you. We're here because we feel our house is depreciated for three
significant factors. One there have been changes in the area since 1995 ongoing until the
present. Changes in the area, the mazket value of the home and the condition of our
home. Our home was built in 1975. We've moved there in 1990. When we moved there
in 1990, there was a 50 ft wide grassy right of way on our northern perimeter boundary.
In '95 that perimeter -that 50 ft wide perimeter was changed to be a 15 ft wide road and
the rest of it was three rows of grapes were planted. They run parallel to our property.
Behind our home which is the west end perimeter there were two 2-acre residential lots
that had grapes on it. We moved there knowing that there were grapes on the back and
we were happy to be in the agricultural area. When the road came on the side and the
three rows of grapes that were planted in '95 which was 5 yrs after we were there things
really started to change and be terrible. We were getting sprays from the pesticides
because of the north wind. We are not that far from the sound and there's a north wind
that comes and just naturally brings the spray and then when he's using the dirt road
which is abuts our property -it's not that it is somewhere else. It abuts our property.
He's using that road to spray the grapes. That was one change that was troublesome.
Then I have a map here which I included. Our property is A, property B is a greenhouse
which abuts the three rows of grapes. Cis the western perimeter that had two residential
acres that were being used that grapes on them.
Atkinson: Excuse me. Instead of saying A, B and C, could you give me a lot number.
Discussion of documents that were presented.
Slezak: I made the copies of everything. I included them in the package. I also have an
aerial view map included in the pack. If you take a look, you can see that this is the
greenhouse. It didn't start like that. It grew to be this huge. This property here is my
home. This is the 50 ft wide that was changed. If you could see the change in color -the
little dusty road - it's a gavel road. So that when anything goes up there, it kicks up
everything. That's where he sprays. That's where the actual tractor goes. It is not
grass. And then he goes he goes in-between the grape vines. Meanwhile, after this the
owner of this greenhouse owned all of this at one time. His son moved in here and had a
house built around 1997. I'm not sure when. He doesn't have a direct lane to Alvahs
Lane so he comes behind the greenhouse and he uses the road. So, we get the traffic
from the greenhouse, we get the traffic from the owner of the greenhouse. Mr.
Schneider, Sr. owned. He moved it and sold it to his son after the house was built. So,
now we have the traffic from this house who owns the greenhouse who comes along the
side. We get his traffic and the traffic from the greenhouse. Then when the son was here
he decided that he wanted a dirt bike track. So, he built a track. This shaded area going
around is at least a 200 foot dirt bike track with 10-foot risers. Noisy, dusty and because
of the trees here, there's an echo that the noise is already there and the echo intensifies
the sound. You can hear it from a distance. Matter of fact sound travels very easily here.
We live down the road - I don't know how many feet from the north road -you have it
on the map there. When the Canine Classic was there on Saturday, we can hear them
with the loudspeakers. That is how fast sound travels in this area. Okay, now after the
dirt bike track which is still ongoing, the senior Mr. Schneider was going to build a house
on this property in Southold. So, meanwhile while the house was being built, he had a
trailer - a permanent house trailer built in this corner which I included on this map. If
you look at this map. This is in '03. In '03 he changed the lines so that his son could
own the house sepazately so that he could get a mortgage because his son couldn't get a
mortgage as part of the greenhouse landscape. So, that yellow I drew in. That was not
part of this. I drew that in to show the location. Now this is their borderline. You can
see although he had all this property, the greenhouse is built right on the property line.
So, was the little trailer. In the trailer - so who lives in the trailer? Mr. And Mrs.
Schneider lived in there for a year. But then they submitted applications for workers to
live in there. There's five people living in there. Two adults and three children. Now,
since the road goes right in front of them and the people park on the grass, the children

also get sprayed as well as the house. They play in this azea. There is no place else for
them to go. So, when they have parties or soccer games or whatever, the five people are
right parallel -next to our property. So, we get a concentration of negative activities is
how I see it. We have the traffic, we have the spraying, we have the greenhouse activity.
McConlogue: Excuse me, what is the greenhouse activity - is that commercial?
Slezak: Commercial. It was expanded over the years. Here, I have all the expansions. It
started out as this little squaze, and it came to be this with the dirt bike track, with a house
trailer which didn't go to the Zoning Boazd of Appeals. I checked that out and was told it
was agricultural and was told that this is the way it goes. So, it didn't go to the Board of
Appeals for whatever reason. So, we have those different factors. Now, in '06 I have
pictures which I also submitted of the trailer. To show you how close everything is.
There's the dirt road, the greenhouse that abuts the property. I'm standing on Alvahs
Lane taking the picture. This is what you see. By the way, do you see that little sign: Do
Not Enter. That's on the access road so whether it's sprayed or not sprayed, people go
and you don't know if it's sprayed or not. So, how is it stopping anybody. It doesn't.
It's non-functional. Of course, we've never told when it's going to sprayed. So, my
clothes aze on the line. So, anyway, but this is the picture of the dirt road, the grapes.
You can see the trailer here. They have two trailers - a business trailer and a house
trailer. They put up a little shed last year to sell flowers during the day. Here's the side
view of trailer -from my property. I'm standing on my property. Here's the dirt road,
the grapes. You have the actual photographs which I'm sending azound. Now, the
condition of my home - I also included a picture of a new residence that was built behind
my home -off my northern property -which was built. They moved in December '06.
Sommerstadt: They're in the back of the vineyard. He bought the property and
constructed a house.
Atkinson: With the 3-caz garage?
Slezak: Yes, the three-caz garage is now a winery. The winery has had five Open
Houses, cars going back and forth on the dirt road bringing the public, having public
wine tastings.
McConlogue: Oh, there's a tasting room there too?
Slezak: The garage is everything. I have literature. Here's an article from Dan's Papers
saying how they have the winery in the garage. They charge $3,500 for a membership.
As I say, I have a list of all dates. I have this stuff on the computer. I included some, but
I can briefly tell you. The five Open Houses were really terrible because they were all
day -cars back and forth, kicking up dust. People drinking and then driving back. This
is abutting my property. I'm there trying to cut my trees and do my bushes. I have people
saying to me what are you doing, are you peeking thru? Nasty and I tell them that I live
there! Leave me alone. I don't feel that I have to have that kind of activity. October 20
they had three buses ftom Adelphi come. Buses that just about fit the width of the road.
They bring portable toilets. Since he has the construction business and the winery
business we have trucks that go back and forth. Some trucks you can't fit so they park
right at the beginning of the entrance and they have a little tractor to bring stuff back to
him. Portable toilets aze brought back there and they maintained when the people come
to the tents. February 9a' they were coming to rack the wine. I have a picture of the
garage where all the cazs pazk. That's at the end of the dirt road. Now, the pazking
intervention is a problem. Now, they were parking into my trees. December 1, 2007
from 5 pm to 9 pm, there were non-stop cazs coming back and forth. I believe they were
coming to collect their grapes. It was non-stop. It was dark from 5 to 9 on Dec. 1 going
back and forth, lining up in front of my property because they couldn't really get thru
because the road is kind of narrow and it's dazk.
McConlogue: Is this like a co-op or something?
Sommerstadt: Yes, that's exactly what it is. He's formed like a co-operative. He was
selling shazes. Let me talk for a few minutes. It was like a co-operative. You buy a
shaze and you can work in the vineyard, do the field work, pick the grapes and for this
you get a keg of wine. I don't know how you translate - 23 cases of wine where you can
put your own label on it and say this is my own wine.
McConlogue: You're contending that that kind of an operation generates a lot of traffic?
Slezak/Sommerstadt: Yes, absolutely.
Sommerstadt: When he first moved in, he said he would be a quiet little winery. I guess
he decided he wanted to play with the big boys on the Main Road. He's not on the Main
Road, he's on a dirt road.
McConlogue: And you all have to use the dirt road?
Slezak: That is the only access road.
Sommerstadt: I mean you try to sit in the backyard on a Sunday afternoon and relax and
you have cars going back and forth, dust blowing all over, people yelling and screaming.
It's really annoying. I feel it negatively impacts the property.
Slezak: He also has posters about some of the group dates: May 31, June 21, July 19 and
upcoming dates. He also adds that if you want private parties, he will accommodate. We
also do private tastings for families and their friends all during the summer. Please
contact us if you aze interested in setting up another date or theme. So, they aze having
this ongoing thing. I went on the computer because they have a press section. There's
one that was a video on Channel 4 News. It wasn't them, it was a couple speaking for
them. It was for Valentine's Day. Now let us tell you about the Bella Vista winery.
Now, they are going to a Tuscan Overnight for $225. I heazd this on the TV. I have not
seen this written yet because I have looking on the website.

