Kiernan (10:30 A.M.), Town Clerk Judith T. Terry. 9:15 A.M. - Photographs were taken of the Supervisor and the Town Board. 10:00 A.M. - Site Selection Committee for the community residence for mentally disabled persons, Francis Burke, Executive Director of The Way Back Inc., Lisa Browning, Social Worker and Program Director for The Way Back Inc., and Terri Segovia, NYS Office of Merital Health, Regional Office, Brentwood, met .with the Town Board. (Site Selection members present: John Sullivan, Jennifer Gould, Barbara Michelsen, Mary Regan, Valerie Cardona.) Town Board advised that they propose two alternative sites for the residence - Main Road, Cutchogue, and North Road, Greenport, and will be adopting a resolution to that effect eno. 24). 11:00 A.M. - Henry Smith, Vice President of the Town Trustees, and Robert Maus, Chairman of the Cedar Beach Park Association Waterways Committee, and other members of the association met with the Board to discuss the need for maintenance dredging in their area. Mr. Smith assured the residents that the Trustees would be supportive of a small scale dredging project, but environmental assessment and vari6us state and federal permits will be required. The Town Board advised that although Town funds may nog be used for private dredging projects, it might be possible for the property owners to form a district, have a bond and be assessed the costs over a number of years. 11:55 A.M. Stephen Angell, member of the Conservation Advisory Council, met with the Town Board to discuss the poster contest the CAC sponsored in the spring, and the CAC's proposal to run three paid ads to' feature the three poster contest winners and information regarding each of the subjects (Don't Feed the Swans"; "Leaking Fuel Oil Tanks"; and "Recycling"). It was agreed that a better method of publicitY would be to invite the poster winners to a Town Board meeting for a presentation of their wards. - 12:10 P.M. - Recess for lunch. 11:45 P.M. - For Discussion Items: (1) Bond. for a November referendum regarding Open Space/Farmland funds will be held for the present time. (2) Covenants and restricts for Southold Villas will be discussed by Town Attorne~ Arnoff and Planner Valerie Scopaz. (3) Youth Board formation proposal by Mary Ann Fleischman.--Jim McMahon was present to discuss this proposal with the Board. (4) Supervisor Harris discussed the poor condition of the Southold Town Dog Pound, and the need to move ahead with the construction of a new building. Garrett Strang, Architect, and representatives of the North Fork Animal Welfare League will be invited to the August 14th work session to review the proposed Plans. Board members~ agreed a bond resolution will be required when the final costs are established. (5) Sale price for the Landmark Preservation Commission's publication "Houses of Southold - The First 350 Years" was discussed, and the Board agreed on $15.00 (see resolution no. 23). (6) Councilman Wickham discussed the proposal for dissolution of the Fishers Island Garbage & Refuse District. (7) Councilman Wickham gav& a brief update on the Waste Management Task Force, and advised that the Solid Waste Management Plan should be available in about three weeks. (8) Letter from a non-resident expressing her disappointment at paying $10.75 for a weekend beach eprmit and then having it rain. (9) Board discussed what the charge should be for emergency dumping of wastewater into the Fishers Island Sewer District system, and _agreed_upon $.05 per gallon (see resolution no. 25). (10) Councilwoman Oliva expressed her con-~:ern at Supervisor HarriS; re-~i~Jc~0~oof the funds to the libraries in Southold Town Supervisor Harris said he had reduced the allocation ,_from $12,500 to $I0,000. Councilwoman Oliva requested the Supervisor to place a -resolution on the agenda (see no. 22) reinstating the funds. Supervisor Harris stated that Tax Pac will not be happy with this as they feel they are being taxed twice for these funds, once when the school budget i~ voted on and once through Town of Southold taxes. Councilwoman Oliva said the funding was placed in the 1990 budget back in October of 1989 and should not be reduced during the libraries' fiscal year as they hadprepared their 1990 budget with these funds included. SUPERVISOR HARRIS: At this time, before we go into resolutions, is there any member of the audience that would like to address any of the resolutions, that we will be dealing with tonight.