BARGAIN AND SALE DEED WITH COVENANT AGAINST
GRANTOR'S ACTS (INDIVIDUAL OR CORPORATION)
FORM 8002 (short venion), FORM 8007 (long venion)
CAUTION: THIS AGREEMENT SHOULD BE PREPARED BY AN ATTORNEY AND REVIEWED BY ATTORNEYS FOR
SELLER AND PURCHASER BEFORE SIGNING.
THIS INDENTURE, made the September 7, 2006, between Leonard D. Epifano and Patricia
Ryan-Epifano, Husband and Wife, of 1100 Watersedge Way, Southold, New York 11971, party
of the first part, and Bayhaven Properties,xLLC of 19 Westbury Road, Garden City, New York
11530, party ofthe second part;
WITNESSETH, that the party of the ftrSt part, in consideration of Five Hundred Twenty
Thousand Dollars and No Cents ($520,000.00), lawful money of the United States, paid by the
party ofthe second part, does hereby grant and release unto the party of the second part, the heirs
or successors and assigns of the party ofthe second part forever;
SEE ATTACHED SCHEDULE 'A' DESCRIPTION.
TOGETHER with all right, title and interest, ifany, of the party of the first part in and to any
streets and roads abutting the above described premises to the center lines thereof,
TOGETHER with the appurtenances and all the estate and rights of the party of the first part
in and to said premises,
TO HA VE AND TO HOLD the premises herein granted unto the party of the second part, the
heirs or successors and assigns ofthe party of the second part forever.
AND the party ofthe first part, covenants that the party of the first part has not done' or
suffered anything whereby the said premises have been encumbered in any way whatever;'except
as aforesaid.
AND the party of the first part, in compliance with Section 13 ofthe Lien Law, covenants
that the party of the first part will receive the consideration for this conveyance and will hold the
right to receive such consideration as a trust fund to be applied first for the purpose of paying the
cost of the improvement and will apply the same first to the payment ofthe cost ofthe
improvement before using any part of the total ofthe same for any other purpose.
The word "party" shall be construed as ifit read "parties" whenever the sense ofthis
indenture so requires.
IN WITNESS WHEREOF, the party of the first part has duly executed this deed the day and
year first above written.

of Suffolk, State of New York, known and designated as Lot No.40 on a certain map

RUNNING THENCE South 52 degrees 05 minutes 50 seconds East, 125.00 feet;
THENCE South 37 degrees 54 minutes 10 seconds West, 125.00 feet;
THENCE North 52 degrees 05 minutes 50 seconds West, 125.00 feet to the easterly side
of Bay Haven Lane;
THENCE North 37 degrees 54 minutes 10 seconds East along the southeasterly side of
Bay Haven Lane, 125.00 feet to the point or place of BEGINNING.
BEING AND INTENDED TO BE the same premises know by the street address of 305
Bay Haven Lane, Southold, New York 11971.
BEING AND INTENDED TO BE the same premises conveyed to Leonard D. Epifano
and Patricia Ryan-Epifano by deed from Patricia Ryan-Epifano dated February 12, 2004
and recorded in the Suffolk County Clerk's Office on February 20, 2004 in Liber 12302
Page 345.
Grantor herein, Patricia Ryan-Epifano, is the same Grantor to Leonard D. Epifano and
Patricia Ryan-Epifano in the Deed dated February 12,2004 and recorded in the Office of
the Suffolk County Clerk on February 20, 2004 at Liberl2302 Page 345 and is the same
Grantee, Patricia 1. Ryan, from Edna D. Schinnerer dated March 15, 1975 and recorded
in the Office of the Suffolk County Clerk on April 7, 1975 at Liber 7820 Page 481.