McConlogue: Everything here is market value? The assessment is based on the mazket
value. We understand what you aze driving out and how does this affect your market
value?
Slezak: Well, I would NOT have moved there if I knew that people....
McConlogue: What number do you put on it? Have you checked...
Slezak: I have that too. That's my third avenue.
McConlogue: Oh, I'm sorry, go ahead. Take your time.
Sommerstadt: There's three negative influences we feel. Number one is the winery and
all the activity. The trail of people -all that goes on with the nursery.
Slezak: The concentration of all these different things so close. It deviates from the rest
of the block. Everybody has their two-plus acres..
Sommerstadt: Negative impact on the property value.
Schulteis: Are any of these uses contrary to the zoning for the land that they're on?
Slezak: I want and I asked. Matter of fact I went when I knew when they were going to
build a house. I went to see Mr. Anthony Trezzano - is that his name?
Webster: Trezza.
Slezak: Trezza and I asked because I was concerned about the road. I said I would like
to know if there were any public activities going on. Oh, don't worry about that -they
are not interested in that. Their application says that they are not going to have anything
public going on there. My reply: thank you very much. I've checked further and as long
as it's a residence and because it is in the agricultural azea supposedly he has the right....
Schultheis: So, it's an acceptable use of the land?
Slezak: I guess so, but it's aresidence - it not -their application says it is a residence.
There is no indication on the application that says they were going to have a winery.
Schultheis: So, it is in the agricultural district?
Slezak: It is in the agricultural/residential area. But, it's both. It's not in direct access so
that the public can get to it.
Wiggins: Has any of the zoning changed since you bought the property?
Slezak: No.
Wiggins: So, it's always been zoned that way.
Slezak: Since I've been there. Yes.
McConlogue: Did you say that the other homes are in 2-acre zoning?
Slezak: Plus.
McConlogue: Plus, and yours is 2 acres?
Slezak: No, ours is 1.8. The other homes down the street aze a112.2...
McConlogue: And the other 2 acre homes enjoy the quiet 2 acres?
Slezak: They don't get any of this activity because the residence that I'm getting from
the winery is in my comer. They don't see....
McConlogue: I understand. So, what you're saying.... We're trying to relate all this that
the mazket value of the homes on the 2 acres is "x" and yours should be less because you
suffer this here economic depression.
Atkinson: External obsolescence.
McConlogue: This is economic.
Sommerstadt: I figured if you try to sell the house -people would come around and see
these things...
Slezak: And hear the noise, hear the dirt bikes, get sprayed on. I mean the DEC has been
to my house. He's issued two warnings to the owner already for overspraying. And this
is just for him. I've had the DEC there before him for other things. One time they
pushed a tractor on my property leaking oil. I've had them come - this is for the past
owner - I had them leave the sprayer right on the road either Memorial Day or Labor Day
-one of those holidays. They left the full sprayer leaking, dripping - I didn't know what
was in it. I know it smelled - I think they must have been cleaning. So, the DEC came
about 8 pm at night. I had a flood coming. Nobody would want this. I didn't expect to
have this kinds of problems. I mean you have a home next to this kind o£... Sure lots of
people do have homes next to wineries. I `ve seen them. I've driven by each of them -
not one of them has an access road where the public goes to their home. Not one of the
wineries have an access road that is abutting a residence. They have their own access
road. People are tasting wine, driving thru, they could hit my trees. My Mom who
lived in Levittown on Mother's Day with the chain link fence had a car going thm her
living room. So, drinking and driving is a concern of mine. So, people on this road are
drinking and driving all day. I made two charts to summarize because you have the
information there. I have six recent home sales in Cutchogue and Mattituck. The first
one is on Matthews Lane. My home was built in '75. This home was built in '74. It
sold January 12, '07. I know July was the valuation date so I try to go on either side of
the valuation date. July 12 '07, the home sold for $455K. It was atwo-story as my home
is. It has more square footage. My squaze footage is 1684, that square footage was 2159.
They have less land. They have .56, they have more baths, they have 2 '/z baths, they
have a fireplace as I do. They have a 2-car gazage, I have a 1 '/z car garage. Stillwater-
Cutchogue. This home was built in '62 with the sale date of 5/7/07. It sold for 416K.
It's two-story - it has more square footage than I do. It has 1756. The land was 1.7, one
bath, one fireplace. Theresa -the home was built in '69 that was also sold July ' 07 -
$480K. One story with more square footage - 2340 where I have 1684 -less land, .44,
one bath, one fireplace, 2-car garage. Westphalia -house was built in '95. July 12 '07
was the sale date. Sold for $465K, 2-story. It has more square footage than I do -1835,
the land is .4; 2 '/z baths, 1 fireplace, 1 garage. Aldrich Lane in Mattituck. This home
was built in 2000, sale date was 9/21 /07. Sold for $475K, 2-story like my home. 1596 sq
footage - a little less than mine -- .almost an acre of land -- .9.
McConlogue: What does the assessor say your mazket value is?
Slezak: Says that my market value is higher than all of them except one. Mine is 6200,
the others are -Matthews is 6600; Stillwater is 5800; Theresa was 5400, Westphalia is
4589. The one on Aldrich was 6050. The one on Rosewood was 5300. There's a home
right now on Depot that's for sale that assessed at 7100. It was built in 1988. For sale
price is $449K. It's atwo-story, it's almost the same as mine. It's 1659 - I'm 1654. It
has 2 '/z baths, and 2-caz garage. So, looking at these overall to me I have one of the
highest assessments expect for the one that's for sale for $449K. The one sold, one has a
higher assessment, the others are - no two similar to mine and three -you see from the
charts. But I feel that if you look at pictures, they are all in quiet neighborhoods, they
don't have any negative area influences. They are pretty houses. I have pictures here too
see them. They look like my house.
Schultheis: Do you have an appraisal that shows in like terms that shows the value of
these homes? Because I'm looking at it and you have 1.83 acres and you are comparing
to houses that have .17, .44 acres.
Slezak: Yes, that's true, but there are no other houses. I've seazched.
Schultheis: An appraiser would make those adjustments and would bring each of those
houses into line on equal terms.
Slezak: Well, I didn't want to go for the cost of an appraisal because I feel I am being
over-assessed. I feel I have area influences which definitely depreciate my home.
Atkinson: Let me ask you a question. Do you -can you give me a percentage that you
feel the value of your property has diminished -10%, 20%?
Slezak: Well, I've looked at - I have it on the front page. I've said the value of my
property is $476K and should be assessed at $SOOK. These homes are assessed at 45, 54,