~ JODY ADAMS: My last name is Adams, first name Jody. I'd like to address two different resolutions. One will make sense, and the other is going to be pushing things a little. The pushing thing is in regard to resolution 6, sending Mr. Lessard here and there. I would like to offer a few comments in regard to Mr. Lessard, his supposed position, and the way he carries it out. I understand that so far my questions about the Day property, and how it has been handled, are not the subject of your special prosecutor. I would like to tell you a little about the way it was handled, and how I see it reflects on the ability of Mr. Lessard. The Day~ converted a barn-garage into a rental upstairs garage apartment, with the express intent also creating rooms for overnight rentals downstairs. This conversion was without any Town permit and scrutiny, was in violation of a varity of zoning and building codes, and for a long time I could get no actions. SUPERVISOR HARRIS: Excuse me, Ms. Adams. Does this pertain to the resolu- tion, "that we're going to pass? JODY ADAMS: If you want to make it so~ It has to do with Mr. Lessard. SUPERVISOR HARRIS: I would suggest is, if this in reference to something other than the actual resolution, that we're acting on, sending him to a Conference, o~mce we have addressed the resolutions, at that time, then we have the public sector, again. JODY ADAMS: I have a separate thing for the public session, since this is the first time I've been here in about four years. The other one is directly involved. SUPERVISOR HARRIS: Normally,the first sectio~ of our meeting, the first part of our meeting, the public session deals strictly with a resolution, that we're going to pass. If you have a comment about a resolution... JODY ADAMS: I have a comment on Mr. Lessard, whether he should be sent away from Town government. Okay? SUPERVISOR HARRIS: That is in reference to whether he goes to a conference or not? JODY ADAMS: It could be. Would Mr. Fisher remove his building inspector? Within violation of a variety of zoning and building codes, for a long time i could get no action. Mr. Fisher, building inspector, Mr. Murphy, Judy Terry, Lessard, Mr. Lark, and myself, all discussed the issue, and eventually citations were served for these violations. I have copies of them. For reasons unknown, they were dismissed with lead to renew. The apartment's rented, the taxes remain 2O JULY 31, 1990 unchanged, procedures were undertaken withou~ public notice in the Town Planning Board with Mr. Lessard present. On the record, the Planning Board seems to arbitrarily legitimize an illegal apartment, bypassing Health Department scrutiny to protect the waterfront, in regard to cesspools and so on, with the supposedly legitimate subdivision approval, the Building Department now claims to want to renew its prosecution with the matter relating to the garage-apartment. This is insane, as are many other things taking place daily because of lack of coordina- tion. I do especially question this, because of the close relationship of James Rich, the politician, to the Day people, as I've said to Mr. Lessard generally. You want every resolution now, all at once? The other one is 24 in regard to the halfway house to be operated by The Way Back, I have serveral things to say. You should compare the alternative to the original choice, and put on your record, your reasons for choosing which ever you choose. If the reason is, as it would seem to be, bowing to the probably ignorance of the community in the Crown Landing area, and viciousness, you are endanger of violating civil rights laws~ especially with the recent passing of the Federal Disability Act. I have viewed superficially the site, and my conclusion is, that with the exception of the size of the house Crown Landing is probably the best choice. It is safe, fairly private, new, attractive and at the present has few neighbors. Those who expressed fear can exit by an alternative route. Putting the house on a main road, 'the two first and second choices, endanger the safety of the residents, and creates a noise and harassment hazard, probably greater than if they lived on Crown Land Lane. SUPERVISOR HARRIS: Is there anybody else, that would like to speak? RICHARD GRATHWOHL.