Gillisple, Jr., Chairman Robert Bergen Charles Grigonis, Jr. Serge Doyen, Jr. Fred Hulse, Jr. MINUTES SOUTHOLD TOWN BOARD OF APPEALS November 29, 1973 A regular meeting of the Southold Town Board of Appeals was held at 7:30 P.M., Thursday, November 29, 1973, at the Town Office, Main Road, Southold, New York. There were present: Messrs: Robert W. Gillispie, Jr., Chairman; Robert Bergen; Charles Grigonis, Jr.; Fred Hulse, Jr. Absent: Mr. Serge Doyen, Jr. THE CHAIRMAN: The Public Hearing on Appeal No. 1848, Samuel Manarel, Harbor Lane, Cutchogue, New York, was postponed from November 1, 1973 because the applicant had not notarized the application. It concerns an appeal for a variance in accordance with the Zoning Ordinance, Article III, Section 302 for permission to erect accessory building with reduced setbacks. Location of property: Harbor Lane, Cutchogue, bounded north by D. Hommel; east by Harbor Lane; south by J. L. Lyons; west by Dalchet Corp. Fee paid $15.00. The Chairman opened the hearing by reading the appli- cation for a variance, legal notice of hearing, affidavits attesting to its publication in the official newspapers, and notice to the applicant. THE CHAIRMAN: This application is accompanied by a sketch which indicates the accessory building is 20" from the southerly line and 14" from the back line. THE CHAIRMAN: Is there anyone present who wishes to speak for this application? Southold Town Board of Appeals -2- November 29, 1973 (There was no response.) THE CHAIRMAN: Is there anyone present who wishes to speak against this application? (There was no response.) After investigation and inspection the Board finds that applicant requests permission to erect accessory building with reduced setbacks at Harbor Lane, Cutchogue. Applicant states that he has a well and pump which must be covered. The Board agrees with the reasoning of the applicant. The Board finds that strict application of the Ordinance would produce practical difficulties or unnecess- ary hardship; the hardship created is unique and would not be shared by all properties alike in the immediate vicinity of this property and in the same use district; and the variance will not change the character of the neighborhood, and will observe the spirit of the Ordinance. On motion by Mr. Gillispie, seconded by Mr. Bergen, it was RESOLVED, Samuel Manarel, Harbor Lane, Cutcho~ue, New York, be GRANTED permission to erect accessory building with reduced setbacks subject to the following condition: That if the Board of Appeals should find it necessary at some future time to require that the accessory building be located a greater distance from the rear yard line or side ya~ line (or both) than is presently approved for this building, the Board shall have the power to make such an adjustment Vote of the Board: Hulse, Grigonis. Location of property: Lot 9L, Shore Acres, North Drive, Mattituck. Fee paid $15.00. Southold Town Board of Appeals -3- November 29, 1973 THE CHAIRMAN: The application is accompanied by a survey indicating that Plot ~ L to which applicant refers has a house on it. The northerly dimension is approximately 590 feet to the filled area with an additional area of 35 feet of filled area. The southerly dimension is approximately 566 feet plus 75 feet of filled area. Plot ~ L-2, as proposed, has a house and garage on it; ~ L-1 is vacant and will consist of 320 feet on the southerly dimension and 315 feet on the northerly dimension with approximately 90 feet in width. THE CHAIRMAN: Is there anyone present who wishes to speak for this application? MR. WILLIAM BOURGUIGNON: I was told that this whole property here was my front lawn, and there is not much I can do with a front lawn of that size. It has ~trees on it, there are 150 trees. I don't intend to improve the land other than to put a house up on the proposed Plot L-t. I have five children, the oldest of whom is in college. I would like to provide a home for my children's ownership. THE CHAIRMAN: I think you should decide where you want the access. We can describe it in the action. MR. BOURGUIGNON: I would prefer to put the access on this side (referring to map) because it's the lower side. I will make a 15 foot access along the northerly line. THE CHAIRMAN: Many of the surrounding prDperties are similar or lesser in size than the proposed division of Plot ~ L. Are there any questions? THE CHAIRMAN: Is there anyone present who wishes to speak against this application? (There was no ~response.) After investigation and inspection the Board finds that applicant requests