Location of Property: 945 East Gillette View Drive, East Maripn
SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in
this application and determines that this review falls under the Type II category of the State's List of
Actions, without further steps under SEQRA.
CTM 38-3-2
PROPERTY FACTS: The applicant's property consists of 13,277 square feet and is shown as Lot 56 on
the Map of Marion Manor, filed March 18, 1958 with the Suffolk County Clerk. The property has 100 feet
along Gillette Drive, lot depth of 134.05 along the southerly side property line, 100 feet along East
Gillette Drive, and 131.49 feet along the northerly side property line.
BASIS OF APPLICATION Request for Variances under Sections 280-15 and 280-124, based on the
Building Inspector's March 17, 2008 amended Notice of Disapproval concerning a proposed new dwelling
and accessory shed structure for the following: (a) the new construction will exceed the code limitation of
20% for lot coverage; (b) the new dwelling is proposed at less than 35 feet from the front yard lot line;
(c) the proposed shed will be in a side yard rather than a rear yard.
ZONING CHAPTER 280 OF TOWN CODE (formerly Chapter 100): Zoning Code Section 280-124, which
states that non-conforming lots measuring less than 20,000 square feet in total size require a minimum
front yard setback of 25 feet and maximum lot coverage of 20 per cent. Also Zoning Code Section 280-15
which states that accessory buildings shall be located in a rear yard.
FINDINGS OF FACT
The Zoning Board of Appeals held a public hearing on this application on April 24, 2008, at which time
written and oral evidence were presented. Based upon all testimony, documentation, personal inspection
of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant:
AREA VARIANCE RELIEF (Orie:inal Reauest): This is a request for variances pertaining to the
proposed front yard setback of a new dwelling, proposed lot coverage by building area greater than 20%,
and the proposed location of a shed. The original proposal shown on the March 11, 2008 surveyor map
prepared by John T. Metzger, the new single- family dwelling was planned in a location 25 feet from the
westerly front lot line adjacent to Gillette Drive instead of the code-required 35 feet, and proposing to
locate an accessory 8 ft. by 10 ft. shed in the northerly side yard. In addition, a total lot coverage was
requested at 24.5 per cent for all building area, instead of the code limitation of 20% (maximum).

AMENDED AREA VARIANCE RELIEF: During the April 24, 2008 hearing, the applicant was asked to
bring the plan into more conformity with the code. During the hearing there were objections raised by the
closest resident with concerns regarding the setbacks of the proposed home in relation to their home
immediately adjacent on the south side, and asked the Board to consider increasing the side yard on the
southerly side to 15 feet instead of 10 feet. The applicant stated he would relocate the shed on the north
side of the house at a minimum of 10 feet from the side line which would permit the southerly side
setback to be increased another five feet (from 10 feet to 15 feet), and agreed to submit alternative
diagram(s). On May 1, 2008, the applicant submitted the following site maps as alternatives regarding
the front yard setback, and a shed at +/- 10 feet from the northerly side, as well as increasing the
southerly side yard setback from 10 to 15 feet:
(1) surveyor site map dated April 29, 2008 increasing the westerly front yard setback for more
conformity, from 25 feet to 30 feet, reducing the easterly front yard setback from the code-required
35 feet to 31 feet; and lot coverage total at 24.5% (maximum);
(2) another option shown on a surveyor site plan dated May 1, 2008 which would increase the
westerly front yard from 25 feet to 26 feet while maintaining a conforming 36 feet from the
easterly front yard, and a lot coverage total at 24.5% (maximum).
REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and
personal inspections, the Board makes the following findings:
1. Town Law &267-b(3)(b)(3)(l). Grant of alternative relief will not produce an undesirable change in the
character of the neighborhood or a detriment to nearby properties. The majority of the lots in this
development contains one-quarter acre in size and many have required variances related to the
construction of a single-family dwelling. The northerly adjacent lot is vacant, and the southerly lot is
improved with a single-family dwelling. Variance requests are common in this residential development of
approximately 59 nonconforming lots containing an area of less than 30% and located in an R40 Zone
District. Lots containing a larger lot size do not commonly require lot coverage variances, and
approximately 13 lots in the immediate area are larger than this property. An estimated 85 percent of
the entire subdivision is improved with single-family dwellings. This property, like numerous other lots
in the immediate area, has two code-defined front yards and two side yards, without possibility of a code-
defined rear yard. The lot has frontage on two streets (one at each end of the property), rather than one
street for the remainder of the development. The applicant also is increasing the code-permitted side
yard from 10 feet to 15 feet for greater conformity with the code and to address the concerns raised by the
adjacent resident-landowner most affected on the lot line between the two properties.
2. Town Law &267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method,
feasible for the applicant to pursue, other than an area variance. The proposed modular home is not able
to be re-designed or cut in size, which results in little to gain in the area of setbacks from specific areas.
3. Town Law &267-b(3)(b)(3). The variances requested herein are substantial, and are the maximum the
Board will approve.
4. Town Law &267-b(3)(b)(5). The difficulty has been self created inasmuch as the applicant is choosing
a modular home.
5. Town Law &267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this