- I'd like to speak on resolution 24. I have a letter that I'd like to present to the Board, but I'd like to present it after the resolution. My name is Richard Grathwohl. SUPERVISOR HARRIS: Is there anyone else, who would like to address any resolution, that we'll be acting on tonight? (No response.) If not, we will proceed on resolutions. Mr. Grathwohl, are you going to make a statement after we do resolutions? COUNCILWOMAN LATSON: I was telling Scott, I told him I would call you back, and I didn't, and tell you when the work session was ..today, so that you could be here, and Mr. Grathwohl is the adjacent neighbor 'to the proposed alternate site on the Main Road. He had several concer, ns, which relayed to your office and spoke with Harvey about it, and I'm not making excuses, but my father~in-law is dying of terminal cancer, so I was up at Stony Brook. There's no excuse, really. I forgot, and so '1 apologize, because I did say I would call you back. SUPERVISOR HARRIS: Dick, if you would come forth, I'd be glad to show you a copy right now before we get to it. TOWN ATTORNEY ARNOFF: I handed one to Mr. Burke. He can show it to Mr. Grathwohl. COUNCILWOMAN LATSON: I did speak to Fran about your concerns, too, because he is a very understanding neighbor. RICHARD GRATHWOHL: I have no comment at this time, but i would like to have the option to hand out a letter to you. SUPERVISOR HARRIS: You can do it now, or after the resolution. Thank you. JULY 31, 1990 21 2.-Moved by Justice Edwards, seconded by Councilman Wickham, it was RESOLVED that the Town Board of the Town of Southold hereby authorizes the refund of $15.00 to Frances Dooley, which sum represents the fee for a yard sale permit which Mrs. Dooley was forced to cancel due to a medical emergency in her family. 2.-Vote of the Town Board: Ayes: Councilman Wickham, Councilwoman Latson, Councilwoman Oliva, Councilman Penny, Justice Edwards, Supervi~,or Harris. Lessard, Prinicpal Buildincj Inspector, to attend the New York State Buildinc~ Officials Conference, Inc. on October 3, 4, 5, 1990, at the Fallsview - Hotel, Ellenville, New York, and the use of a Town vehicle for travel, and necessary expenses for meals, lodging and travel shall be a legal charge against the Building Department's 1990 Budget. 6.-Vote of the Town Board: Ayes: Councilman Wickham, Councilwoman Latson, Councilwoman Oliva, Councilman Penny, Justice Edwards, Supervisor Harris. Coutts, Sr. as a School Crossinc~ Guard, effective immediately, at a salary of $22.00 per day,AND as a Traffic Warden, effective immediately at a salary of $7.35 per hour. 7.-Vote of the Town Board: Ayes: Councilman Wickham, Councilwoman Latson, Councilwoman Oliva, Councilman Penny, Justice Edwards, Supervisor Harris. This resolution was declared duly ADOPTED. 8.-Moved by Councilwoman Oliva, seconded by Justice Edwards, it was RESOLVED that the Town Board of the Town of Southold hereby appoints Kristine Stueber as a Beach Attendant for the remainder of the summer season, (to replace Todd Neuman who quit on July 19, 1990), effective July 25, 1990, at a salary of $5.99 per hour (2nd year). 8.-Vote of the Town Board: Ayes: Councilman Wickham, Councilwoman Latson, Councilwoman Oliva, Councilman Penny, Justice Edwards, Supervisor Harris. This resolution was declared duly ADOPTED. 9.-Moved by Justice Edwards, seconded by Councilman Wickham, it was RESOLVED that the Town Board of the Town of Southold hereby authorizes and directs Supervisor Scott L. Harris and Town Attorney Harvey A. Arnoff to execute a Grant Agreement between the U. S. Department of Transportation, Federal Aviation Administration, for the $259,067.00 federal share for the Obstruction Removal and Lighting Project at Elizabeth Field Airport, Fishers Island, New York. 9.-Vote of the Town Board: Ayes: Councilman Wickham, Councilwoman Latson, Councilwoman Oliva, Councilman Penny, Justice Edwards, Supervisor Harris. This resolution was declared duly ADOPTED. 11.-Moved by Councilwoman Oliva, seconded by Councilman Penny, it was RESOLVED that the Town Board of the Town of Southold hereby accepts, with regret, the resignation of Kathleen McKeic, lhan-Simpson, Coordinator of EISEP and Coordinator of the Adult Day Care Program, effective July 27, 1990. 11.-Vote of the Town Board: Ayes: Councilman Wickham, Councilwoman Latson, Councilwoman Oliva, Councilman Penny, Justice Edwards, Supervisor Harris. This resolution was declared duly ADOPTED. 12.-Moved by Councilwoman Latson, seconded by Councilwoman Oliva, it was RESOLVED that the Town Board of the Town of Southold hereby appoints Pamela Meuse as an Outreach worker for the 'Nutrition Program, Coordinator of EISEP and Supervisor of the Day Care Program, effective July 31, 1990, 7 hours per day, 5 days per week, at a total salary of $11,172.00 per annum. 