53, 58 and they do not have area influences as I am. So, given these factors this is what
we feel. Oh, there is also the condition of our home. We have the original deck on the
upper and lower which is in repair which I have pictures of which you may have seen.
The settling of the steps, we have the original -it's also inaccurate - it says we have oak
floors - we do not have oak floors. We just recently put in one oak floor in the living
room. We have carpeting -original carpeting and linoleum. The original windows - we
could use new windows. So, those aze the conditions of the home that I feel help to
depreciate. I think the biggest concern is the area influences because we would have
never bought there if we thought that and I checked about certain things. I was told that
for that road to be changed at the time when we moved. I had asked about that 50-foot
wide right of way. I was told that it couldn't be changed. It had to go thru a review.
What happened is that they had to go for a review and had to get special permission. It
wasn't that they just decided to do it. They had to get permission from the Town to
change that 50-foot right of way to do what it did to us.
Schultheis: Kevin, do you have comments?
Webster: I do. I do. This property has, as we were talking, has an assessment of 6200
which equates out for a taxable value of $590K as of July 1, 2007. It is on Alvahs Lane.
It's 1200 feet north of Route 48. There's a series of six lots that are, as Mrs. Slezak says,
there's a 2.1, a 2.2, a 2.2, a 2.2, other 2.2 and theirs which is 1.8. So, they are all in an
AC zone which is basically what they call R-80 so it is a 2-acre. The greenhouse has
been there for 30 yrs since 1978 and they did an addition on this in 1987 so Emie
Schneider has operated this greenhouse for a long time. They purchased the home in
1990 and that was an existing structure that was there for many years before they
purchased it. It is not a new structure that was put in after they purchased it. It's common
out here to have greenhouses around.
Slezak: Excuse me. It's common for them to be on the property line. There are
variances for the new greenhouses. This greenhouse is right on the property line. That is
not common.
Schulteis: When was it built -was it allowed?
Slezak: It was built before laws came, so it was Grandfathered in. But I'm saying that it
not like a regular greenhouse. He's leading me to believe that it is like any other
greenhouse.
Sommerstadt: It's been expanded, plus they have a dirt bike path which is very
annoying.
Slezak: And, they're allowed to have it because it's agricultural. Not to mention the
dust...
Sommerstadt: The trail of people. They have their workers housed in a trailer. That was
added later. It's right on the northern property line.
McConlogue: So, for the first couple of years, you didn't experience any heavy traffic
or...
Slezak: No, we would not have moved there.
Sommerstadt: We had no problems with the greenhouse
Slezak: For the first five years. It's when he started expanding. In ' 91 that's when the
other one-family dwelling was constructed. In ' 91, the second home came. So,that
traffic from the back came because he doesn't have direct access to Alvahs Lane. So, he
is using our side also.
Atkinson: Who owns that I S feet?
Slezak: The winery.
Atkinson: The winery owns that.
Sommerstadt: It's an access to the vineyard and the winery is in the back. Because he
doesn't have access to road so he has a 15-foot right of way.
Slezak: Now, when he has people parking there. If you look at the picture, the dirt road
is where they park. Let me tell you that they park into my trees, they park on the side,
they.. and he's having large groups. Could you imagine -look at the space -there were
3 busses from Adelphi there. They couldn't turn around -they had to back up, we've
had cars back out, drive backwards because they can't turn around.
Wiggins: Mr. Webster, since you mentioned these other 4 or 5 lots on Alvahs Lane, do
they all have similar houses on them? Built around the same time?
Webster: The first couple, I believe, do. The one that is just south of the Slezak's is a
new house that was put up. But, Ibelieve - I don't know if some of them are vacant.
Wiggins: 16.3?
Webster: 16.3 has a new house that was put up.
Wiggins: And 16.4, 5, 6 & 7?
Webster: Some of them might be vacant. I don't have them. I have to go back and
check.
Slezak: Two of them are vacant lots. And the other ones were not built when ours were
built. They were built -like 4 or 5 yrs ago. We've been there '90.
Wiggins: What aze the taxes on those houses?
Webster: I don't know. I don't know what they aze.
Slezak: Last yeaz the house next to us was taxed exactly the same. I spoke with Mr.
Webster last yeaz it was exactly taxed as mine was. And it's a home that's bigger and has
bigger land. He said because it's not totally done yet. Well, it looks totally done. The
people come to spend the week ends there.
Webster: As of last taxable status date, it was not complete. As of this taxable status
date, it's a complete assessment. I don't know exactly what it is. It was higher as we
discussed then 6200...
Slezak: It was the same - 6200 - up until when it just changed - Mazch 1. Because I
came and I asked.
Webster: Because last yeaz it was a partial assessment because it was not complete. We
were looking at that over the yeazs and the owner was taking his time in finishing his
home. But now it has a complete assessment on it.
McConologue: Kevin, did you look at any of the compazables?
Webster: I did. I did. Because the land size is 1.83, it's a 1730 squaze foot, 2-story
home, 2 bathrooms, firll basement, fireplace, 2-caz garage that's 460 square feet. We
have them down for a deck and a porch combined for 214 square foot and an out-
building. Ihave 4 sales that I have looked it there in the Cutchogue azea. Two on Alvahs
Lane, one on Horseshoe which is very close but it's a residential development that is just
east of their home and one on the Main Road which is obviously a very busy road and I
come out to higher value than $590K. The property was reduced by this Grievance
Board back in 1993 from 7100 to 6200. I feel it is a fair assessment. I do have awork-up
based on adjustments - I feel my net adjustments are fairly reasonable for the azea. The
two homes that sold on Alvahs Lane aze both south of Route 48 but they are on the same
road. The other one on the Main Road -- take Alvahs Lane down south, make a left and
it's right there on the north side of Route 25 on the Main Road. So, I feel that at this time
the assessment is fair based on the size of the land and the size of house.
Slezak: The house that he is talking about on the Main Road was completely renovated.
Walls, paintings, siding, everything -the house that you are talking about because I've
watched it change. My home is in disrepair so I don't think you can say - I really
disagree with it.
Wiggins: If your home is in disrepair and you repair, then the assessor will not raise it,
that is just maintenance on your property. But it will affect your sale price though.
Slezak: Alright. Obviously people wanted the house on the Main Road in Cutchogue
and in some places when you speak to realtors that's a real plus because people can walk

to the library, they can walk to the town. They are not having adverse situations. Yes,
it's on the Main Road, but their frontage - cazs aze going by -they are not driving on
their property interfering with their private life in the back.
Wiggins: I realize that is a concern and this Boazd will consider that. It's a unique
situation
Sommerstadt: I don't think there is another property in the town of Southold that has
these types of outside influences on the northern....
McConlogue: Does the claimants have......
Sommerstadt: It's like a double whammy of the winery and the greenhouse.
Slezak: And, what else is to come? They're now having Tuscan week end. People are
just coming in the back, driving back and forth. I can't sit out in my back without having
noise from the dirt bike, having people drive by, being sprayed on, having the DEC
come. Well, I'll leave it to you and I appreciate the time that you have given us.