permission to divide property into two lots, Lot ~ L, Shore Acres, Mattituck. The findings of the Board are that the surrounding area consists of plots of similar or lesser size than the proposed division of property of the applicant. The Board agrees with the reasoning of the applicant. On motion by Mr. Gillispie, seconded by Mr. Grigonis, it was RESOLVED, William Bourguignon, 500 North Drive, Mattituck, be GRANTED permission to divide property into two lots, Lot ~ L, Shore Acres, North Drive, Mattituck, as applied for, subject to the following condition: That access be provided to Plot 9 L-2 consisting of 15 feet in width adjacent to the northerly border of Plot 9 L-l; and that the property shall be divided as requested by the applicant. Vote of the Board: Ayes:- Messrs: Gillispie, Bergen, Hulse, Grigonls. PUBLIC HEARING: Appeal No. 1853 8:15 P.M. (E.S.T.), upon application of Laury Ford, 243 West End Avenue, New York, for a variance in accordance with the Zoning Ordinance, Article III, Section 100-31 and Bulk Schedule for per- mission to divide log with less than required width and area. Location of property: Private Road off east side of Westphalia Road, Mattituck, bounded north by Mattituck Creek; east by J. Rakowski; south by Private Road; west by Robert J. Munch. Fee paid $15.00. THE CHAIRMAN~ The application is accompanied by a survey of Van Tuyl showing the surrounding area and indicating that the premises are situated on a right of way coming in from Westphalia Road. The property is approximately 52,000 sq. ft. in size on Darby's Branch of Mattituck Creek. Southold Town Board of Appeals -5- November 29, 1973 THE CHAIRMAN: Is there anyone present who wishes to speak for this application? IRVING L. PRICE, JR., ESQ.: I have nothing to add except that I am disappointed that the map doesn't show it as well as the map that is not a part of the record, which shows that they would have a frontage of 130 feet. THE CHAIRMAN: It shows the size of the lots in the vicinity which would be important to us. The proposed property is approximately 360 feet on Darby's Creek. The westerly end is 170' +; the depth of the easterly end is 220'+ on a considerable angle to the right of way. The westerly lot of 25,000 sq. ft. would have 130' on the right of way; and the easterly lot, in two courses, would provide about 130' on the right of way and would have a total of approximately 27,000 sq. ft. This proposal probably will have to go to the Planning Commission because of its being on Darby's Creek. THE CHAIRMAN: Are there any other questions? (There was no response.) Is there anyone present who wishes to speak against this application? MRS. MARY HAWKINS: I live opposite this property, and my neighbors Avignon and Ratti live in the Bronx and have sent Special Delivery letters. There are about five houses on the right of way and that subdivision would add more. The road is not wide enough. One family has two cars and another has three cars. THE CHAIRMAN: There are no houses on this property at the present time. You have enjoyed the benefit of less traffic than would normally be developed. MRS. HAWKINS: It's an unpaved road. It's 30 feet and narrows down to 20 feet. MR. PRICE: The right of way has been there for years. THE CHAIRMAN: Does anyone else wish to speak against this application? (There was no response.) Southold Town Board of Appeals -6- November 29, 1973 MR. PRICE: I would like to make certain observations. Let the record show that these properties in question are shown on a Map of Roderick Van Tuyl dated October 30, 1973, and my observation is that the size of the lots of Avignon and Ratti , as shown, are approximately the same size as lots that are requested in this application. R. Hawkins has a lot in the same area and has access to their property directly from Westphalia Road. THE CHAIRMAN: I believe this will have to go to the Planning Commission because it is on water, and it will also have to go to the Department of Environmental Control. MRS. M. HARRIS: As I recall, this is quite close to Westphalia Road so it would not bring in much traffic. THE CHAIRMAN: I think the point this lady was making was that it would add another car or two. THE CHAIRMAN: Are there any other questions? (There was no response.) After investigation and inspection the Board finds that applicant requests permission to divide lot with less than required width and area on Private Road off east side of Westphalia Road, Mattituck. The Board finds that applicant is possessed of a piece of property that is larger than