12.-Vote of the Town Board: Ayes: Councilman Wickham, Councilwoman Latson, Councilwoman Oliva, Councilman Penny, Justice Edwards, Supervisor Harris. This resolution was declared duly ADOPTED. 13.-Moved by Councilman Wickham, seconded by Councilwoman Oliva, it was RESOLVED that the Town Board of the Town of Southold hereby reappoints Gerald Denneh¥ as Chairman of the Southold Town Farmland Committee, effective July 18, 1990 through July 18, 1991; he to serve in said position without compensation. 13.-Vote of the Town Board: Ayes: Councilman Wickham, .Councilwoman Latson, Councilwoman Oliva, Councilman Penny, Justice Edwards, Supervisor Harris. This resolution was, declared duly ADOPTED. 14.LMoved by Councilman Penny, seconded by Justice Edwards, it was RESOLVED that the Town Board of the Town of Southold hereby appoints William Gaffc~a, Jr. as a Custodial Worker I, at the Southold T. own Recreation Center, effective July 30, 1990, at a salary of $20,342.40 per annum. 14.-Vote of the Town Board: Ayes: Councilman Wickham, Councilwoman Latson, Councilwoman Oliva, Councilman Penny, Justice Edwards, Supervisor Harris. This resolution was declared duly ADOPTED. 15.-Moved by Justice Edwards, seconded by Councilwoman Latson, it was RESOLVED that the Town Board of the Town of Southold hereby grants permission to the Oysterponds Historical Society Inc. to close a portion of Village Lane, Orient, from a point south of Orchard Street and a point north of Fletcher Street, on Saturday, August 11, 1990 (raindate, Sunday, August 12, 1990), from 9:00 A.M. to 4:00 P.M., for the observance of the Society's annual 18th Century Day, provided they secure and file with the Town Clerk a Certificate of Liability Insurance in the amount of One Million Dollars, naming the Town of Southold as an additional insured. 15.-Vote of the Town Board: Ayes: Councilman Wickham, Councilwoman Latson, Councilwoman Oliva, Councilman Penny, Justice Edwards, Supervisor Harris. This resolution was declared duly ADOPTED. 17.-Moved by Councilman Penny, seconded by Councilwoman Latson, it was RESOLVED that pursuant to Article 8 of the Environmental Conservation Law, State Environmental Quality Review Act, and 6NYCRR Part 617.10, and Chapter 44 of the code of the Town of Southold, notice is hereby given that the Southold Town Board, in conducting an uncoordinated review of this unlisted action, has determined that there will be no significant effect on the environment. DESCRIPTION OF ACTION: Proposed "Local Law in Relation to Boats, Docks and Wharves". CHANNEL SYSTEM - The bed of a natural waterway with well defined banks presenting the evidence of the flow of tidal waters and commonly or usually traversed by watercraft, and, in addition, refers to man-made or stabilized waterways designed for the navigation of watercraft. For the purpose of this Local Law, boat basins and bathing areas are included in the "channel system". 2. Section 32-32 (Sanitary regulations) is hereby amended by adding, thereto a new subsection 32-32.1 to read as follows: 32-32.1 Ramps. A.All boat engines must be shut off when loading or unloading at any Town Boat Ra~:,. B. No person shall park or leave any unattended vehicle on any ramp. 3. Section 32-34 (Operation of boats near beaches and bathers) is hereby amended to read as follows: No boat propelled other than by hand shall cruise or be operated with one hundred (100) feet of any lifelines or bathing float, or if there be no lifelines or bathing float, then within one hundred (100) feet of any public or semipublic beach regularly used for bathing or swimming, nor shall such boat cruise or be operated in excess of five (5) miles per hour within fifty (50) feet of any person bathing or swimming, or anchored or moored boat. 4.Section 32-35 (Water Skiers) is hereby amended by changing subsection C to read as follows: C. No person shall ride on waterskis, surfboard or similar device, or use or operate a boat to tow a person thereon, within one hundred fifty (150) feet of any public or semipublic bathing beach or public dock or within fifty (50) feet of any swimmer or bather, or moving or anchored boat; nor shall any such persons engage in such activities come within three hundred (300) feet of the shoreline unless they approach or depart perpendicularly