Mr. K: Phillip Kermanshahchi, 7213 Peconic Bay Boulevard, Cutchogue 11958
Webster: Two copies of his property card. If you want to circulate them around, I've
made the copies.
Wiggins: It dropped from 11,200 to 8,300.
Webster: Well, I increased the assessment from this Grievance Board's reduction last
year. I've honored their decision and started at the base assessment of 6600 which was
reduced June 15 of'07 and I just took the increase from that point forward. The
Grievance Board reduced his assessment by that amount and I honored that so I took the
it
66 - he had basically $1700 worth of improvement on our card -the way we value the
assessments and so I increased it by that amount.
Wells: New improvement - GB -what???
Webster: That the Grievance Boazd -that was done by your Board -reduced it from
9500 to 6600.
Wells: Alright.
McConlogue: I thought you looked familiar
Webster: Last year's property cazd and assessment did not reflect a garage so there -
when we were there last taxable status date -meaning Mazch of '07 there was a rough
structure of a garage - it was covered but it wasn't finished so we did not assess the
house for any type of a garage last year. This year when we went there is.
Atkinson: The garage is the only improvement he's made since the last time he came
before us.
Webster: Well, that's the only improvement that we made. Yeah - we were there just
before taxable status date and we increased the assessment for the gazage only. I don't
know what's there after taxable status date on, but the increase was from the garage.
Wiggins: Why was the property increased to 10,100 on 3/1/07?
Webster: Oh, because originally the house was assessed at a 1428 square foot seasonal
cottage with no heat, no basement, no fireplace at a rate of $1.50 a square foot. When we
went to the home and took a look at it, it turned out to be a 2200 squaze foot ranch with
no basement, but a fireplace and a gas forced hot air system. All of that work -this is
something that you probably don't remember from last year -all that work was done
without a building permit. I believe that Mr. K testified that it was done before he
purchased the home but the work was done and it changed the house dramatically by over
50% and that's the reason why there was an increase. We also found a patio of 1314
squaze feet that was not on there and also central a/c so that was the reason for the
increase from 4600 to 10,100. It's only in the improvement -nothing to do with the land.
We kept the land assessment the same since 1977 and...
Wiggins: And, then you have a correction of errors that brought the values down?
Webster: Yes. Based on the survey we took the exterior measurements of the home
when we were there at 2375, the survey said 2200 so we honored the 2200 and made a
correction at the time from 10,100 to 9500 based on the improvement going from 7700 to
7100.
Wiggins: And at that point the 95 that came to us and it was dropped down to 6600.

Webster: Correct.
Wells: I guess he has a new garage.
Mr. K: What was there prior was a car port and we basically enclosed the space - a
weather proof gazage.
Wiggins: There was a car port there the same size?
Mr. K: No. It was about 2/3 the size of the garage.
Wells: So, the garage is now 25 x 29 with a loft over it.
Mr. K: Yes.
McConlogue: Unheated?
Mr. K: Upstairs, it's storage.
McConlogue: There's no heat in the garage.
Mr. K: No.
McConlogue: And the price per square foot that it was valued at?
Webster: $2.25. If it were second-story living, it would be $3.75 a square foot. That's
standazd rate that they have used in this town from 45 plus years. But, it's much lower
than that.
Wiggins: You have beach rights with this property too?
Mr. K: No. Nice view of the golf course.
McConlogue: Been using for yeazs and years -unheated it's $2.65 per square feet -
Webster: $2.25
McConlogue: And heated is?
Webster: $3.75 of the base level.
Wiggins: It was also a larger building too.
Webster: We didn't have a carport on there. If you look at the card on the back the part
that's crossed off, there was 1428 x $1.50 gives 2142 and then there was a deck of 288
square feet for $43. So the total assessment was 2185 and then when you bring it back

over to the other side in 1980 it was 2200 so it's been - it was 2200 from 1980 until
2007. When this work was done nobody knows. I don't know. As I said Mr. K has
testified to the fact that it was done before he purchased it. So, for however many years it
was 2200 square feet when we had it assessed at 1428 and we did change it because of
that. There's no carport on there ever either which usually is an assessable item because
it's a covered space similar to a porch which is 50 cents - % the rate of a garage on the
base level.
Mr. K: If I remember correctly one of you remembered Winnie Parini's house that her
husband had built most of it -put it together and I think the joke here last year was that
you had a fish bowl for skylight in the house and really it was a shower door that he had
basically stuck on the carport area to make it light coming to the carport. But, if any of
you remember, it's the old Parini residence.
Webster: I'd like to pass around the original card and the pictures are there that I've
taken of the home. The first two -and they're dated - of the two pictures aze two angles
of the home and the third photo is an older photo probably from 1980.
Atkinson: You increased the assessment just based on the gazage. Is that correct?
Webster: From last year to this yeaz -yes.
Atkinson: And you're contesting on the assessment that was added on for the garage?
Mr. K: What I'm saying that last year when there was anincrease - I was saying that
they took into account the garage that was maybe not completely structurally done, but if
you see the survey gave you with it already drawn in and that's dated 2005 with the
garage in there.
Atkinson: Did you do a partial assessment last yeaz?
Webster: No. As I testified there's no gazage on that assessment last year. It did not
come on the card until this tentative roll - May of '08.
Schultheis: The survey shows the garage under construction - it doesn't show it as...
Wiggins: We have here -taxable status date is when? The 31 s`
Webster: Marchls`of2008.
Wiggins: March 1 -okay.
Schultheis: And the only proof that you submitted is the value of the house from the loan
application.

Mr. K: Tthat's one thing and the other is if you go back two years ago the value of the
property was $460K with the assessor and all of a sudden just because there is the
addition of the garage for it to go up to this value every year if it's going to...
Wells: No, it went from 4600 to.... It went up from because all of a sudden it was not
seasonal, it was heated, it was added on to so that was over a 27-yeaz period. So, there
were changes made to a seasonal cottage that had been assessed at 4600. You didn't buy
a seasonal cottage.
Mr. K: I bought a building that had no Certificate of Occupancy, but it had air-
conditioning, it had heating, it had the same footprint minus the gazage. It was a carport
there. There was another carport on the other side of it which was in very bad shape
which was taken down just for safety reasons. And, what we did was we build up what
was concrete on the ground level with a patio so really as far as footprint goes, if you
want to put a change to it from when I purchased it, it would be just the garage which was
just recently been completed.
Wells: Yes, but the re-assessment, if I'm understanding Kevin correctly, because the
work to change from a seasonal cottage to a year-round had been done without permits.
Webster: Still no permit for it.
Wells: Still no permit for it. So it was adjusted for ayeaz-round house and whether it
was that transfer that kicked off the physical inspection I don't know. But the 4600 --
sometime in over 27 years, the house was basically re-built and made ayear-round house.
So, you were given an adjustment last yeaz which was the change from when the
realization was that you bought ayear-round house. You were given a break for that and
you aze being added on again for finishing the garage.
Mr. K: And, there still is no C of O. So, if you want to evaluate as a building with a C of
O, I don't think it's fair yet.
Schultheis: Is the garage finished?
Mr. K: There is still some work being done.
Schultheis: What is lacking in getting a C O right now? What hasn't been done that
qualified for a C O right now?
Mr. K: I would imagine I would have to shore up the upstairs a bit. The loft space.
Schultheis: Is there a building permit that you are going to do that?
Mr. K: There is storage it was going to be just storage up there at which point I want to
fix up and add maybe a room to it or something like that, but I haven't done that yet. I
don't think you can get a CO if someone steps on it.

Schultheis: Do the plans for building permit show that you're doing that?
Wells: The building permit was just for the garage.
Mr. K: It is. It is a lot of storage space upstairs - basically an attic.
Schultheis: Do you have a copy of the plans?
Webster: I do. I just want to say one thing. We don't assess based on a CO. I think you
guys know that. If we did that - if people wait and wait and renew these things, you'd
never have anybody get an increase in assessment. People have these structures, pools,
garages that they aze using and they keep replacing it and replacing it and getting a new
one and 10 yrs later that time they get a CO. They think they aze not getting an increase
in assessment. That's not the way the State works. They work with what's there. But, I
do have a copy of the plans showing that there's supposed to be a single window on the
south-facing side. But, if you look at the picture, the original photo there, there's
actually, I think 3 windows that come down this way. So, I'm not sure -the building
permit was issued -- oh, over a year ago. I think they get 18 months. I'm not sure
what's going to happen with this, but it's definitely a different look that's there. You
have a full dormer facing south when... Do you want to look at this? I can pass this
around so you can see.
Wiggins: I have a question with this card. On 3/27 of 07 you have the building permit
which says "as built" garage.
Webster: Yeah, I was going to ask the same thing...
Wells: Oh, well because it was done first and then they got the permit.
Wiggins: But, still the gazage is there and the taxes were increased to 9500 and then they
were dropped a month later I guess by the Grievance Board....I'm not sure.
Webster: No, that was dropped because I took the survey's squaze footage.
Wiggins: No, no. I understand that -correction of errors. That was on 5/15/07.
Webster: Yes.
Wiggins: It's got the gazage there from 3/27 and then you've got a 95 total and then
there's a GB - is that Grievance Board?
Webster: Yes.