most of the adjoining properties. This is a reasonable division of property based on an analysis of the surrounding area. The Board finds that strict application of the Ordinance would produce practical difficulties or unnecessary hardship; the hardship created is unique and would not be shared by all properties alike in the immediate vicinity of this property and in the same use district; and the variance Will not change the character of the neighborhood, and will observe the spirit of the Ordinance. On.motion by Mr. Bergen, seconded by Mr. Hulse, it was RESOLVED, Laury Ford, 243 West End Avenue, New York, be GRANTED permission to divide lot with less than required width and area on Private Road off east side of Westphalia Road, Mattituck, as applied for. Southold Town Board of Appeals -7- NoVember 29, 1973 For the Record: Irving Price, Esq. submitted a survey of property of LaurY Ford dated September 13, (Survey prepared by Roderick Van Tuyl). 1973~ PUBLIC HEARING: Appeal No. 1854 - 8:30 P.M. (E.S.T.), upon application of Louis Getoff, Waterview Drive, Southold, for a variance in accordance with the Zoning Ordinance, Article III, Section 100-32 for permission to erect a bus shelter in front yard area. Location of property: north- east side of Waterview Drive, Southold, bounded north by Goose Creek; east by Harrontine & others; south by Cedar Avenue & others; west by Waterview Drive, Wilkinson & others. Fee paid $15.00. The Chairman opened the hearing by reading the application for a variance, legal notice of hearing, affidavits attesting to its publication in the official newspapers, and notice to the a-plicant. The Chairman read letter received from Mr. Getoff, dated November 7, 1973, as follows: "I am in Manhattan Thursday nights working with patients and so cannot appear before you in person. I began construction of a small (7' square, roof height slopes from 3' to 7') shelter for my daughters to wait under for their school bus in bad weather. I did not apply for a permit because I mistakenly thought that this small, non-permanent, structure did not require it. I do not reard where I'm building it as my front yard as my front yard is about 400 feet back near the house. I respectfully request that you grant me psrmission to finish the shelter so my children can be out of.the rain, snow, and wind while waiting for the school bus. The house is about 400 feet back up our driveway with intervening woods, and out of sight of where the bus stops. (We live on a 7 and 1/2 acre piece of land). My neighbor's children (Gonzalez) will be able to use it also and my other neighbors (Wilson, Wexler, Terrabacchia) hope that you will grant me this variance." Southold Town Board of Appeals -8- November 29, 1973 (Mrs. Getoff discussed sketch with the Board). THE CHAIRMAN: Is there anyone present who wishes to speak for this application? MRS. LOUIS GETOFF: I bought 200 feet of property from Julius Zabowski so I could put my road in. THE CHAIRMAN: Will the shelter be on your property? MRS. GETOFF: Yes. THE CHAIRMAN: Is there anyone present who wishes to speak against this property? MR. ROBERT BERGEN: I don't want to speak against this application but I think the shelter should be placed back further on the property. MRS. GETOFF: It"s back behind our mail boxes. When the bus comes down the hill the children can see it. THE CHAIRMAN: We can't grant permission to put a building on a Town road. The Town owns 50 feet of road there. When a structure like this is granted it should be at least 5 feet from the edge of the property line. That's also for your own protection in case of an accident. MR. BERGEN: There's a marker across the street. THE CHAIRMAN: Mr. Getoff should check his distance from that marker, from the south to the northwest. It should be at least 5 feet fr~am the property line. As your husband has suggested, this is temporary. There are a lot of children in Town who have to walk a quarter of a mile to the Main Road. We are starting something here that we don't want to turn into an avalanche. I believe it should be subject to the Board's rescinding this permission at any time. THE CHAIRMAN: Is there anyone present who wishes to speak against this application? (There was no response.) Southold Town Board of Appeals -9- November 29, 1973 After investigation and inspection the Board finds that applicant requests permission to erect a bus shelter in front yard area of property on the northeast side of Waterview Drive, Southold. The findings of the Board are that applicant resides in a wooded area and