to or from the shoreline solely for the purpose of commencing or ending the ride. Section 32-35 (Water skiers) is hereby amended by adding thereto a new subsection D and E to read as follows: D. No person shall be towed on waterskis, surfboard, inflatable parasail, or similar device, unless such person is wearing a Coast Guard approved personal flotation device of Type I, II, or III. E. No person shall be towed on waterskis, surfboard, inflatable, parasail or similar device or use or operate a boat to tow a person thereon between the period sunset to sunrise or during periods of limited visibility. JULY 31, 1990 6. Section 32-36 (Speed Limits; manner of operation) is hereby amended by adding thereto the following new subsections: D. No boat shall be operated in such manner, as to throw up a wake which could be dangerous to life or limb of a person, boat, or other property. E. All commercial jetski or commercial windsurfing operators shall provide a patrol boat (other than a jetski or windsurfer) which must be operational and manned at all times for the purpose of controlling their clientele. F. All commercial jetski and windsurfer operators shall require their clientele to wear U.S. Coast Guard approved personal flotation devices of type I, II, or III. G. Small sailboats commonly known as windsurf~rs, are prohibited in the following areas. 1. Within five hundred (500) feet of Mattituck Inlet. .2. Within one hundred (100) feet of swimlines, 7. Section 32-36.1 (Equipment) is hereby amended by adding thereto a new subsection C to read as follows: C. In addition to the penalties provided for in this Chapter the Bay Constable has the authority to take the following actions for violations of this Section: 1. Direct the operator to proceed to a dock or anchorage. 2. Suspend further use of the boat until the condition is corrected. II. JULY 31, 1990 RICHARD GRATHWOHL: I really didn't want to speak. I just wanted to present you with a letter. There's one here for the Town Board, and I just want them to realize my concerns. That's all. Thank you very much. TOWN ATTORNEYARNOFF:Mr. Grathwofl t,~e had occasion to spend quite a bit of time with Mr. Burke, and discuss the nature of his project. I think more than you, he wants Iocation..I mean, there's nothing definJ, te that's been done, but whoever is the neighbor, he wants to be a good neighbor, and such that he wants to be able to maintain the property in the way, that would make you proud to have them as your neighbor. At least, that's what they voiced to me in the course of my conversation with them. I,for one, have done some independent inquiries in regard to the Way Back. I believe that they are a reputable organization, and they do, to the best of their ability, what they set out to do. I feel what the Committee has done, is a credit to this community, as a community, because I s~t in on many of the Board meetings, I mean on the Committee meetings, and there were people diametrically opposed in that room working together, and that says an awful lot for Southold. This is not something that you would find very often in other communities. I know because I've lived in the Brookhaven area, where there have been major problems. Old Field was the standoff point. I lived right next to Old Field at one point. I was privy to a lot of the community fervor, that arose out of a community residence, that went in there. I hope that they're good neighbors, because if they are, then I think from here on in, as I said to Fran Burke earlier tonight, it will be downhill for them. RICHARD GRATHWOHL: Well, I wasn't going to speak tonight. I just wanted to inform the Town Board, but now that you brought it up, I will say a few words. I attended the site meeting, the first site meeting, and two concerns came about. One, was mentioned and I overheard it said, that this was a nice site because we could enlarge it. That is a concern of mine. Number two, I met with Mr. Burke outside in the rain under the arbor, and I said, would you guarantee to me, that this will not become a drug rehabilitation center? He said no, he would not. Now, those are my two main concerns. I've been very liberal in trying to work with this Committee, and I will work with Mr. Burke, but I just wanted the Town Board to support me, just a property owner. I'm going to leave it at that, and I'll let you people decide. TOWN ATTORNEY ARNOFF: I don't believe that a drug rehabilitation center comes