Wiggins: Alright. Down to 66? Okay. And that was 6/15/07. Now, that garage is
already on here. That was reflected in the 95 down to 66. The garage is already down
there. What is this new improvement when the gazage was already there?
Webster: Well, the permit came in after the taxable status -that's why it's not on the
property cazd. Taxable status date is Mazch 1, 2007. The permit for this gazage came in
after taxable status date. So, that's why it's not on the property card.
Wiggins: But, it may not be on the card, but it's on remazks which says there's a garage
here - 3/27/07 whether he's got a permit or not, you're still taxing him here for it and
you've brought his taxes to 95.
Webster: The 9500 does not reflect the garage.
Atkinson: The 9500 reflects a correction of errors for the square footage.
Wiggins: I understand that. You've got a 10,100, 3/1/07. 3/27/07 you've got the gazage
- the garage is on there. Then it was corrected to 95 with the gazage on there. The
garage is on this card as of 3/27/07 from what I see.
Webster. It's written on the property card by somebody in our office, but it's not
reflected in the assessment on the back of the card. It's not reflected in the assessment.
The permit was taken out after taxable status date. So, that's why we aze saying we aze
not - we did not assess him for a garage last yeaz. If somebody builds a pool on that
same date, March 27 of 07, they're not going to have an increase in the assessed value
come May of 2007 because the taxable status date set up by the State is March of 07 so
you build a pool on March 2 of 07 and you're not going to pay adime -you get a free for
that whole summer and all of next year as well.
Wiggins: So, you feel that the assessment went from 66 to 83 because of this garage.
Webster: Yes.
Wiggins: And how many square feet is it?
Atkinson: About 765 square feet.
Webster: I don't have the original card in front of me.
Atkinson: Based on the first floor dimensions.
Schultheis: The increase was 725 square feet for the gazage at 2.25 which gave us 1631
and then the patio was 1314 squaze feet at .25 per
Webster: That was already on there from '07. The only increase was for the garage.
That's it.

Schultheis: So the increase was for $1631?
Webster: Yes, added to the existing assessment which put it at an increase of 1700
because there was a little bit left over there so when you add that 1631 to the existing, it
came out to $1700.
Wiggins: So, you have assessed the garage here at $1631, correct?
Webster: Yes.
Wiggins: That's the assessed value for the gazage?
Webster: Yes.
Wiggins: Now, you want to add that on to the 6600, right?
Webster: Yes.
Wiggins: And, that would be the 83, alright.
Schultheis: Anybody else have anything else to add?
Wiggins: So, you have this property as being worth $790,000.
Webster: Yes. Based on the most current residential assessment ratio.
McConlogue: So, you understand that the gazage was not assessed unti12008. It was
never assessed before that.
Mr. K: What was the increase last yeaz for then? Why did we go from 4600 to 6600 and
then again now 6600 to 8700?
Webster: May I answer that. The reason was as I stated before that it was originally
assessed for only a 1400 some odd (I don't have the card in front of me) square foot,
unheated, seasonal cottage. When we looked the numbers exactly at 2200 square foot
ranch, with heat, fireplace and no basement. It also had a patio which was never
assessed. It also had central air conditioning which was never assessed. So, those are
dramatic increases. That's more than a 50% increase in the square footage of what was
originally on there. As Mr. Wiggins is looking at, you can see the plans -how they were
drawn up with the family room and the bedroom. All of that did not match with what was
on the card. Originally and again, all this was done without a building permit and there
still is not a building permit issued for as built improvement. The plans that you are
looking at now show a single window on the south side and if you look at the original
photos that I think Cara is looking at, there's a large dormer that runs along the back side
of that.

Wiggins: Mr. K, do you feel that your property is worth $790,000?
Mr. K: Definitely not in this market -definitely not in this mazket.
Wiggins: Do you have any compazable sales of comparable homes that would reflect the
assessment is too high.
Mr. K: Well, I had a property that I had bought on Peconic Bay Blvd that had just sold. 1
had bought it just prior to purchasing this property and I had bought it for $267,000 and
this is in the year of 2004 -beginning of 2004. I just sold it in October for $225,000 at a
loss so considering if that is where the values aze going, I have paid $500,000 in 2004 for
this.
Wiggins: So you have a comparable sale in the azea of a property that you owned that
sold for 200 and something thousand dollazs?
Schultheis: Is a vacant piece of land?
Mr. K: It had a house on it, but it longer has a house on it.
Schultheis: So it was sold as a vacant piece of land.
Mr. K: Yes.
Schultheis: So, you're comparing a vacant piece of land to a (Inaudible)
Mr. K: The house was basically shack, it was not..
Wells: Well, this house was basically a shack and was appraised as a shack and when it
was discovered that it was more than a shack, it went from 4600 to 10,100 and last year
we reduced it a little and then the garage was added..
Mr. K: So, the garage has basically doubled the value of my property - er, the house.
Wells: It hasn't doubled it.
Mr. K: What percentage has it taken it up?
Wiggins: It brought the assessment up $1631. It went from 66 to 83.
Mr. K: That includes the land.
Wiggins: That's your total assessment.
Mr. K: The land will never grow, but the house in itself, has because of the addition of a
garage, has gone up by a substantial percentage.

Wiggins: No more than what it's supposed to. $2.25 per squaze foot for the squaze
footage of the gazage and then comes out to an assessed value of $1631 and that's what
was increased just for the price of the garage not the whole thing.
Schultheis: How does that $2.25 per square foot deviate from what other gazages are
assessed at?
Webster: Well, thank you for asking that because I was going to bring that up. It's
consistent with every other property in the town with a new garage. Gazages are assessed
at $1.25 a square foot and the upstairs if it's finished is assessed at $2.00 a squaze foot. It
it's not, it cut by I S% if it's storage to $1.00 a square foot. So, if we have $1.25 for the
bottom and we have $1.00 for top, that's consistent with everybody else in the town that
has storage up. As I said before, if it were finished space up there, it would be $3.75 a
square foot.
Wiggins: But, he doesn't. You're saying that he has something going on upstairs.
Webster: No, he does not. It's just storage.
Mr. K: It's a storage space - I think.what.I .....
Wiggins: And you charge $1.00 a square foot for the storage.
Schultheis: So, the $2.25 per square would be consistent with any other structure of this
nature built in the town right now.
Webster: Yes.
Schultheis: Okay.
Wiggins: And, how do you determine if this is storage? Because he's got a floor and he
can put things in there?
Webster: Well, the plans said it was storage. But, again, the plans also called for 1
window over here and, really, I think we have 3 windows with a full dormer calling for a
single. So, I'm going by the plans.
Mr. K: For storage and head room to maneuver, I have the pitched roof.
Wiggins: Thank you. We will review this.
Schultheis: Now, what's happening with this extra dormer which is not on the plan?