his children have a few hundred feet to get to the school bus. The applicant wishes to have the children sheltered from bad weather while waiting for the bus. The Board finds that strict application of the Ordinance would produce practical difficulties or unnecessary hardship; the hardship created is unique and would not be shared by all properties alike in the immediate vicinity of this property and in the same use district; and the variance will not change the character of the neighborhood, and will observe the spirit of the Ordinance. On motion by Mr. Grigonis, seconded by Mr. Hulse, it was RESOLVED, Louis Getoff, Waterview Drive, Southold, be GRANTED permission to erect a bus shelter in front yard area of property located on the northeast side of Waterview Drive, Southold, as applied for, subject to the following conditions: That the shelter be placed at least 5 feet from any property line on the north side of Waterview Drive. It is further understood that this is a temporary permission subject to being rescinded at any time in the future° Vote of the Board: Ayes:- Messrs: Gillispie, Bergen Grigonis, Hulse. PUBLIC HEARING: Appeal No. 1855 8:45 P.M. (E.S.T.), upon application of Stanley Garren, Nakomis Road, Southold, for a variance in accordance with the Zoning Ordinance, Article III, Section 100-31 and Bulk and Parking Schedule for permission to divide lot with less than required area. Location of property: Nakomis Road, Southold, bounded north by Nakomis Road; east by L. W. O. Property Association; south by E. M. Pearson; west by A. H. Van Denheugal. Fee paid $15.00. Southold Town Board of Appeals -10- November 29, 1973 The Chairman opened the hearing by reading tho application for a variance, legal notice of hearing, affidavits attesting to its publication in the official newspapers, and notice to the applicant. THE CHAIRMAN: The application is accompanied by a survey indicating that the applicant is the owner of an irregularly shaped piece of property. THE CHAIRMAN: Is there anyone present who wishes to speak for this application? MR. VAN TAGGERT: My property is adjacent to this property and I am related to Mr. Garren. He asked that I come do~ to answer any questions you might have. THE CHAIRMAN: Is the property about 77,000 sq. ft.? MR. VAN TAGGERT: Yes, that's about right. THE CHAIRMAN: One of the lots will be 40,000 sq. ft., and the other will be about 37,000 sq. ft. Will the house be on the lot that is 40,000 sq. ft.? MR. VAN TAGGERT: Yes. THE CHAIRMAN (referring to map): This is defined as a stream. It looks like meadowtand. MR. VAN TAGGERT: It is marshy. I think the intent is to keep it as it appears. THE CHAIRMAN: The property in Laughing Waters which adjoins consists of half acre or less plots so that the lots which Mr. Garren proposes to create are, in effect, twice the size of the lots in Laughing Waters. THE CHAIRMAN: Is there anyone present who wishes to speak against this application? (There was no response.) THE CHAIRMAN: Is he in a hurry ~or this? I am not clear about exactly where the line should be. MR. VAN TAGGERT: Anything the Board entertains would be helpful. I can get the exact dimensions established for you. Southold Town Board of Appeals -11- November 29, 1973 On motion by Mr. Gillispie, seconded by Mr. Bergen, it was RESOLVED that decision on Appeal No. 1855 be postponed until December 20, 1973, at 7:30 P.M. when we have a definite indication of what is proposed. (E.S.T.), upon application of Thomas Muncy, Nassau Point, Cutchogue, for a variance in accordance with the Zoning Ordinance, Article III, Section 100-35 for permission to erect a fence which will exceed permitted height. Location of property: Lot part of 9119 and part of 9120, Nassau Point Club Prop., Inc., Re'Subdivided "B", Bayberry Road, Nassau Point, Cutchogue. Fee paid $15.00. The Chairman opened the hearing by reading the application for a variance, legal notice of hearing, affidavits attesting to its publication in the official newspapers, and notice to the applicant. THE CHAIR~N: The sketch accompanying this application indicates the unusual character of this lot. It's about 50' or 60' on Bayberry Road Extension and extends 450 feet and gradully widens out on the creek. It's 450 feet long and 50 feet wide; it widens out where the house is and narrows down at the creek. The applicant's garage, of necessity, has to be in his legal front yard area. The garage is approximately 210 feet from the Bayberry Road Extension. THE CHAIRMAN: Is there anyone present who wishes to speak for this