Present Were: Don Wilder, Chairman Jack McGreevy, Member Peter Young, Member James Eckert, Member Doug Hardy, Member Glen McNab, Member Jacob Smith, Student Member Scott Worth, Student Member Lauren Standish, Secretary Absent Were: Chris Kempner, Member Bob Ghosio, Trustee CALL TO ORDER Chairman Don Wilder called the meeting to order at 5:30 PM CHAIRMAN'S ANNOUNCEMENTS REPORTS The CAC members shared their comments as a follow-up to the NOAH presentation that was held on Sat., May 10, 2008. The members unanimously agreed that the presentation went well and Peconic Landing did an excellent job. They question what to do next with the information. Doug Hardy cited the public trust doctrine and defined what a rolling easement was. He stated that waterfront property owners should be made aware that their properties would eventually erode. The MHW line is a dynamic line that may move seaward or landward and the property owner needs to accept that. Peter Young questioned where intervention would be made ie. Town, State, Federal? Don Wilder stated that our local laws needed to be reviewed and enforced. Doug Hardy added that all bulkheads that block public access should have walkways to allow for public access. Don Wilder mentioned that East Hampton Town has banned all new docks. GUEST SPEAKER Supervisor Scott Russell attended the meeting and the CAC members shared their comments with him regarding the NOAA presentation and discussed the possibility of future educational workshops. Supervisor Russell asked if there were other areas the council wanted to get involved in and whether they felt their recommendations to the Board of Trustees concerning wetland permit applications were effective. Don Wilder thought their recommendations were effective, such as the requirement of non-turf buffers and drainage. Peter Young agreed but thought that they should restructure. He further commented on docks, and in his opinion, the NOAA presentation provided good scientific information that we should take and compare to our Code, and then get everyone to the table to discuss. Don Wilder suggested public docks at the road ends. Supervisor Russell remarked that bay docks should be almost impossible to get. He suggested the CAC meet with the Town hired consultant to work on code changes. He also mentioned the desperate need for stewardship and management of Town acquired lands. Don Wilder suggested inviting Melissa Spiro to a future CAC meeting. Supervisor Russell also mentioned that Channel 22 was available for educational use. The council members agreed they wanted to continue to review wetland applications but could select two members each month to inspect and the others could work on different projects at the same time. They felt that wetland issues were still very important to them. Supervisor Russell suggested they develop stewardship and management plans and submit them to John Sep. The group needs to decide what their goals are. Don Wilder suggested a worksession to discuss in further detail. OTHER BUSINESS Member James Eckert will attend the next Board of Trustees Regular Meeting to be held of Wed., May 21, 2008 at 6:00 PM. APPROVAL OF MINUTES Moved by Jack McGreevy, seconded by James Eckert, to Approve the Minutes of April 9, 2008. DISCUSSION AND RECOMMENDATION OF WETLAND PERMIT 8~ COASTAL EROSION PERMIT APPLICATIONS Moved by Peter Young, seconded by James Eckert, it was RESOLVED to SUPPORT the Wetland Permit application of LEWIS TOPPER to construct approx. 90 linear ft. of vinyl bulkhead in place of existing timber bulkhead to be removed and backfill with approx. 5 cy. clean sand to be trucked in from an upland source; and does NOT SUPPORT the application to construct approx. 74 linear ft. of low-profile, vinyl groin in place of existing +/-78' timber groin to be removed. Located: 3605 Camp Mineola Rd., Mattituck. SCTM#123-6-12.4 Inspected by: Peter Young, Glen McNab, Scott Worth, Jacob Smith The CAC Supports the application to replace the bulkhead with the Condition drywells and gutters are installed on the dwelling, the pipe is removed from the bulkhead, and a 10' non-turf buffer is installed landward of the bulkhead. The CAC does Not Support the application to replace the jetty and recommends the jetty be left to deteriorate. Vote of Council: Ayes: All Motion Carried Moved by James Eckert, seconded by Don Wilder, it was RESOLVED to SUPPORT the Wetland Permit application of WILLIAM & MARISSA HARNEY to remove the remains of existing dock structure entirely and replace in-place by constructing a 3'X 11' ramp onto a 3'X 30' fixed dock section with a 32"X 12' seasonal aluminum ramp onto a 6'X 20' seasonal floating dock secured by two 6"X 25' anchor pilings. Located: 4015 Main Bayview Rd., Southold. SCTM#78-2-16 Inspected by: James Eckert Vote of Council: Ayes: All Motion