Mr. K: Just more head room because of the pitched roof. You really can't get close to
enough storage. Even though if you look at the footprint of the garage, what is up there
once you have a pitched roof, there really isn't much room.
Schultheis: Kevin, what is the procedure for determining head room? At what point in
time is the increase assessed for? If it 6 feet and under...
Webster: Yeah, if it's just a knee wall, I don't think the Bldg. Dept. would allow for that
to be used as living space.
Schultheis: If you have an knee wall, you increase that head room to 6 foot or more, then
it's assessed for more of a value.
Webster: Yeah, we go with what the plans are. And if we can get an inspection, we can,
but if they grant these plans aze improved and we get them, that's what we look at to see
what the height is. If somebody has a 5 foot all the way across, it's just storage, it's not
going to be living space. But, I'm not familiar with every single building code and how
that works. But, in this situation, I believe, the building permit is issued for a garage with
storage over. So, that's the way it's written.
Schultheis: The plan doesn't reflect the additional dormer that was added.
Webster: No. No. Right now it just says attic with storage. And showing this one single
thing here. But, now it goes across this way.
Schultheis: So, at this point in time the plans are not in conformance with what is
actually constructed.
Webster: I'm not sure. I'm just looking at the plans that I have. I don't know what's
been done; if there...
Schultheis: Is the dormer.....?
Mr. K: No, the dormer is larger.
Schultheis: And, it wasn't on the plan and it was built without plans.
Mr. K: Well, the window area that was given in there, was not in our....
Schultheis: How wide was it before anything was done?
Mr. K: I think it was 6-7 feet.
Schultheis: How wide is it now?
Mr. K: I would say maybe 10 feet

Webster: The windows aze 5 feet -just the windows themselves without the framing of
the dormer. Each window is 5 feet across. Again, I don't have the original. Are there
three or them or two of them? I assume there's going to be an amended plan to this to
them and then to us.
Schultheis: I assume when he gets a CO, he'll have to get an amended plan.
Schultheis: Well, I think we have enough with what we need to make a determination
now.
McConlogue: Do you have any comparable sales?
Mr. K: No I don't.
McConlogue: He can still submit them now if he has them.
Mr. K: I can always go back.
McConlogue: As far as we're concerned, we're taking everything now.
Mr. K: No. I don't have any comparable sales.
Wiggins: Well, you do have until 8 o'clock tonight, so if you want to dig some up, we
can look at them.

Schultheis: Okay. It's the evening of Grievance Day and we will reconvene the meeting
of the Town of Southold's Boazd of Assessment Review.
McConlogue: Please stand up. Please raise your right hand. You do solemly swear that
the testimony you are about to give in this proceeding is the whole truth and nothing but
the truth so help me God.
Mr. Matejka: I do.
McConlogue: Please state your name and home address.
Mr. Matejka: My name is Jerry Matejka, 1300 Strohson Road, Cutchogue, New York
11935
Schultheis: What kind of proof or substantiation do you have to offer?
Mr. Matejka: Should I start? I have documentation that I would like to submit to the
members here. On way of introduction if I may, this property at 1300 Strohson Road, has
been in our family since 1951. My Aunt Mildred in 1999 had set up a Life Estate as she
had gotten on in her years. My wife and I were taking caze of her and when she passed
we had gotten the house as a small two-bedroom house. I don't know if the pictures are
on the reverse side of it. We realized that it was about 800 square feet as I remember.
The house was too small for our family so that in 2006 what we did we hired a licensed
Southold town contractor, DNT carpentry, at a price of $318,500 with DNT, Mr. Don
Conalise's firm. For this price the house was - I say -totally demolished. To answer
your question, Mr. McConlogue, the house doesn't look the same. It doesn't for a very
good reason. It was demolished. There was nothing that he could save on it except for
one exterior wall and a half. That was all that was remaining and a plywood, sheeting
floor. So, that as shown in the contract which I've got and I will leave here also. The
contract was for a fixed price of $318,500 and included complete, total work that was
done in the house. From framing to Andersen windows to doors, to heating, air-
conditioning, stairway, oak floors. Everything was included in that price so that for the
price that we paid him and we have a CO now about 3 or 4 months that we are able to
move back into it. For that amount of money, the job was completed. One or two extras
-there was a $3,000 fireplace that we had - a gas fireplace -that was not part of the
price and of course appliances were not included so we had to pay for appliances.
McConlogue: And that brought us to the final picture -the two-story.
Mr. Matejka: Yes, sir. Yes, sir. That story that you see -- he did really nothing on the
outside. There was an existing driveway so that he didn't touch that. He re-graded that a
little bit, but there was no landscaping, no real work per se. The kitchen cabinets were
included as well as painting. So, it did take 15 months to finally get a CO. Oh, I'm sorry
new cesspools and collapsing of the old were included. My aunt had them on the back of

the house I guess when they... and now they had to be in the front. So, they had to
collapsed in the back and new on the front. Now, we thought that we were - again my
wife and I are both retired on a fixed income. So, we thought we were doing the right
thing by going up rather than essentially out. Because there was plenty of room on the
side to knock down a garage and make this double on a single floor. The way our
neighbors are. Neighbors on both sides of us both have large footprint ranches. We
thought we were doing the right thing by going up. To our great shock and surprise the
fact that it cost us this amount of money when I got recently the new assessment from
Kevin and Mr. Scott for 8900 which would appraise it at $847,619. It was like: What! I
mean if I paid $318,000 for a house that was essentially demolished -okay now if you
want to add into it the value of the property which I'll double it. That's how I arrived at
basically the amount that I have which I had felt was $636,000. How did you arrive at
that Mr. Matejka. Well, I took the amount that I just had the house constructed for and
basically doubled it for the value of the property and the structures that are there. If I go
by the assessed values of the houses on both sides of me that are considerably lower and I
also have submitted documentation on two houses away from me on the same side of me.
Mr. Cannizzazo purchased his home on Strohson Road about 3 yrs ago for $635,000 and
that was before the mazket has taken a nosedive that it has now. So, that you know that
for the assessors to tell me that the house is worth $847 -almost $900,000 -there's just
now way. I mean I'm not looking for something for nothing here, but, again, I
understand Kevin was very good at explaining how he came up with the number. But,
again, that doesn't mean it has anything to do with the value that it should be. I'm basing
it on what I paid for it. I didn't any discounts from this contractor. None. He's licensed
in the town and he's a businessman like everyone else is. So, that was the fair price with
what he charged for everything. I have the contract and the payment schedules to show
that. I did wind up paying that. I can leave all that.
Atkinson: When was the date of the contract?
Mr. Matejka: The date of the contract was signed November 21, 2006. I got my CO end
of January of this year -let's say January 20, 2008. I've got some pictures - I'm not sure
Kevin had them in the package. It shows three pages. The first page is the before picture
when they started to demolish it. The middle page actually shows -the second page
actually shows the extent of the demolition. I mean clearly this was not -even though it
went in as a renovation and addition. Essentially, when he got into it he had to take
everything down.
Mr. McConlogue: So, what position is the best indication of value in at least the first
yeaz is the cost approach -what it cost to build it. Your position?
Atkinson: Plus the land.
Mr. Matejka: Plus the land. Exactly right, Ma'am. Exactly right.
Webster: My position is you have to go with market value. As of July 1, 2007, what the
home was worth as of that date based on what was there as of March 1, 2008.

