WITNESSETH, that the party of the first part, in consideration of ten dollars and other valuable consideration
paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs
or successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate,
lying and being;/jKWli: at Mattituck, in the Town of Southold, County of Suffolk,
and State of New York, being more particularly bounded and described
as follows: BEGINNING at a monument on the Southerly side of a 50 foot
right-of~way at the Northeast corner of the premises herein described
adjouning land formerly of Klapper later of Hazel S. Smith, on the East;
running thence along said land formely of Klapper; later of Smith South
2040' 10" East 630.0 feet to the ordinary high water mark. <Df- Great
Peconi.c Bay: running thence Westerly; along, ordinary high water mark of
Great Pecond.c Bay on a tie line South 77053' 40" West 68.14 feet to land
now or formerly of Arthur and Emily Loweth: running thence along said
land now or formerly of Ji..oweth North 2013' 10" West 645.0 feet to a
monument on the Southerly side of a 50 foot right-of-way, at a point
149 feet Easterlyfrom the Easterly line of the 25 foot right-of-way
hereinafter referred to; running thence along the Southerly side of said
50 foot right-of-way South 8CJ'> 09' 00" East 62.26 feet to the monument
and place of the BEGINNING.
TOGETHER;with a right-of-way over said 50 foot right of way from the
premises to a 25 foot right-of-way running Southerly from New Suffolk
Avenue, and together with a right-of-way over said 25 foot right-of-way
extending Southerly from New Suffolk Avenue for acess between said
premises and New Suffolk Avenue, a public highway.
BEING'.AND INTENDED TO BE the saine premises as conveyed to George H.
Terry by three deeds, one from the widow and heirs of George B. Reeve,
dated June 2, 1922 and recorded September 1, 1922 in Liber 1051 cp 182
for the centralportionaf the'premises, the second from Richard
Downing and wifw dated March 7, 1925 and recorded March 20~ 1925 ~n
Liber 1129 cp 237 for the easterly portion of the premises, and the
third from Ernest Johrens and wife, dated October 1, 1926 and recorded
December 30, 1926 in Liber 1245 cp 207, which premises were acquired
by Florence E ,Terry, as devisee under the Will of her husband, George
H. Terry, who died a resident of Suffolk County on Septemoer 22, 1956.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads
abutting the above dC5Cribed premises to the center lines thereof; TOGETHER with the appurtenances and all the
estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the premises
herein granted unto the party of the second part, the heirs or successors and assigns of the party of the second part
forever.
AND the parly" of!!!e first part, in compliance with Section 13 of the Lien Law, covenants that the party of the
first part will re(:~j\'e the consideration for this conveyance and will hold the right to receive such consideration as
a trust fund to be' applied first for the purpose of paying the cost of the improvement and will apply the same first
to the payment of the cost of the improvement before using any part of the total of the same for any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