within the purview 6fthe Pattervon Law, and that would require further action, and further community response by Mr. Burke, so to the extent that if in fact he was your neighbor, or anyone else's neighbor, that single family dwelling exception, that's provided in 4134 of the Mental Hygiene Law does not apply to things like drug rehab centers, at least at this point does not. - RICHARD GRATHWOHL: Right. That's my concern is because the State government has ways of changing things at a later date. Everything looks on the table fine, but what happens five years down the road, ten years down the road? That is my concern, also. Not only for myself, but also, for the community. I've said enough. I really didn't want to. SUPERVISOR HARRIS: Mr. Grathwohl, we certainly appreciate your concern, and we certainly will do all we can to make sure your concerns are addressed in the future. SUPE~RVISOR HARRIS: At this time, we'd like to go back to the audience, unless there's any member of the Board, that would like to say anything in reference to their meetings, that they've been attending and so on. COUNCILWOMAN LATSON: I'll just make a brief comment on the State of the Bays conference. It was a pleasure to see a great majority of South01d Town Board members there. Justice Edwards, Supervisor Harris, Councilwoman Oliva and myself, attended the 1990 State of the Bays conference, where we were given an update on the B.T. Comp study, otherwise known as the Brown Tide Comprehensive Assessment Management Plant and they still don't know what causes the Brown Tide, but today they sure do have a much better idea what's going on in the Bay, in terms of nitrogen loading, and the algae bloom. As you may have read, there was an algae bloom in West Creek, West Neck Creek in Shelter Island, also one in Shinnecock Bay in Center Morriches. What we don't know is, if the blooms had always occurred. They may have occurred every year to a limited degree, but we never monitored before. The overall feeling of the conference, I came away with, was one of a guarded optimism. The Bays are certainly at a great risk, and .they haven't recovered fully. What they have managed to do,through the cooperation of the Health Department, is decrease the nitrogen loading into the bays from the scavenger waste plant in Riverhead, and also, from the lagoons from the duck farms, that previously dumped all the sludge in the creeks, so whereas there was approximately..I don't have the numbers in front of me, but I would say that 1,600 pounds of nitrogen going into the bay, there is 700 pounds going into the bay, and the immediate study area is Flanders Bay. That still is not a great amount, but steps are being taken to decrease the problem. Another feeling, that I came away with, was that regardless of whether we ever find the answers to the Brown Tide, today we know that our Peconic Bay system, unless diligently managed, is a bay at risk. The problems associated with i~eople 8' JULY 31, 1990 and developmen-t near the shores, so with increased development comes increased problems, but the overall strategy at this point is to acquire prime pieces of water- front, that still have not been developed as integral parts of an overall manage- ment program, and preservation for the Peconic Bays to strive for national estuary1 status, which Patrick Halpin and Fred Thiel have been working on in a bipartisan effort to get a bill, or a program across the government desk, so we can go to the Federal government and ask for National Estuary-j- Status, which wouldgive the east end ,as a whole, additional million dollars a year, and management of the bays, and awareness of not point and point source pollution. They also had a selectman from Massachusetts, who was managing the Buzzard's Bay study come down, and Ruth and I had the opportunity to have dinner with him, and he was very conservative man with a very practical approach, a very modern approach to government. But one thing, that I though was interesting is in Massachusett~s,where they elect their selectman, and it's non-partisian, and he couldn't understand how in a small town, like we have on the east end, we have political parties. If you're all coming From the same community, you should all be working towards the same goal, so with that we can all look forward to, and swallow looking to work together to enable the Peconic Bays to become a healther, and more abundant resource, that we all know and