A full refund ($400) in the above-noted file reference is recommended for the reason that
the applicant decided to re-submit under a different application to all the Departments
involved, after creating a new lot based on a 1979 approval, and their desire to change the
status of one parcel into two separate building parcels.

The existing single familv dwelling notes an existing single side vard setback of 11 ,5 feet. That setback will be
maintained with the orooosed second stOry addition. Pursuant to the ZBA's interpretation in Walz (#5309), such
additions and alterations will thus constitute an increase in the degree of non-conformance.
Pursuant to Article XXIII Section 280-114. which states.

Eve Seber and Carlo Voelker are proposing to construct a second 1100r addition to an existing
single story residence. The design of the existing building is a 1970's style, wedge-shaped structure that
creates a number of construction issues when attempting to remodel it. (Please see construction plans.)
The Bulk schedule requires a side yard setback of 15'. The existing garage is lIS from the east
side yard, and the existing deck is 8.5' from the same side yard. However, as this deck was cOl)structed to
accommodate the unusual wedge-shape of the house, it leaves little or no room for reasonable or aesthetic
deck design. The ultimate intention is to increase the rear deck so as to provide an area that is adequate
enough to enjoy the rear of the property.
Our proposed house ddlll"gn would square-off the foundation and house (please see drawings # I
and #2). As illustrated on these drawings, the proposed deck would be squared to the new house and
would, consequently, provide the appropriate sized space and the improved aesthetic we areattemJll!ng to
achieve. However, by squaring the deck to the new house orientation, the side yar4 setback (o,the deck is
further reduced to from 8.5' to 6,6'.
Pursuant to Article XXIII, Section 280-114, we are requesting an 8.4' side yard setback reliefto
accommodate our proposed deck and our proposed second 1100r addition to the existing residence.
The Southold ToWII Trustees held a public meeting regarding our proposal and subsequently
approved it by issuing Permit #6805. The DEC is currently reviewing the same propl)sa!.

The proposed house and deck design is infmitely more suitable to the character of the neighborhood than the existing structure.
The existing structure is outdated and has no similarities to any other building in the area.
(2) The benefit sought by the applicant CANNOT be achieved by some other method feasiblc for thc applicant to
pursue, other than an area variance, because:
It would compromise the design of the structure which has been carefully crafted to increase the benefits to the neighborhood
character and the physical environment.

The existing setback distance of the deck is 8.5' from the east side yard. We are requesting an additional relief of 1.9', or 12%
