Sachs : Based on the information you have submitted, the New York State Department of Environmental Conservation has determined that : The property landward of the "Top of Slope" line greater than 10 ' elevation NGVD, as shown on the survey prepared by Joseph Ingegno last revised 8/27/01 , is beyond Article 25 (Tidal Wetland) jurisdiction. Therefore, in accordance with the current Tidal Wetlands Land Use Regulations ( 6NYCRR Part 661) no permit is required under the Tidal Wetlands Act . Please be advised, however, that no constructionk sedimentation, or disturbance of any kind may take place seaward of the tidal wetlands jurisdictional boundary, as indicated above, without a permit . A double row of staked hay bales and a silt fence must be placed down, before any activity begins, at the edge of the clearing limit. Public water supply, although provided by the Suffolk County Water Authority, is determined through the current and projected use of the community.
