Tlus application must be filled in by typewriter or ink and submitted to the Building Department with the following:
A. For ue", building or new use:
I. Fmal survey of property with accurate location of all buildings, property lines, streets, and unusual natural or
topographic features.
2. Final Approval from Health Dept. of water supply and sewerage-disposal (S-9 fonn).
3. Approval of electrical installation from Board of Fire Underwriters.
4. Swom statement from plumber certifying that the solder used in system contains less than 2/10 of! % lead.
5. Conunercial building, industrial building, multiple residences and similar buildings and installations, a certificate
of Code Compliance from architect or engineer responsible for the building.
6. Submit Planning Board Approval of completed site plan requirements.
B. For existing buildings (prior to April 9, 1957) non-conforming uses, or buildings and "pre-existing" land uses:
' I . Accurate survey of properiy showing all property lines, streets, building and unusual natural or topographic
features.
'2. A properly completed application and consent to inspect signed by the applicant. If a Certificate of Occupancy is
denied, the Building Inspector shall state the reasons therefor in writing to the applicant.

REQUEST MADE BY APPUCANT: This Is a request for a Special exception under Article III.
Section 280-13B of the Southold Town Zoning Code. Applicant/Owners propose to establli1t,~_
a Bed and Breakfast use as an acc:essory use In their home, Incidental to their occupancy
and residence In the existlng slngle-famlly dwelling, with up to four (4) guest rooms for
lodging and servIng of breakfast to not more than ten (10) casual, transient roomers.
PROPERTY DESCRIPTION: The applicant's property consists of 11.31 acres and Is
Improved with a two-story, slngle.famlly dwelling and accessory shed as shown on the
3/13/97 survey prepared by Kenneth H. Beckman, L.C.
FINDINGS OF FACT
The Zoning Board of Appeals held a public hearing on this application on January 25, 2007,
at which time written and oral evidence was presentad. Bued upon all tsstimony,
documentation, personal inspection of the property and the area, and other evidence, the
Zoning Board finds the following facts to be true and relevant.
REASONS FOR BOARD ACTION. DESCRIBED BELOW: Based on the testimony and record
before the Board and parsonallnspectlon, the Board makes the follOWing findings:
1. Russell and Florence Pellicano, the applicants herein, have owned and resided In the
subject property aince obtaining a CO from the Town of Southold on 7/02103. They originally
designed their home wtth the Intention of completing the unfinIshed space over their four.
car attached garage In order to operate a Bed-end-Breakfast facility In the future. They will
continue to occupy the dwalllng as a prlnclpel reaidence wh!le operetlng the proposed B&B
w!IJeh wit! consIst of four Guest rooms (SectIon 280-4 of the code permits no more than 5
With a maximum of 10 casual and transIent roomers). ,The Bed-end-Breakfast use is clearly
s~bordinate to the DrInclpal use of the dwelling. --'.________,,-
2. The Bed-end Breakfast, as applied for, Is reasonable In relation to the District in which it
Is locatad, adjacent use districts, and nearby and adjacent resIdential uses. The applicants'
subject parcel conalate of 11.31 acres In the A.c Agrlcultural.conservatlon Zone District
which affords them more than ample on-site perking for the proposed four guest rooms.
Their dwelling la acc:eased through a long private gravel drive off of North Bayvlew Road.
Other properties that uee the drive are owned by the Pellicano's daughters. The proposed

exterior.
3. This special exception use will not prevent orderly and reasonable uses proposed or
existing in adjacent use districts. The property to the West of the applicant's property is

INSTRUCTIONS
a. This application MUST be completely filled in by typewriter or in ink and submitted to the Building Inspector with 4
sets of plans, accurate plot plan to scale. Fee according to schedule.
b. Plot plan showing location of lot and of buildings on premises, relationship to adjoining premises or public streets or
areas, and waterways.
c. The work covered by this application may not be commenced before issuance of Building Permit.
d. Upon approval of this application, the Building Inspector will issue a Building Permit to the applicant. Such a permit
shall be kept on the premises available for inspection throughout the work.
e. No building shall be occupied or used in whole or in part for any purpose what so ever until the Building Inspector
issues a Certificate of Occupancy.
f. Every building permit shall expire if the work authorized has not commenced within 12 months after the date of
issuance or has not been completed within 18 months from such date. If no zoning amendments or other regulations affecting the
property have been enacted in the interim, the Building Inspector may authorize, in writing, the extension of the permit for an
addition six months. Thereafter, a new permit shall be required.
APPLICATION IS HEREBY MADE to the Building Department for the issuance of a Building Permit pursuant to the
Building Zone Ordinance of the Town of South old, Suffolk County, New York, and other applicable Laws, Ordinances or