McConlogue: Can you help us make a decision?
Mr. Matejka: Oh, the only thing I would say is that Kevin keeps referring to -we've
had this discussion. You keep referring to what was there in July of 2007.
Webster: No, that's not correct. What was there Mazch 1, 2008. What was there March
1, of 2008 valued as of July 1, 2007.
Mr. Matejka: Okay.
Webster: And, what was there Mazch 1, 2008 was this existing home with its CO
already. So, you have to value the home which was there March 1, 2008 as of July 1, of
2007.
Mr. Matejka: The new house -the house right now as it is as of what the value would
have been in July of 2007.
Webster: That's correct.
Mr. Matejka: When the market had..... but, again, it's again I think that in the complaint
form that certainly is on the second page, grounds for the building has recently been
remodeled, constructed with major improvements and that is cleazly shown on my second
page as my - so I've taken what it cost to construct that house. It's as if you were buying
a house, Kevin for $300,000 and then as soon as you bought it, the assessed value tripled.
You wouldn't be happy with that. In other words, if you bought a house for `x' amount
of money and all of a sudden after you bought that house someone immediately said to
you: well, your taxes are going to be worth $900,000. Unless you got that house for
nothing from a relative which we didn't do. We spent this money and this was cost and
it's a complete construction job. This is not like adding a second floor that we have that
the situation that we have here. The house was essentially demolished.
Schultheis: Kevin, let me ask you something. On the calculations...
Webster: First of all, I need a copy of the cazd. I need to look at the original or
anybody's copy because I do not have an extra copy.
Schultheis: What I seem to be seeing here is that you took this as a whole brand new
house. In other words, somebody built this house from scratch and then assessed it based
it on the square footage and the rates per square foot. Is that correct?
Webster: That's correct. The base level of the home. Let me just say this. This was a
884 square foot, one-story house with the original assessment. Now that 884 is two-story
and there's an additional 140 square foot that's two story that was added. And an
additiona188 square feet that was added so the home - right... So, the home is effectively
2136 square feet when originally it was 884. So, the home was more than doubled.

Schultheis: Almost tripled.
Webster: Two and half times. And, I have to object to Mr. Matejka's comment that I
tripled his assessment. His original assessment since 1968 was 5100. Now, it's 8900. I
strongly object to that fact that he is implying if I had bought a house and my assessment
was tripled I would have a problem with that. I will say that I would definitely have a
problem with that. But, in this case by no means... the home was improved by 2 Y~ times
and the assessment went from 5100 to 8900.
Mr. Matejka: But, Kevin, I couldn't grieve the thing because, as I said, my aunt owned
the house and she actually, technically owned the house until she passed away in 2002.
So, that even in '99 when she set up a life estate that still didn't give me the right to
grieve it and since we had early on decided that we were going to renovate the house - do
a major job. I didn't pursue the fact whether it had been over-assessed at 5100 or 5600 or
whatever it was prior to that. I didn't have the right to grieve it and I just let it go. So,
you're using that and saying well, look it was that much for 800 square feet -that doesn't
mean that if she had her wits about her to go ahead and to grieve it, that it should have
been done. She didn't. So, it's unfair as a comparison. I'm claiming it's unfair to say
well, look what it was at 800. It's 2 ''/z. If it were assessed to begin with at the time,
Kevin....
Webster: Well, may I say this. If you look at what the ratio was in 2005, the ratio was
1.26%. 5100 divided by 1.26 would show that this home on a creek would have a taxable
value of $405,000. I think that's probably the reason why she did not file a grievance. It
would be hard pressed to prove as of 2005 that this home -the pre-existing home on a
creek -with 1/3 of a acre with 110 feet of waterfront with a dock would be worth less
than $400,000.
Atkinson: That was my next question - if he has a dock?
Webster: And, another thing is that the home has central air conditioning now. Has 336
square feet of porch that all wasn't there. Both of those items were not there. The
bathrooms were doubled.
Wiggins: Why were her taxes reduced from 56 to 51 in 1968?
Webster: Building removed. Assessment reduced $500. If you look at the second line
down, Mr. Wiggins, May 1 of 1968 under "remarks", it says building removed,
assessment reduced $500. So, I don't know what kind of building that was. But
something was taken off with the assessor back then. Oh, here it is. You know I can
barely see it. There was a cottage and back then...
Mr. Matejka: Oh, Mr. Wiggins, in 'S1 when the bought the property, there was a cottage
on the premises and then in the 60's, they had that little -since it was only my aunt and
uncle -they had that little 2-story ranch that was built in '68. So, there was a pre-
existing structure and that structure was removed and I think Mr. Drokowki took it away.

They had migants working on his property. So, that he moved that house -that cottage
- to his property on Sound Avenue. A little bit of history.
Wiggins: The 3600 that you have at 3107 was for the partial.
Webster: Correct. We had discussed it and I reduced it down after we had adiscussion -
down to 1800 on the improvement.
Atkinson: How much was done at that point?
Webster: Well, it was not very much at the time. Mazch 1 of 2007 there was a
foundation and it was not complete. So, it may have dropped down. I cannot recall what
was there on Mazch 1 of 2007. We ageed on it.....
Mr. Matejka: Well, we didn't agee . You and Ihad -- I had a lot of difficulty with that
because in March 2007 what was there was the middle two pictures -the ones showing
the walls. He was not that far along on it. But, I went along with what you said. I wasn't
happy with the fact that you only dropped it to 3300 with what was there.
Webster: I dropped it to 1800.
Mr. Matejka: I thought it should have been dropped even more at that time. But, you and
I had that discussion. Because that picture -the middle one -shows what was there.
And it doesn't matter. At this point it doesn't matter what was there from my standpoint.
It's that I know what it cost me and what the value is and I just think that at this point that
-how many houses would you want to buy like mine. I mean we are not selling it but I
mean - at 800 -almost $900,000.
Wiggins: The difference in taxes that from the way your aunt had the house. From 5100
... it's now assessed at 8900 shows a value added to that structure of $362,000 which is
almost -not quite what you paid to have the work done but it's within about $50,000 of
that.
Mr. Matejka: But, the old house was removed so it can't be added to. It shouldn't be
added to because that would be fine if I were adding $360 on top of what was there. But,
my whole claim, Mr. Wiggins, is that house was removed so you can't add the two. If
you add the two components that you know you're at 800 or 900 -that's - I just don't
see that. I am holding to purchase price, cost what I have here. Plus land value. And it
doesn't come up anywhere near that. Otherwise, I wouldn't be wasting you time here.
Atkinson: What's the land??
Mr. Matejka: The land - I doubled it for the land - I doubled it for the land. Another
$300 to come up with a total which is $636,000 is what I feel it is worth right now.

Webster: I think Mr. Wiggins makes a great point on this. 860 squaze foot house had
3300, now it's 2'/z times bigger and the improvement went from 33 to 71. If you look at
it that way and I think I have discussed it with you. 800 squaze feet was 3300. Now,
it's 2136. So, if you say it's doubled and you take 884 and double it would be 1768 for
an assessment of 6600 if we doubled 33. But's it bigger than 1768 -it's 2136 and it's at
7100. So, it works either way you look at, that works.
Schultheis: And the 2100 -- does that include the porches.
Webster: No. No. Just living space, 336 squaze feet of porch -that's additional. So,
even if you said it was doubled -the porches, the central air is additional -the dock is
additional.
Mr. Matejka: The dock's been in there all along. You know that was another thing.
Right now I just feel that the assessment - I mean that dock is not something that has just
been added. The dock's been there. The bulkhead has been there. And, for now to come
along and start charging for that -you know the gazage has always been assessed. But,
it's not like every little piece when you showed up you went and added.
Webster: So, you feel that we should not have assessed your dock even though you have
an existing fixed dock, sir?
Mr. Matejka: No. No. Believe me if you removed the dock that would not make me
happy. I'm just making the point. The dock is not the issue here. It's total value that
we're looking at.
Webster: Total value that the State's value of your house is $847,000. You have a 2136
square foot, brand new home with central air conditioning, a porch, a fixed dock, a
detached gazage on .37 acres in Cutchogue on a private road.
Mr. Matejka: Well, what aze you telling me that ... wait a minute. What is that you're
telling me. You're telling me that I underpaid for the work that I had done.
Webster: I'm just stating the facts of what your home is.
Mr. Matejka: But I'm showing you what I have paid to have it done.
McConlogue: You have sales, Kevin or anything? What is your $847,619. How did you
arrive at that? Square footage?
Webster: I used the rates per square foot of $5.50 per square foot which is the standard
rate that we have in the town for properties with a full basement and a fireplace. I used
$3.00 a squaze foot for the section that does not have a basement. I used $.50 per square
foot for the porch. $200 per unit for the central air conditioning. I used $200 for the
dock. I kept the $1.00 per square foot for the existing garage. And the outbuilding is at