Carried Moved by Doug Hardy, seconded by Jack McGreevy, it was RESOLVED to NOT SUPPORT the Wetland Permit and Coastal Erosion Permit applications of STEVEN 8 SEVGI UYANIK to remove partial remains of existing bulkhead. Re-grade existing bank to top of bluff. Construct 88' of new bulkhead in place; 8' return on west end and 16' return on east end. Remove all existing rocks encountered during construction and replace as armoring at base of new bulkhead upon completion. Remove existing platform and stairway to beach. Construct new 10'X 16' upper deck; 10'X 12' lower deck and 3' wide stairways to beach in new location. Provide 10' wide non-turf buffer zone behind new bulkhead. Re-vegetate with Cape American Beachgrass. Install erosion control geometric design nylon matting "Enkamat" 7010 or equal from base of bluff to top of bluff and re-vegetate slope with a combination of Bayberry, Rosa Virginia and Beach Plum plantings. SCTM#44-1-6 Inspected by: Doug Hardy 4 The CAC does Not Support the applications because of the high energy shoreline resulting in serious erosion, the continued hardening of the shoreline will steepen the beach and accelerate erosion down current of less protected bluffs. Vote of Council: Ayes: All Motion Carried Moved by Jack McGreevy, seconded by Doug Hardy it was RESOLVED to NOT SUPPORT the Wetland Permit and Coastal Erosion Permit applications of SOPHIE LATHAM & PRISCILLA JAMIESON to rebuild the existing jetty and repair the existing bulkhead. Located: 2180 Peter's Neck Rd., Orient. SCTM#32-1-6.1 Inspected by: Jack McGreevy The CAC does Not Support the applications because they were incomplete. The CAC recommends additional information is submitted such as the type of materials being used, the length and design of the jetty, and a professional review of the effects of the groin. Vote of Council: Ayes: All Motion Carried Moved by Glen McNab, seconded by Don Wilder, it was RESOLVED to SUPPORT the Wetland Permit application of GARY GUJA to construct a docking facility consisting of a 4'X 16' ramp to a 4'X 58' catwalk, elevated a min. 4' above grade of wetlands, a 3'X 15' ramp and a 6'X 20' floating dock with three (3) secure piles plus one additional 10" round tie-off pile. Located: 372 North Dr., Mattituck. SCTM#106-6-29 Inspected by: Peter Young, Glen McNab The CAC Supports the application with the Condition the dock extends no further seaward than the neighboring docks and open-grate decking is used on the catwalk. Vote of Council: Ayes: All Motion Carried Moved by Jack McGreevy, seconded by Don Wilder, it was RESOLVED to SUPPORT the Wetland Permit application of THOMAS J. APREA, JR. to remove 106' of existing bulkhead, boardwalk and 286 cy. of soil fill from behind existing bulkhead. Truck removed soil off site to an approved upland disposal site. Construct 10' of new bulkhead at rear of basin. Located: 3140 Gardiner's Bay Estates, East Marion. SCTM#37-7-9.1 Inspected by: Jack McGreevy The CAC Supports the application with the Condition the driveway is completely removed or partially replaced with pervious materials to absorb the run-off. Vote of Council: Ayes: All Motion Carried Moved by Glen McNab, seconded by Don Wilder, it was RESOLVED to NOT SUPPORT the Wetland Permit and Coastal Erosion Permit applications of STACY SHEPPARD for the existing 49' jetty. Located: 710 Park Ave. Ext., Mattituck. SCTM#123-8-28.5 Inspected by: Peter Young, Glen McNab The CAC does Not Support the application because the jetty serves no purpose. Vote of Council: Ayes: All Motion Carried Moved by Glen McNab, seconded by Don Wilder, it was RESOLVED to SUPPORT the Wetland Permit application of JOSEPH ZITO to construct a second-story addition and deck onto the existing dwelling, and install new windows and doors. Located: 3600 Deep Hole Dr., Mattituck. SCTM#115-17-8 Inspected by: Peter Young, Glen McNab The CAC Supports the application with the Condition gutters and drywells are installed to contain the roof run-off. The CAC also recommends an engineer's report to determine whether or not the first floor can accommodate the additions. Located: 730 Tarpon Dr., Southold. SCTM#57-1-8 The CAC Tables the application because the plans do not match what exists on the property and requests a clarification. Vote of Council: Ayes: All Motion Carried Moved by Doug Hardy, seconded by Jack McGreevy, it was RESOLVED to NOT SUPPORT the Wetland Permit application of MICHAEL, GARRETT & TRACEY KOKE to place over filter cloth on grade along toe of eroding embankment approx. 