The Southold Town Board met at the office of Supervisor Norman E.
Klipp~at Greenport on Tuesday~ March 22~ 19W9o The meeting was
called to order at 1:30 P.Mo with the following present: Super-
visor Nlipp; Justices Terry; Tuthill; Albertson and Clark; Town
Supt. of Highways Price; Town Attorney Terr~ and Town Clerk Booth.
The minutes of the previous meeting were read and were duly ap-
proved as read.
Moved by Justime Clark; seconded by Justice Albertson:
Resolved: That the regular monthly audit meeting of this Board be
held at the office of the Supervisor, on Tuesday~ April ~, 1959,
at 1:30 P.M.
Unanimously adopted.
Moved by Justice Albertson; seconded by Justice Terry:
Resolved: That the leave of absence of George G. Wetmore from the
Town Police Force, be extended from April l, 19~9, to July l, 19~$~
without compensation.
Unanimously adopted.
MOved by Justice Terry~ seconded by Justice Tuthill:
~esolved: That Bond No.SM-175~308 of the American Motorists Ins-~r-
ante Co. on behalf of Otto L. Anrig~ Bond No. SM-175~307 of the
American Motorists Insurance Co. on %ehalf of James P. Kelly and
Bond No. SM-175~306~ o~ the American Motorists Insurance Co. on
behalf of Henry Y. King~ be and hereby is approved as to form and
sufficiency of surety therein.
Unanimously adopted.
A letter was read from George R. Latham, President of the Oyster
Ponds Historical Society~ Inc. expressing his appreciation for the
timely assistance of Supt. of Highways Price and his men in helping
move the old Orient School House to its destination.
A public hearing was held at the office of ~he Supervisor at Green-
port, on Tuesday, March 22, 1959~ to consider a proposed Town Or-
dinance regulating the taking of clams from Tow, waters. The
ToWn Clerk presented proof of publication of such hearing.
Supervisor Klipp opened the hearing at 2 o'clock P.M. and read
the call of the meeting. He then called upon any person present
wishing to speak either for or against the proposed ordinance.
Clarence Erickson spoke in favor of the proposed ordinance.
William Caley was opposed to it on the grounds that he didn't
believe it could be enforced.
The Supervisor declared the hearing closed at 2:2~ P.M.
Moved by Justice Tuthill; seconded by Justice Albertson: On roll call
the following clam ordinance was unanimously adopted by the Tow, BOard:
~OUTHOLD TOWN ORDINANCE TO REGULATE THE TAKING AND ~NNER OF
TAKING CLAMS FROM TOWN WATERS.
Section l: Definitions as Used in this Ordinance.
(1) Resident: Whenever the word "Resident" is used in this
ordinance it shall mean a member of a household actually occupying
or maintaining a dwelling in Southold'Town for not less than two
months of the calendar year in which a violation of this ordinance
was committed.
(2) Southold To%~ Waters: Whenever the~,~n~ds "town waters"
are used in this ordinance they shall be deemed to mean all waters
and land under waters in any harbor, bay or creek~ title to which
is vested in the Board of Trustees of the Town of Southold and shall
include all of the waterways and creeks cutting the shore line of
the To~m of Southold on Long Island.

Section 2: No person not a resident of Southold Town may take
clams in any manner at any time from Town waters.
Section 3: No person may take illegal size clams at any time.
Section $: Any violation of this ordinance shall constitute a
misdemeanor and shall be punishable by a fine of not less than
$5.00 ~or more than $50,00 or imprisonment for not less than
lO days nor more than 180 days~ or by both such find and imm~
~ prisonment.
Section 5: This ordinance shall take effect immediately.