application? (There was no response). Southold Town Board of Appeals -12- November 29, 1973 THE CHAIRMAN: It seems to be a very good solution particularly in view of the fact that his new neighbor, Nohis, would be happy to have a fence. After investigation and inspection the Board finds that applicant requests permission to erect a fence which will exceed permitted height on Lot part of ~119 and part of 9120, Nassau Point Club Prop. Inc. The findings of the Board are that applicant wishes to furnish a barrier between his home and his ne ighbor's to the north. The neighbor's home is being built at the present time. The Board finds that this is a reasonable request. For all practical purposes the area between the applicant's house and the garage is his rear yard area. Applicant asks permission to extend this fence no further than 15 feet east of the garage, a distance of approximately 195 feet to Bayberry Road. The Board finds that strict application of the Ordinance would produce practical difficulties or unnecessary hardship; the hardship created is unique and would not be shared by all properties alike in the immediate vicinity of this property and in the same use district; and the variance will not change the character of the neighborhood, and will observe the spirit of the Ordinance. (E.S.T.), upon application of Samuel & Kathryn Yasso, 91 Sheridan Avenue, Williston Park, New York for a variance in accordance with the Zoning Ordinance, Article VII, Section 100-71 and Bulk Schedule for permission to erect an addition with reduced side yard. Location of property: Main Road (Rt. 25), Mattituck bounded north by H. Kander; east by L. Lindsay & L. Alger; south by L. Lindsay; west by Main Road. Fee paid $15.00. Southold Town Board of Appeals -13- November 29, 1973 The Chairman opened the hearing by reading the application for a variance, legal notice of hearing, affidavits attesting to its publication in the official newspapers, and notice to the applicant. THE CHAIRMAN: The application is a little bit deceptive in that a 10 foot variance is required. The actual distance from the sideyard will be 15 feet at the closest point of the building. THE CHAIRMAN: Is there anyone present who wishes to speak for this application? MRS. YASSO: (Mrs. Yasso showed sketch to the Board) It widens at one point and narrows down to the back. THE CHAIRMAN: May we have one of these sketches for the record? (Mrs. Yasso presented the Board with a sketch as requested). THE CHAIRMAN: The property is on a State Highway so it will have to go to the Planning Commission. The total area is .254 acre, 90.45 feet on the Main Road, and it's an irregularly shaped lot. It's 200 feet in depth on the easterly dimension, 188.32 feet on the westerly dimension. These two sidelines narrow down at the southerly end of the lot. One of the things we are concerned with is the parking area. Do you have a restaurant there? MRS. YASSO: Yes. THE CHAIRMAN: This is zoned "B-i". (The Chairman read Article VII regarding off-street parking spaces). How many people do you seat in the restaurant? MRS. YASSO: About 25 people. THE CHAIRMAN: I believe the Building Inspector said there is no trouble as far as parking is concerned. What is the purpose of the addition? MRS. YASSO: We want it for a. warehouse, for a beer and soda distributorship. THE CHAIRMAN: Are you going to increase the size of the restaurant? Southold Town Board of Appeals -14- November 29, 1973 MRS. YASSO: It will be an additional store. MR. FRED HULSE: Are you doing away with the restaurant? MRS. YASSO: No. we are leaving that there. THE CHAIRMAN: You are adding another business? MRS. YASSO: Yes. THE CHAIRMAN: Are there any other questions? (There was no response.) THE CHAIRMAN: Does anyone wish to speak against this application? (There was no response.) After investigation and inspection the Board finds that applicant requests permission to erect an addition with reduced side yard on Main Road (Route 25), Mattituck, New York. The findings of the Board are that applicant is the owner of a restaurant on an irregularly shaped lot and wishes to erect an addition to be used as a warehouse. The Board finds that the restaurant will not be expanded and that the addition will be used for warehouse purposes, and not for restaurant purposes, and will not affect the number of parking spaces permitted for restaurant use.