ACTION OF THE ZONING BOARD OF APPEALS OF TOWN OF SOUTHOLD

at a meeting of the Zoning Board of Appeals on Thursday, July 21, 1960 the appeal
was considered and the action indicated below was taken on your
( ) Request for variance due to lack of access to property
(X ) Request for o special exception under the Zoning Ordinance
( ) Request for a variance to the Zoning Ordinance
1. SPECIAL EXCEPTION. By resolution of the Board it was determined that a special exception
(X ) be granted ( ) be denied pursuant to Article.....I:=.=... Section .......300, Subsection ......11.....
paragraph ................ of the Zoning Ordinance, and the decision of the Building Inspector (X )
be reversed ( ) be confirmed because the Board finds that the public convenience
and welfare and justice will be served and the legally established or
permitted use of neighborhood property and adjacent use districts
would not be substantially or permanently injured and the spirit of
the Ordinance would be observed, therefore be it RESOLVED that this
application be granted, permitting the erection of a 6 ft. 6 in. by
12 ft. 6 in. directional sign, total area of which shall be no greater
than 50 sq, ft., upper edge to be no higher than 15 £t. 6 in. and 3 ft.
above the ground level. Location of sign: From a point 63 ft_ in a
westerly direction from the drainage culvert (drainage of Silver Swamp
to Peconic Bay under the new section of State highway), thence in a
southerly direction to the property of Nassau Brick Company, said
sign tobe installed no less than 5 ft. in from the northerly property
line of Nassau Brick Company, south side Main Road, Greenport, New York.

2. VARIANCE. By resolution of the Board it was determined that

Inspector.

or areas, and giving a detailed description of layout of property must be drawn on the diagram which is part of this location.
c. The work co\'ered by this application may not be eam menced before issuance of Building Permit.
d. Upon opprovaI of this application, the Building Inspector will issue a Building Permit to the applicant. Such
permit shall be kept on the premises available for inspection throughout the progress of the work.
e. No building shall be occupied or used in whole or in part for any purpose whatever until a Certificate of Occupancy
shall have been granted by the Building Inspector.

Gentlemen:
The Town of Southold Zoning Ordinance states that everyone
is entitled to substantial justiee. In issuing a permit to erect e. sign,
the Board of Appeals omitted the word "Resort" from their notice of
permi8sion to erect a sign, after they agreed to leave it in at the
meeting, Thursday, July 21st, 1930 at 7: 50 P. M. (A ,n act of pretended
legislation) The word, resort, is part of the direction, inasmuch as
it designates the type of place it is. l'1e are primarily interested in
people on their vacation, we are not open all year, do not cater to
business people or have commercial. rates. If the Board insists upon
this action, they will be depriving us of equal right under the law.
Article 14 of the Constitution of the United States states: "Nor deQy
to any person within its jurisdiction, the equal protection of the laws."
The Board of Appeals has approved m8Qy signs in this area .lith the word
"Resort" also auto club emblems (resort approved. motel) which is unfair
competition for the reason tha.t if an owner has the most beautiful place
on the bey, and he has less than ten units, he cannot belong.
If you deprive us of the right to use the word "Resort" you
",ill be depriving us of equal protection under the law.
Mr. Rosenberg emphasized repeatedly at the meeting of July 21st,
that we .!ouldn't want more than aQyone else but s.fter we left the lMeting,
the Board arranged to give us2.1ess.

Gentlemen:
Pursuant to the provisions of the Zoning
Ordinance of the Town of Southold and the Town Law
of, the State of New York, the undersigned, as resi-
dents of the Town of Southold and authorized repre-
sentatives of all the members of the North Shore Resort
Association, hereby file this letter in opposition to
the present application of Albert and Veronica Frohne
for permission to erect a directional sign.
Since all the members of this Association,
and others, have complied with all the provisions of
the Zoning Ordinance of Southold Town we believe this
application should not be granted while one, or both,
of the present applicants has an existing v101ation
upon their own property.
We believe the granting of this application
under such circumstances would, in itself, be inequit-
able, a violation of the spirit of this Ordinance, and
lead to a general breakdown of its enforcement.
