party of the second part,
WITNESSETH, that the party of the first part, in consideration often and 00/100 dollars, lawful
money of the United States, paid by the party of the second part, does hereby grant and release
Ullto the party of the second part, the heirs or successors and assigns of the party of the second
part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon
erected, situate, lying and being in the Town of Southold at Cutchogue, County of Suffolk and
the State of New York which is more fully described on the attached Schedule k
Being and intended to be the same premises described in a deed dated July 10,2000 and
recorded in Liber 1205:page 739 in the Suffolk County Clerk's Office, and in a deed dated
Nc,veml;>er 2912001 and recorded in Liber 12155 page 934 in the Suffolk County
CJ.erk s Off ce.
However, this transfer is subiect to a reservation of the appurtenances and all the estate and
ri!!hts of the party of the first part in and to the premises durin!! the lifetime of the party of
the first part,
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any
streets and roads abutting the above described premises to the center lines thereof,
TOGETHER with the appurtenances and all the estate and rights of the party of the first part in
and to said premises,
TO HA VE AND TO HOLD the premises herein granted unto the party of the second part, the
heirs or successors and assigns of the party of the second part forever.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the
party of the first part will receive the consideration for this conveyance and will hold the right to
receive such consideration as a trust fund to be applied first for the purpose of paying the costs of
the improvement and will apply the same first to the payment of the cost of the improvement
b<:fore using any part ofthe total ofthe same for any other purpose.
AND the party of the first part covenants and warrants as follows:
DESCRIPTION
ALL that certain plot, piece or pan:el of land, with the buildings and improvements thereon
erected, situate, lying and being at Cutchogue, Town of South old, Suffolk County, New York,
being known and designated as Lot No. EIGHT (8) and the northerly seven (7) feet of Lot No.
SEVEN (7) on the "Map of Eugene Heights, owned by Jacob F. Bowers, situate at Cutchogue,
New York", filed as Map No. 856 on October 29, 1928.in the Suffolk County Clerk's Office,
being more particularly described as follows:
~\ BEGINNING at a point on the southeasterly line of Oak Street distant 160.55 feet as measured
along the southeasterly line of Oak Street from the corner formed by the intersection of the north-
easterly line of Harbor Lane and the southeasterly line of Oak Street; running thence South 660
50' 00" East on a line seven (7) feet south and parallel with the northerly line of Lot No. SEVEN
(7) on Map No. 856,230 feet, more or less, to the high water line of Eugene's Creek as shown on
said Map; running thence along said high water line North 830 59' 30" East 14.36 feet to the
northeasterly corner of Lot No. SEVEN (7) on said Map; and running thence still along said high
water line of Eugene's Creek as shown on said Map to the northeasterly corner of Lot No.
EIGHT (8) on said Map; thence North 720 31' 30" West along the northerly line of Lot No.
EIGHT (8) 255 feet, more or less, to the southeasterly line of Oak Street; running thence South
43008' 30" West along said southeasterly line of Oak Street 30.49 feet to the point or place of
BEGINNING.