~The Board agrees with the reasoning of the applicant. The Board finds that strict application of the Ordinance would produce practical difficulties or unnecessary hardship; the hardship created is unique and would not be shared by all properties alike in the immediate vicinity of this property and in the same use district; and the variance will not change the character of the neighborhood, and will observe the spirit of the Ordinance. On motion by Mr. Berqen, seconded by Mr. Gillispie, it was RESOLVED, Samuel & Kathryn Yasso, 91 Sheridan Avenue, Williston Park, New York, be GRANTED permission to erect an addition with reduced sideyard on Main Road, Route 25, Mattituck, as applied for, subject to the following condition: Southold Town Board of Appeals -15- November 29, 1973 That the addition will be used for warehouse purposes, not for restaurant purposes, and that the restaurant will not be expanded. Location of property: south side of Pine Neck Road, Southold bounded north by Pine Neck Road; east by W. Cain and others; south by Custer Avenue and Acker; west by E. Mailler & W. Deroski. Fee paid $15.00 The Chairman opened~the hearing by reading the applica- tion for a variance, legal notice of hearing, affidavits attesting to its publication in the official newspapers, and notice to the applicant. THE CHAIRMAN: This application is accompanied by a survey. The map was drawn on September 18, 1970 by Van Tuyl. It was a proposed minor subdivision of land but I don't think it ever became a subdivision. Is there anyone present who wishes to speak for this application? MRS. CHRISTENSEN: I think it was subdivided. It had not been put into separate names. Mr. Terry said that that was the crux of the whole thing. THE CHAIRMAN: Would you show me (on the map) what you own. (Mrs. Christensen showed the Board what they had owned and what they had sold and propose to sell). MRS. CHRISTENSEN: We only want to sell Lot No. 2. THE CHAIRMAN: That's about 20,000 sq. ft. MRS. CHRISTENSEN: We gave some part of it to the Town. I don't know whether that has any bearing on it. THE CHAIRMAN: Did you 9o to the Planning Board with this? MRS. CHRISTENSEN: No. Southold Town Board of Appeals -16- November 29, 1973 THE CHAIRMAN: There is the question as to whether this is a minor subdivision or not. MRS. CHRISTENSEN: We were under the impression that it was. THE CHAIRMAN: We will have to postpone decision on this until we find out what the Planning Board did. Their next meeting is December 6th. (Mr. Henry Raynor of the Planning Board came in and he and the Board had a further discussion of the property. Mr. Raynor said that he did not think this minor subdivision had ever been completed.) THE CHAIRMAN: Is there anyone present who wishes to speak against this application? (There was no response.) On motion by Mr. Gillispie, seconded by Mr. Bergen, it was RESOLVED that decision on Appeal No. 1858 be postponed until 7:40 P.M. December 20, 1973. Southold Town Board of Appeals -17- November 29, 1973 On motion by Mr. Grigonis, seconded by Mr. Hulse, it was RESOLVED that the next meeting of the Southold Town Board of Appeals will be held at 7:30 P.M., December 20, 1973, at the Town Office, Main Road, Southold, New York. The Board postponed the signing of the Action on Appeal No. 1849, Pirate's Cove Marine, Inc., Peninsula Road, Fishers Island, New York, until they receive Department of Environmental Conservation approval and Suffolk County Planning Commission approval. On motion by Mr. Hulse, seconded by Mr. Grigonis, it was RESOLVED that the Southold Town Board of Appeals GRANT permission to the Southold Fire Department to put up the usual poster advertising for the Fourth Annual Parade and Tournament to be held on July 6, 1974; rain date July 7, 1974, subject to the condition that the posters will be removed within a week after the tournament is over. Mr. Raymond Terry had an informal conversation with the Board with regard to property located on the corner of Love Lane ~including an octagonal building. He discussed dividing the property and setting off the building. It's in the name of M. A. Kelsey Properties, Inc. He Said that the gentleman who wishes to purchase it is Don Klaus who wants to move his real estate operation into it and restore it to its original beauty. There was a further discussion regarding parking and it was suggested that Mr. Terry find out how many parking spaces would be required and then analyze what the proposed change is and whether it will increase or decrease. 350 sq. ft. is required for each parking space and access. Southold Town Board of Appeals -18- November 29, 1973 Mr. Henry Raynor had an informal discussion with the Board regarding property presently held by Lois Barker.