want it to be, and thank you. COUNCILWOMAN OLIVA: I would just like to make a couple of comments on the conference, tOO, which I though was very good. I did like the one remark by Dr. Casper, who's doing the research at Stony Brook University. They'd always known that these organism were in it, but they used to call them~ those little brown round things. Now~ they have their own name, and blown up with an electron microscope thirty thousand times in order to see them. But, also, it just points up the need for us, and hopefully the Planning and Zoning Committee, will start addressing such things as road runoff, no discharge zones around marinas, pump-out facilities, restrooms, proper drainage, because that is what we can do, and proper land use management, what we can do right here in Southold Town to help clean up the Peconics. COUNCILMAN PENNY: I just want to mention that the Legislative Committee will be taking a break for the month of August, and will be giving a break to the ~,Town Clerk's Office, and a break to the Town Attorney's Officer who have been iust about able to keep up with the legislation, that we passed. Some of the changes that have come, have come as a result of the Master Plant and some of the concerns of people for inadvertant things that wer~ put in the Master Plant that we've ironed out. A lot of it has been new legislation, as 'the Bay Constable legislationt which ~vould address a lot of public safety, and unfortunately, I will not be at the meeting in August, but I iust hope that the Bay Constable can be here to explain to anybody in the audience. There is a great concern for boater safety, and swimmers safety in the Town of Southold. So moving on with that, we'll be hitting some lively things in September, one of them being is how to fit a resource recovery plan into our Town zoning. So, we're going to be fairly busy for the winter. Thank you. COUNCILMAN WICKHAM: I'm like to speak briefly about the Waste Management Task Force, here in the Town of Southold, which has met several times since the last time the Town Board has met. Last Thursday we held a second garbage infor- mation meeting about the alternatives and-options facing the Town in the area of waste management. We are about to receive in probably the next month, the draft copy from our consultanting engineers on the proposed ~solid waste plan for the Town of Southoldr and I don't go into detail. It's not yet released, but basically the plan will build on a major recycling, reuse, rededuction effort. If this effort 'is really successful and effective, we should be able to reduce the garbage and waste, that comes into the landfill at present, down to some thirty percent of what we now take. If we can do that, there are a lot of opportunities open to the Town, to economize, and to make effective use of the resources we - have~ That is basically the fundamental, or the base plan, that we'll be reviewing and looking at, '-and at some stage discussing more with the people in town. Thank you, Scott. JUSTICE EDWARDS: I, also, attended the, quote, unquote, garbage meeting on Thursday evening. Went to the State of the Bays conference on Friday, which I, also, thoroughly enjoyed, and the man from Buzzard's Bay is a real buzzard. He could really put i~t accross to the public, and I mentioned this fact over ~on . Fishers Island. We're going 'to try and get him over there for a little talk. On Saturday I had a wedding to perform at two o'clock in the afternoon out on Kenny's Beach, which I thoroughly enjoyed with my companion, and at 3:30 we- had a plane flying us back to Fishers Island for a four o'clock Conservancy meeting, and over here yesterday. The Town Board is coming to Fishers Island on Friday. Also, I sat in on the Solid Waste Task Force meeting last night.