175 linear ft. of 25 to 150 Ib. stone rip-rap. Located: 875 Youngs Ave., Southold. SCTM#63-7-31.1 Inspected by: Doug Hardy The CAC does Not Support the application and recommends the area is re-vegetated with native plants, similar to the neighboring property. Vote of Council: Ayes: All Motion Carried Moved by Glen McNab, seconded by Don Wilder, it was RESOLVED to NOT SUPPORT the Wetland Permit application of LORRAINE WENDT to rebuild the as-built docking facility by removing three mooring piles, reducing the width of the fixed dock to 3', and reducing the pilings for the dock to 6"X 6" posts. Located: 980 Deep Hole Dr., Mattituck. KOHN LIVING TRUST to construct +/-164 If. of vinyl bulkhead in place of (and 12" higher than) existing timber bulkhead (including +/-31' of bulkhead/retaining walls forming step-down platform and stairs to be replaced in-place and 12" higher); construct +/-47 If. of vinyl bulkhead on landward side of existing timber bulkhead to be removed; construct +/-16' westerly return; remove and replace existing steps, decking, and walkways adjacent to bulkhead (in-place, except 6'X 55' section of easterly walkway to be reoriented to align with easterly property line); backfill area landward of new bulkheading (including 7'X 14'X 15" concrete step- down to be eliminated) with approx. 20 cy. of clean sand fill to be trucked in from an upland source; and raise existing shed (in-place) approx. 27" onto newly established grade. Vote of Council: Ayes: All Motion Carried Moved by Doug Hardy, seconded by Jack McGreevy, it was RESOLVED to NOT SUPPORT the Wetland Permit application of JUDY TEEVAN 8~ PAULA DIDONATO to replace wood decking around pool, wood deck, wood walkway and wood retaining wall with Bluestone pavers and 8" concrete retaining wall to pool deck level. Located: 325 Willow Point Rd., Southold. SCTM#56-5-26 Inspected by: Doug Hardy The CAC does Not Support the "as-built" work. The CAC recommends a drywell is installed for the pool backwash and the impervious paving is replaced with pervious paving and curbing. Vote of Council: Ayes: All Motion Carried Moved by Jack McGreevy, seconded by James Eckert, it was RESOLVED to SUPPORT the Wetland Permit application of GARDINER'S BAY ESTATES HOMEOWNERS ASSOC. to remove one 4'X 48', two 3'X 14', one 6.2'X 16' existing floating docks and two existing anchor pilings entirely; remove existing 3'X 13.5' wooden ramp; extend existing 3'X 25' fixed dock 10'; reinstall floating docks and pilings that were removed 15' further west and 10' further south than previous; reinstall existing 3'X 13.5' wooden ramp; and install one new 4'X 30', one 4'X 20' floating dock section and one new anchor piling on the east end. Located: Gardiner's Bay Estates. SCTM#37-4-18 Inspected by: Jack McGreevy The CAC Supports the application with the Condition measures are taken to control storm-water run-off. SCTM#87-5-23.6 Inspected by: Jack McGreevy Vote of Council: Ayes: All Motion Carried SPYRO & MARGARITA AVDOULOS to demolish the dwelling including all walls, flooring and chimney, retain full basement and crawl space. Reconstruct dwelling over existing foundation (7.5' original setback and 10' over basement -total 17.5') to chimney. Construct addition landward of existing foundation. Reconstruct foundation on east side and alterations of existing foundation where chimney was located, and install gutters and drywells, as required. Located: 54985 North Rd., Greenport. SCTM#44-1-5 The CAC recommends the bluff is stabilized and a 10' non-turf buffer is maintained landward of the top of the bluff. The CAC has no comment on the proposed dwelling. Moved by James Eckert, seconded by Glen McNab, it was RESOLVED to SUPPORT the Wetland Permit application of VINCENT 8~ EILEEN FLAHERTY to remove the existing stairway to beach and kayak rack. Remove 63' of existing west bulkhead and replace in-place, and does NOT SUPPORT the application to construct 33' of low-profile bulkhead on west end. Located: 177 Inlet Way, Southold. SCTM#92-1-8 Inspected by: James Eckert The CAC does Not Support the proposed 33' low-profile bulkhead on the west end because there was no need shown. Vote of Council: Ayes: All Motion Carried 9 Moved by Glen McNab, seconded by Don Wilder, it was RESOLVED to SUPPORT the Wetland Permit application of 2000 BROADWATERS LLC to construct a 4'X 124' fixed catwalk, a 2.5' X 12' ramp and 6'X 20' floating dock. Located: 2000 Broadwaters Rd., Cutchogue. SCTM#104-9-12 Inspected by: Glen McNab, Peter Young The CAC Supports the application with the Condition open-grate decking is used on the catwalk. SCTM#70-6-29.1 Inspected by: James Eckert Vote of Council: Ayes: All Motion Carried DISCUSSION AND RECOMMENDATIONS OF APPLICATIONS TO AMEND PERMITS Moved by Glen McNab, seconded by Doug Hardy, it was RESOLVED to NOT SUPPORT the amendment application of DON JAYAMAHA to Amend Permit #6437 to construct a fixed open walkway 4'X 70' with decking a min. of 3.5' 10 above vegetated grade, hinged ramp 3'X 20', and floating dock 6'X 20', and install two 6" dia. (nominal) piles to secure the floating dock. Located: 243 Maiden Lane, Mattituck.
