Meeting of March 23, 1958

The minutesof the previous meeting, were read and ~uly approvedas

A public hearing was held at the office of the Supervisor at Greenport,
on Tuesday~ March 23, 19~8, to consider a proposed Town0rdinance
prohibiting and regulating the disposal of garbage and rubbish. The
ToWm Clerk presented proof of publication of such hearing. Super-
visor Klipp opened the hearing at 2 P.M. and read the call of the
meeting. He then called upon any pe~son present wishing to speak
ei~hgr.for or against the p~oposed ordinance.
Mr. Walter E. Hyatt representing several property owaers at Hortons
Point at Southold spoke in favor of the proposed ordinance. A cem-
m,,~ation ~s read from Howard M. Terry, a commissioner of~the
So~thold Fire District, stating his approval of the proposed
dinance~. There was no opposition expressed to said proposed ordin-
ance. The Supervisor declared the hearing closed at 2:30 P.M.
Moved by Justice Clark; seconded by Justice Terry~ and on roll call
the following ordinance was umanimously adopted by the Town Board.
SOUTHOLD TOWN ORDINANCE PROHIBITING~
AND REGULATING THE DISPOSAL OF
GARBAGE AND RUBBISH
SECTION E. DEFINITIONS
~s used in this-ordinance, the term "person" shall mean any
person firm or corporation, other than the authorize~ employees_
of the Town of Southold; the term "garbage" shall mean any animal
or vegetable refuse, offal, swill, garbage, papers, ashes, Junk, rub-
bish, discarded machinery, furniture, building or construction
materials, dirt, leaves and the like; the term "attendant" shall mean
any employee of the Town of S6uthold in charge of the existing Town
D~mp and or any garbage disposal area mmder the direction of the
Town Superintendent of Highways; the" term "garbage disposal area"
shall mean any premises designated by the Town Board as the
Official dump.
SEQTION 2. D~MPING PROHIBITED GENERALLY
No person~shall throw, east or deposit, or. cause to be thrown,_
cast or deposited any garbage upon any premises within the Town of
Southold except'om written authorization by the Town Board, which
authorization may be revoked on thirty days notice. Nothing con-
tained in this section shall be construe~ to-prevent the temporary
~ccumulation of ~arbage by a resident of the Town upon praises
occupied by him to the extent that is ordinary or necessary for
h~is personal household requirements, nor to prevent the disposal
of garbage at any Town D~,mp or garbage disposal area maintained
.or authorized by the Town of Southold, mcr to prevent the proper
use of receptacles placed upon the Streets or other public places
in the Town for the depositimg of papers.
SECTION 3. INVITATIONS TO DUMP BHOHIBITED
No. person shall by erecting signs or other invitation offer
any premises within the Tow~ as a place for the disposal of garbage,
or allow any persons, publicly or-private!y, to dispose of gar~aSe
on a~y premises in the Town.
SECTION ~. CONVEYANCE AND TRANSPORTATION OF GARBAGE.
No person shall convey or transport garbage through the streets
of the Town of Southold in any cart, wagon, vehicle or by any other
means unless adequate care is taken to prevent the blowing away or
spilling of garbage in the streets.
SECTION 5. PENALTY
Any person violating any of the provisions or actions of'this
ordinance~ or any part thereof, shall~pay a penalty of not less than
Five Dollars nor mor~ than Fifty'Dollars for the.first offense, and
~not less than Twenty five Dollars nor more~than One~HUndred~Detla=s·
for each subsequent offense. In addition to the foregoing 9enalty~
it is hereby ordained that a violation of this ordinance or a~y pa~t
thereof shall ~stitute disorderly conduct a~d the person guilty of
such violation shall be ad±Sorderly person. _
SECTION 6.
This ordinance shall not apply to any territory included within
the limits of ~he incorporated Village of Greenport~

The Board held a lengthy discussion on the Fishers Island':Ferry
District~
A comm~uication was read from the family of the late Louis S~ Tuthi~l,
~xpressing the appreciation of the family for the sympathy el' the
Board~
Moved by. Justice Tuthill; seconded by Justice Albertson;
Resolved. That the Superintendent of Highways be and herebyis auth-
orized to sell one 1~1 Reo dump truck,one 1535 International dump
truck, one 19~6 Diamond T. dump truck for a total price of $1500~
Unanimously adopted.
Moved by Justice Terry; seconded by Justice Albertson:
ReSolved: That any expenses incurred by any Town Official,in
promoting any plans of operation for the Fishers Island Ferry District
becharged against said Ferry District in accordance with'Sec. 202 A.