~ Fishers Island is, also, very heavily concerned with SOuthold regarding our garbage problem. Friday, the Town Board is flying over to the Island to meet width the garbage commissioners, and Saturday we have a annual Fishers Island Ci~vic Association meeting, which will be well attended by the group from the Island getting everything in line for the Town father's meeting on Wednesday, a week from tomorrow on Fishers Island. Before we go out to the audience to hear what you have to say, to b~i~g tO U~ ~ i~fo~m~tion tha~ you feel may be important to us, I'd like to say that this Board continues, as Ellen said, continues to work in a effort with bipartisan politics and we certainly realize that the Town has many problems. We, also, realize that there are many things ahead, that we have to deal with, and certainly the State of the Bays Conference on Friday, that we attended, made many of.us~aware of the~ fact that every day should, also, be days that we care about saving the bays, and like Earth Day every day is Earth Day, everyday, also, sl~ould be S~ving the Bays, because it takes everyone of us working together to bring back those creeks that once were pristine, and certainly unpolluted, but also, on a lighter note, I'd like to say that maybe we can find a way that we can diaper swans, and geese, and sea gulls, and mallard ducks, because the sea gull coliform count bacteria, that is actually identified in some of our closure areas, which is the primary reason for closure, also, does come from these animals, and it's not only road runoff, which is of course, a maior portion of, as a point source solution, and not only from development, but also from the natural polulation from water fowl. So once we have that accomplished I think we may be able to c3o back to where we once were. At this time, I'd like to, also, thank once again, the committee, the Site Selection Committee, John Sullivan also has really done a marvelous job, having the background that he did, looking at plans, and so on. I think you really spearheaded this group, John, so I'd like to thank you on behalf of the Town Board, for your work also. At this time, I'd like to go out to the audience. Is there anybody who would like to address us on anything you feel maybe pertinent to you, or that it may be important to us, that we should be looking into, or we should be addressing? JODY ADAMS: May I ask a question? Are you going to discuss the referendum for the Open Space Farmland Plan? SUPERVISOR HARRIS: No, we're not. We discussed that today at the work session, and that was tabled for two weeks. If you'd like to address us on some- thing that you feel is' important? JODY ADAMS: There are a lot of things, that I feel are important. If the indica- tions are that Scott' Harris has not yet realized his responsibility to himself and the Town's taxpayers, we've all had dreams of things we would like to do, and of which really need doing, but that does not mean that they can simply go ahead and be done, and damn the cost. I feel I am paying close to five times what I should be in taxes, and that does not consider Police harressment, conduct or other matters. Mr. Murphy was ~voted out because he was grandizing himself at our expense, as were members of this Board. Mr. Murphy's ethics in spending money to try and create a career for himself, certainly deserves careful scrutiny. The Town may not need, want or be able afford Mr. Harris's dreams, and they should certainly be discussed publicly before being acted on. There's -~ a two sentence here, that I'm going to skip. Finally for today, I would, agaio, like to ask that in relation to your Beach and Open Spaces Committees, the ownership of sufficient beach and public grounds for the use of those without private owned ownership, be developed rationally, so the illegal use of others invasion of rights, and actual criminal usurpation by Police and Town Board members of our rights will end. SUPERVISOR HARRIS: .Is there anyone else, that would like to say anything at this time, otherwise I'll entertain a motion to adjourn. JENNIFER GOULD: Jennifer Gould. Will Resolution 22 be affecting the libraries? SUPERVISOR HARRIS: Yes. JENNIFER GOULD: I'm a Trustee for the Floyd Memorial Library in Greenport, and everyones operating under the assumption that our appropriation was twelve thousand five.. SUPERVISOR HARRIS: It is. COUNCILWOMAN OLIVA: it was just reinstated back. SUPERVISOR HARRIS: As a matter of fact, I had sent a letter out. Our comptroller had brought it to attention. We thought that possibly there was a problem with the budget the way it was originally interpreted, and he brought it to our attention. After talking to numerous trustees over the last two weeks, it's apparent to me that the libraries do their budgeting a year in advance, almost, and certainly I realize, as this Town Board does, that those monies that are budgeted in advance can't be retrofitted, so to speak, with a reduction. So, we have reinstated that small portion back to each of the four main libraries, and of course, the ~ne on Fishers Island, Judge, which we can't forget.
