Therefore, the ROW must be modified and relocated so that a 30-foot buffer around the freshwater wetlands can be replanted in accordance with NYSDEC requirements. This proposal reduces the width of the ROW from 50 feet to 25.31 feet (except for proposed turn-around) and creates a common driveway across Lot 3 to Lot 4 in order to accommodate the required buffer area and provide access for Lot 4 to the ROW and out to Albertson Lane. Finally, the proposed lot line changes increase the area of all 4 lots, making lots I, 2 and 3 more conforming. The existing and proposed area of Lot 4 conforms to present R-80 code requirements. Copy of NYSDEC letter dated 10/21/205 is attached. Mr. Trezza and I agreed that the best course of action is to submit an application for Re- Subdivision (Lot Line Modifications) to the Southold Town Planning Board in which you propose to reduce the width of the now proposed right-of-way from 50 to 25 feet. This will increase the size of all four lots. This right-of-way should terminate in a T-shaped turnaround (see attached sketch), at least 30 feet from the DEC designated freshwater wetlands that are presently depicted as "saltwater" as flagged by Robert Fox on 7/5/04, on John Ehlers' map. Access to Lot 4 is proposed by way of a common driveway of 15 feet in width across Lot 3 to Lot 4, keeping in mind the DEC requirement of the 30-foot buffer from all freshwater wetlands. Prior to making application to the Planning Board, please contact John Ehlers to make the necessary changes to the map as described above. As we discussed, I will send Mr. Ehlers and Mr. Trezza copies of this letter, since we all want to be on the same page regarding the proposed changes and map requirements. SO-20) located on the east side of the property. The survey must be revised to have the freshwater wetland boundary properly labeled. The wetlahds on the south of the property are New York State regulated tidal wetlands. The survey depicts a proposed right-of-way through the freshwater wetland. Please be advised that no future structures or disturbance will be permitted in or through the wetland and the naturally vegetated adjacent area; therefore, the Department will require that a 30 ft. buffer around the freshwater wetland be replanted. Accordingly, the applicant may want to consider modifying the location of the right-of-way and allow for the required buffer area. Also, please keep in mind that once the revised survey is received, a tidal wetlands review will commence and it is likely that, if the proposal is approvable, a buffer area landward of the tidal wetland boundary will be required. Processing will resume upon receipt of 5 copies of a revised survey with the above revision(s) noted thereon. In the interim, the application and supporting materials have been forwarded to the Office of Parks, Recreation and Historical Preservation (OPRHP) for review as to impacts, if any, to archeological resources.