$.75 a square foot. Those are standard rates that this town has used since the mid-60's to
value improvement.
McConlogue: Using those cheap rates, you came in much higher than the claimant.
mean much lower.
Webster: I came in at 7100 for the improvements and the land assessment has been the
same since 1968. I did not adjust the land assessment. When I put those numbers in it
comes out to an $8900 assessment which equates to a taxable value of using the state's
RAR of $847,000 as of July 1 of 2007.
Atkinson: So, what you're saying is you took the 2-story, the 1-story, the porch and you
did everything by the book that's been done since 1968 and you just figured it out by the
book, by the book and you arrived at 7100.
Webster: Yes, actually since 1962. Yes, that's absolutely correct. Those are standard
rates that the assessors have used.
Atkinson: This is 5.50 for this, 3 for this, there's no....
Webster: There's no improvement for anything. Sometimes they would add if there is
superior quality...
Atkinson: Like a cedar shingle roof.
Webster: Yes. Correct. Or everybody has 10-foot ceilings, paneled walls -things like
that. In this case I used the standard rates that have been used and it comes out to this for
an assessment.
Schultheis: Kevin, if I built this same exact house on another lot -brand new -what I'm
hearing from you is that it would be assessed exactly the same way?
Webster: Yes. It would.
Schultheis: There is no deviation at all from where there is a brand new house built
elsewhere would have been assessed at?
Webster: Right, similar quality which we consider to be average quality.
McConlogue: Did you test the cost approach with any sales or anything?
Webster: We don't use the cost approach.
McConlogue: How much per square foot is the cost approach, isn't it?
Webster: Well, these are the rates that used per square foot.

McConlogue: It's the cost approach.
Webster: Well, when you're figuring cost approach, Mr. Matejka is using a cost
approach of what he spent.
McConlogue: I understand what the problem is.
Mr. Matejka: I don't know why the State of New York -with due respect to you, Kevin.
Why the State of New York then would even put on their complaint form a portion
dealing with recent remodeling, purchase price, etc. etc. price that they want to know if
they aze using your approach since the 60's. I mean there's a disconnect here. There's
an obvious disconnect.
Webster: The reason why they do that is they give you a bunch of options to use. If you
look at the form they'll give you purchase price, they give you listing, they'll give you
appraisal, they'll give you cost of construction, additional documentation. They give you
some broad thing to use.
Mr. Matejka: And, if it's of no value, if you're not considering that at all. If you're not
using any cost factors inhere at all except the model that was valid for you since the
`60's then.... there's a disconnect here.
Webster: What you have to do is though -what they ask for - is if you look at the front
-number 7, they want a market value of your property. That's the number one thing you
have to do. If you look here, they are asking for current full market value of the property.
Then you have to take your current market value of the property and convert that to a
new requested assessment. So, that's what the State wants. I'm not a legislator and make
these rules. They want to know number 7 on that form. You have to put down current
full mazket value -market value as of July 1 of 2007 based mostly on market value
which is based, as you know, on comparable sales is what market value.
Atkinson: Just to give the petitioner a weighted argument, he paid $318,500 -did you
figure out - if you added on to that -just to arrive at a mazket value and a supportive cost
approach -the cost of your bulkhead and the cost of your dock and your additional
appliances that you had to pay for and your custom fireplace -what do you think that
would bring it up to? Using a cost approach.
Mr. Matejka: Alright.
Atkinson: I mean bulkheads are $300 a foot.
Wiggins: Is his property bulkheaded?
Mr. Matejka: Yes, it is. But, again that's been bulkheaded since 1968. I didn't bring
that, Mr. Wiggins, but that -you know my uncle had done that -way back when, he had

a number of 600 or 700 when that bulkhead was put it. So, that's been there. So, even
though the house was essentially demolished, the bulkhead was there.
Atkinson: No, but what I'm trying to say is you're looking at the cost approach and
Kevin is looking at the market value so I'm going to say all the way with the cost
approach.
Mr. Matejka: Okay, let's do that. Let's start with the purchase price - I mean the house
which is $318.
Atkinson: Add in -- your fireplace was extra.
Mr. Matejka: $3,000.
Atkinson: Your appliances.
Mr. Matejka: I would say $10,000.
Wiggins: The existing foundation.
Atkinson: Has to be worth something.
Mr. Matejka: $15,000.
Atkinson: A bulkhead at $300 afoot. - 110 feet - is 33,000. How much for the dock?
Mr. Matejka: I spent $7500. The dock was 7500.
Atkinson: The whole dock complete?
Mr. Matejka: Just for renovation on it.
Atkinson: Well, what do you think if you had to get a cost for the dock?
Mr. Matejka: 10,000.
Atkinson: 10,000 -okay.
Mr. Matejka: That's another 65 to 70,000.
Atkinson: And how much for the land?
Mr. Matejka: I said $300,000.
Atkinson: You think 300 for the land. I think that's a little low.

Schultheis: It's waterfront?
Mr. Matejka: Creekfront.
Schultheis: It's got water deep enough for a dock?
Mr. Matejka: Yeah, but the boat can't come to the dock. It's out on a piling because it is
a little shallow.
Atkinson: Well, I think you're a little underestimating the site value.
Schultheis: On the land.
Atkinson: Yeah, on the land. I'm trying to do is bring you up to the cost approach and
get some correlation there. I would say creekfront property is probably worth.... Maybe
550,000
Mr. Matejka: But, it's not at the bulkhead though. The 1 foot is %2 way up the dock
that's why they won't let me put a floating dock on it. That's why I have to have the boat
on a mooring and pull it into the dock. So, when I say 1 foot that's not 1 foot at the
bulkhead so it's '/Z way up the dock.
Atkinson: So, adding in all those and 550 for the site.
Mr. Matejka: I mean if it were 550 for the land and 300 for the house and you add this,
you're back up there.
Atkinson: But, what you're saying is that you're basing your total value on the land
being worth 300.
Mr. Matejka: Yeah - I'm saying the construction costs and I've doubled it for that as my
number. Because again he's got it appraised at...
Webster: It comes to 847.
Mr. Matejka: No. No. Kevin, we're talking about the property -the land -it's
ridiculously low. I understand that.
Schultheis: Just taking a quick look at potential cost. Land potentially is worth 550.
You paid 320 for the improvements, applicances were 10, foundation excavation -
structure for the foundation probably in the vicinity of $50 a square foot -that's 40,000
Mr. Matejka: I'm sorry -what was the 40,000 for, sir?

Mr. Matejka: Of which was there . It was there.
Schultheis: Fireplace is 300. That adds up to 923,000.
Mr. Matejka: I just don't see it. I just don't see it.
Atkinson: If you could find comparable creek front, vacant land sales, that's what you
would go by.
Mr. Matejka: There azen't too much. If I could have, I would have. I did a little
searching and I just didn't see it. There's really nothing there. My neighbor, Cannizzaro
- two houses down from me -...I don't know if I passed that piece of paper azound or
not.
Wells: But there's another property down the street which sold for a couple of million.
Mr. Matejka: This one here -this was two houses down -this was about 3 yrs ago. That
house is on the creek with me. It was on the market for 675 and he wound up getting it
for 635. He's two houses away from me on the creek.
Atkinson: How big is the house?
Mr. Matejka: I don't have that. On both sides of me the 2 lazge footprint ranches
(inaudible)
Webster: I know the name, but I don't the information on it.
Mr. Matejka: I should have asked for that. Only if the members want to hear it.
Wiggins: Well, it would be nice to hear what they are assessed at.
