The meet- ing was called to order at 1:30 P.M. with the following present: Supervisor KlippS Justices Terry, Albertson and Clark~ Town Superintendent of Highways Prices Town Attorney Terry and Town Clerk Booth. The minutes of the previous meeting were read and were duly ap- proved as read. Moved by Justice Clark; seconded by Justice Albertson: Resolved: That the regular monthly audit meeting of this Board be held at the office of the Supervisor at Greenport~ on Tues.~ Dec. ?~ 19~8~ at I~30 P.M. Unanimously adopted. Moved by Justice Clark; seconded by Justice Terry: Resolved: That irving M. Rogers of Greenport; Clarence Bergen of Mattituck~ George H. Stelzer of Southold ~nd David Edwards of Fishers islandS be and hereby are appointed dog enumerators for the Town of Southold~for the year 1949. E~vedby Justice Elbertson$ seconded by JuStice Clark: Whereas~ there exists a vacancy in the office of commissioners' of the Fish~rs Island Ferry District, caused by the resignation Of Leland H Goss~ and Whereas, it becomes necessary to appoint some person to fill such vacancy, Now Therefore Be It ~ Resolved: hat Miss Polly Edmonds be and hereby is appointed on the recommendation of the Commissioners of the Fishers Island Ferry District, to the office of Commissioner of the Fishers Island Ferry District~ to hold such office until the next annual meeting for the election of Commissioners of the District~ at which time the vacancy caused by the resignation of Leland H. Goss shall be filled for the .remaining unexpired term of Leland H. Goss. Unanimously adopted. Moved by Justice Albertson; seconded by Justic8 Terry: ~hereas, under the provisions of~Chapter 699, of the Laws of New York, 1957, it is provided that all claims against the Fishers island Ferry District shall be audited monthly by the Town Board of the Town of Southold, and W~ereas~ none of the members of the Town Board reside on Fishers ISland or in close'proximity 'thereto except one Justice of the. Peace, who resides on Fishers Island, and who is the only member of the Town Board in a position to maintain continuous personal contact with the Commissioners of said Fishers Island Ferry DiStrict: and Whereas, the maintenance and operation of the said Fishers Island Ferry is for the sole benefit of the irkhabitants of the Fishers Island Ferry DistriCt~ and Whereas, it is in ~he best interest of the said i~habitants thav the local member of the Town'Board maintain constant supervision over the operation of said District~ No9 Therefore Be It Resolved: that all claims of the Fishers Island Ferry District, and all reports of the 'C6mmissioners of said ~District he presented to the member of the To-~ Board?residing on Fishers~ Island~ for examination and approval by him prior to being sub- mitted to the Town Board for audit. Moved by Justice Clark$ Seconded by Justice Albertson: Whereas, the Town Board of the Town of Southold, N.Y., by a resolution duly adopted on the 3rd day of No~ember~ 19~8, authorized the Town Superintendent of Highways to purchase certain ~ipmemt for highway Construction and maintenance at a total cost of $16~682.00 subject to the approval of the County Superintendent of Eighways~ and provided that $15~000. of such cost wRs to be paid from the proceeds of obligations to be issued pursuant to the Local Finance Law, and ~tER~&S, a contract of purchase for such equipment was duly entered intoby the Town Superintendent of Highways on ~e 9th day of November 19~8~ %~ich contract has been duly approved by the County Superintendent of Highways. NOW, THEREFORE, BE IT RESOLV~ ~ 1. The specific object or purpose for Which obligations are to be issued pursuant to this resolutionis to finance the cost of:- One (1) Walter Sno9 Fighter Model AGBS complete with 18~ HP 32000 GV~, Hydraulmc power steer~ air braxes~ tmres 12.O0/3~ singles, defroster-heater, 0~-l~ offset ~ plow, SWR-12 Right- Speedwing - SWL Left Speedwing control. 2. The maximu~ cost of such equipment is $16~682.00 and the lan of financing such cost is as follows: A do~n pa~nent of 1682. is to be paid from the Ymchinery F-~ud, and the balance of the cost is to be provided by the issuance of serial bonds in the amount of $1~000~ pursuant to this resolution. ~ The following determinations are hereby made: ~ The period of pro~able usefulness of such equipment is five years. (b) The subdivision of paragraph a of Section ll~O0 of the Local Finance Law which is applicable in the circumstances is sub- division ~r28". (c) The proposed maturity of the obligations authorized by this resolution will not be in excess of five years~ ~. The down payment required to be provided pursuant to Sec~ tion 10?,CO of the Local Finance Law has been provided from current funds. ~ That the Town of Southold issue its serial bonds in the amount of $15~000. to finance such cost in accordance with the fin- ancial plan set forth above. Such bonds shall be dated approximately as of the date of the delivery of such equipment and the power to fix and determine the exact date of such obligations is h~reby~ delegated to the Supervisor, 6. Such bonds shall be numbered i to h inclusive~ shall be in the denomination of $$~O00.~each for the first three bond~ and $3~O00. for the final bond~ and shall mature in annual installments in~h~_years and amo..unt~ as follows~ 19~9 $$,000.00; 1950 $$~OOO.00; 1951 $4~000.~ and 19~2 $3~000.O0. ~he power to determine the date upon which such installment shall b~come due and payable is hereby delegated to the Supervisor. The.bonds shall be issued in bearer forms without couponss and shall not contain a power to convert to re- gistered form, .~The bonds shall bear interest at a rate not exceed- ing 2-1/2 per centum per annum payable semi-annually.- 7, The Supervisor is hereby delegated the power to prepare such bonds and to sell such bonds at private sale at not less than par and accrued interest~ and at such sate to fix the interest rate to be borne by such bonds within the limitations set forth in this resolution. The Supervisor shal~ deliver snch bonds to the purchaser thereof only aga~inst~eash or a certified check, The proceeds of sale o~ the bonds shall be deposited in a special bank accoo~t as required by Section 165.00 of the Local Finance Law. The powers delegated to the Super..~i~or by this resolution shall be exercised in conformity with the provisions of~the Local Finance Law. 8, This resolution shall take effect immediately. The T6Wn of Southold~ in the County of Suffolk~ a municipality of the State of New Yorks hereby acknowledges itself indebted and for value received promises to pay to the bearer of this bond on the let day of 19~ ~ the sum of Four Thousand ($$~000,00) Dollars~ and to pay interest on such sum at the rate of per centum ( ~) per annum~ semi-annually~on the ls~ day of October and April in each year from the date of this bond until it matures~ upon presentation of this bond for notetion of such interest payment thereon. It is hereby certified and recited that all conditions~ acts and things required by the Constitution and statutes of the State of New York to exist~ to have happened and to have been performed precedent to and in the issuance of this bond~ exist~ have happened and have been performed~ and that the issue of bonds of ~hieh this is one~ together with all other indebtedness of'such Town of Southold New Tork~ is within every debt and other limit prescribed by the Constitution and laws of such State.