residential community will have an adverse impact on the physical or environmental conditions in the
neighborhood.
Grant of the alternative relief requested is the minimum action necessary and adequate to enable the
applicant to enjoy the benefit of his property, while preserving and protecting the character of the
neighborhood and the health, safety and welfare of the community.
RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test
under New York Town Law 267-B, motion was offered by Member Weisman, seconded by Chairman
Goehringer, to
DENY the application shown on the original plan dated March 11, 2008, and to
GRANT Alternative Relief as shown on the surveyor site map revised April 29, 2008 by John T.
Metzger, Land Surveyor, Peconic Surveyors, P.C.
Any deviation from the variance given such as extensions, or demolitions which are not shown on the
applicant's diagrams or survey site maps, are not authorized under this application when involving
nonconformities under the zoning code. This action does not authorize or condone any current or future
use, setback or other feature of the subject property that may violate the Zoning Code, other than such
uses, setbacks and other features as are expressly addressed in this action.
The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration
that does not increase the degree of nonconformity.

AREA VARIANCE REASONS:
(I) An undesirable change will not he produced in the CHARACTER of the neighborhood or a
detriment to nearhy properties if granted, because: The rauch-style home that we are proposing will
blend into the neighorhood which is composed orranches, capes and colonials. The exterior will be clap-
board and shingle similiar to the majority of homes in the area and in East Marion in general. It's size
and low profile will be in keeping with the existing neighborhood. This ranch style home will be lower
and smaller in square footage than the colonial style homes immediately abntting it.
(2) The benefit sought by the applicant CANNOT be achieved by some method feasible for tbe
applicant to pursue, other thau an area variance, because: The proposed new borne has been designed as
a retirement home with all living space on one floor for the ease of living and enjoyment for seniors.
(3) The amount of relief requested is not substantial because: The living quarters of the proposed
home will have a 44' setback and only a portion of , the garage (10 ft.) will encrouch upon the 35' front yard
set back.
(4) The variance will NOT have an adverse effect or impact on the physical or environmental conditions
in the neighborhood or district because: The relatively small size ofthe parcel, similiar to others in the
subdivision makes it difficult to build a ranch style home. In fact, Cape Cod style homes in the neighbor-
hood have additions to side and rear yards, giving them in some instances, a larger footprint than our
proposed home.

To the Chainnan and Members of the Zoning Board of Appeals:
Enclosed please find two amended surveys for our property at 945
Gillette Drive in East Marion.
At the public meeting on April 27, 2008, my neighbor to the South,
Mr. Robert Vitelli expressed concerns ofthe size of the house and proximity
to his property line. I spoke with him after the meeting at Town Hall and
again at his home in East Marion. We agreed to move my house five feet to
the north, leaving a fifteen foot side yard thus improving Mr. Vitelli's sight
range from his porch looking north, which had been his major objection.
We also discussed plantings and screening and Mr. Vitelli expressed that he
would like the side yard to be left open and that if the need arose in the
future we would discuss planting or screening at that time.
The two surveys show the front setback at twenty-six feet and thirty
feet, the preferred plan would be the one with the twenty-six foot setback,
Using the thirty foot setback, while not objectionable to me, would decrease
my rear yard setback and impact the three neighbors along East Gillette, The
difference of the four feet in the front is minimal in limiting my neighbors
view as compared to the view of the three neighbors from their front
windows who face the rear of my house,
Thank you for your careful consideration and courtesy which has
made this experience, which sometimes can be very stressful to a
homeowner, like myself, much less so,

Dear Sir or Madam:
Please find enclosed a copy of the Legal Notice describing your recent application. The Notice
will be published in the next issue of the Times Review newspaper.
1 ) Before April th :
Please send the enclosed Legal Notice, with both a Cover Letter including your telephone
number and a copy of your Surveyor Site Plan (filed with this application) which shows the
new conStruction' area or other request, by CERTIFIED MAIL, 'RETURN RECEIPT
REQUESTED, to .ill! owners of property (tax map with property numbeirs enclosed), vacant or
improved, which abuts and any property which is across from any public or private street.
Use the current owner name and addresses shown on the assessment rolls maintained by the
Town Assessors' Office located at South old Town Hall, or Real Property Office at the County
Center, Riverhead. If you know of another address for a neighbor, you may want to send the
notice to that address as well. If any letter is returned to YOU undeliverable, YOU are requested
to make other attempts to obtain a mailinq address or to deliver the letter to the current owner,
to the best of vour ability, and to confirm how arranqements were made in either a written
statement, or durinq the hearinq, providinq the returned letter to us as soon as possible:
AND not later than April 8th: Please either rnail or deliver to our office your Affidavit of Mailinq
(form enclosed) with parcel numbers, names and addresses noted, and furnish it to our
office with the white receipts postmarked by the Post Office. When the green signature cards
are returned to you by the Post Office, please mail or deliver them to us before the scheduled
hearing. If any signature card is not returned, please advise the Board during the hearing and
provide the card (when available). These will be kept in the permanent record as proof of all
Notices.
2) Not Later April 14th: please make arrangements to place the enclosed Poster on a
