ON CONDITION THAT [he bond (indemnity inswance) required shalt continue in full force and effect in favor of the Town of Southold, and PROVIDED that the actual point at which the fireworks aze to be feed shall be at least two hundred feet from the nearest building, public highway or railroad, or other means of travel, and at least filly feet from the neazest above ground telephone or telegraph tine, Vees or other overhead obstruction; that the audience at such display shall be restrained behind lines at least one hundred and fifty feet from the point at which the fireworks are dischazged and only persons in active charge of the display shall be allowed inside these lines; that all fireworks that fire a projectile shall be so setup that the projectile will go in the air as nearby as possible in a vertical dvection unless such fireworks aze to be fired from the shore or a lake or other large body of water, then they may be directed in such manner that the falling residue from the deflagration will fall into such lake or body of water; that any fireworks that remain unfired after the display is conducted shall be immediately disposed of in a way safe for the particulaz type of fireworks remaining; that no fireworks display shall beheld during any wind storm in which the wind reaches a velocity of more than thirty miles per how; that all persons in actual chazge of fn-ing the fireworks shall be over the age of eighteen years, competent and physically fit for the task, that there shall be at least two such operators constantly on duty during the discharge and that at least two soda acid or other approved type fire extinguishers of at least two and one-half gallons capacity each shall be kept at such widely separated points as possible within the actual area of the display. The Town may grant a permit for the public display of fireworks by municipalities, fair associations, amusement parks or organizations of individuals. Penal Law Section 405.00(2). 2. An "organization of individuals" is a religious, civic, or comparable organization. Op. Atty. Gen No. 2007-3. 3. The fireworks display must be one intended for a public audience. The ability of the public to see an otherwise private display does not render it a "public display". Fireworks permits shall not issue for weddings or other private parties. See Op. Atty Gen. No. 2007-3. 4. Council- man Tom Wickham cast the lone dissenting vote. Adequate regulations regarding docks aze already in place in Chapter 275 of town code, he said. Specifically, there are 12 conditions to get a new dock application approved by Trustees. "I think we already have a good policy in place," Mr. Bergen said. "This is a purely political, not an en- vuonmental, question to answer: What do the citizens of Southold Town want their coastline to look like?" Mr. Bergen said. Improving public water access and keeping vistas open should be the two points guiding any revisions made to town code during the moratorium, Mr. Ber- gen said. But other trustees welcomed the dock moratorium with open arms. "We need this moratorium," said Trustee Peggy Dickerson. New dock regulations have been discussed but not acted upon for two years, she said. Though she believes the town has a "very good wetland code," she said she welcomed any changes or clarifications that could bemade during the moratorium. Unlike Mr. Bergen, Ms. Dickerson believes environ- mental and visual impacts should be weighed equally during the moratorium.Town officials will now have a chance to "stop, look and listen" to all the facts. Jill Doherty, the Trustees' vice president, said she arid Trustees president Jimmy King both feel it's time the town "take a hazd look" at its shoreline. She said she wasn't sure a moratorium was necessary to do so, but would support the boazd's decision either way. Southold Town Board members on Tuesday agreed to let the Lions .Club set off its fireworks display one last time from the townowned preserved pazcel adjacent to the Strawberry Fields festival site on Route 48 in Mattituck. The boazd re- versed its decision of two weeks ago af- ter a seazch of town records didn't turn up a letter board members thought was sent [o the Lions Club in 2007, informing the club it would have to find a new site in 2008. Boazd members don't believe setting off fire- works is an appropriate activity on land preserved far open space, because of potential impacts on wildlife and habitat. At the board's May 6 work session, members, believing a letter to that effect had been sent to the Lions last year, agreed to in- form the club the site was off limits this year. "We looked in the files in the town attorney's office and could not find anytfiing saying that it was the last time," said town attorney Patricia Finnegan.. "I would give them the permit this year and put it in writing that this is the last time," Supervisor Scott Russell said. The application is to for the display to occur on Town owned Open Space property. On September 15, 2006, the Land Preservation Committee sent a memorandum to the Supervisor and Town Board stating that the Committee was made aware that Town-owned open space land had been used in the past as a launching area for a fireworks display. The Committee determined that fireworks are not in keeping with the purposes of our open space program and that this use should not be allowed in the future on any Town-owned open space lands. In an a-mail to you dated June 7, 2007, I noted: "At the June 5, 2007 Town Board meeting, the Town Board overrode the Land Preservation Committee's recommendation against allowing fireworks to be launched on the Town owned open space property formerly known as the Adamowicz property. The Town Board decided to allow the fireworks to occur this year. " It is my understanding that the Town Board allowed the (reworks to occur in 2007, but that the Board did not intend to allow it again in 2008. I believe that this matter should be scheduled for discussion at the next Town Board meeting. I have copied this a-mail to Scott in order for him to schedule discussion at the next TB meeting. Since the law library is over the the Annex, I don't have easy access to Town Law Books other than the ones I have copies of. I am going to put the Town Board resolution from the last meeting in this file. Would you supply me with state regulations, copy of penal code, etc.? PERMIT for PUBLIC DISPLAY OF FIREWORKS I, ELIZABETH A. NEVILLE, Town Clerk of the Town of Southold, Suffolk County, New York, being an officer duly designated by [he Town Board of the Town of Southold for this purpose, do hereby GRANT TO: MATTITUCK LIONS CLUB PERMIT FOR THE PUBLIC DISPLAY OF FIIZEWORKS by said organization in accordance with the provisions of Section 405.00 of the Penal Law of the State of New York on FRIDAY, JUNE 13. & SATURDAY. JUNE 14.2008 AT 9:30 P.M.. on the town-owned property off Souud Avenue in Mattituck, New York. ON CONDITION THAT the bond (indemnity inswance) required shall continue in full force and effect in favor of the Town of Southold, and PROVIDED that the actual point at which the fireworks aze to be fired shall be at least two hundred feet from the neazest building, public highway or railroad, or other means of travel, and at least fifty feet from the neazest above ground telephone or telegraph line, trees or other overhead obstruction; that the audience at such display shall be restrained behind lines at least one hundred and fifty feet from the point at which the fireworks aze dischazged and only persons in active chazge of the display shall be allowed inside these lines; that all fireworks that fire a projectile shall be so set up that the projectile will go in the air as neazby as possible in a vertical direction unless such fireworks aze to be fired from the shore or a lake or other lazge body of water, then they may be directed in such manner that the falling residue from the deflagration will fall into such lake or body of water; that any fireworks that remain unfired after the display is conducted shall be immediately disposed of in a way safe for the particular type of fireworks remaining; that no fireworks display shall beheld during any wind storm in which the wind reaches a velocity of more than thirty miles per how; that all persons in actual chazge of firing the fireworks shall be over the age of eighteen years, competent and physically fit for the task, that there shall be at least two such operators constantly on duty during the dischazge and that at least two soda acid or other approved type fire extinguishers of at least two and one-half gallons capacity each shall be kept at such widely sepazated points as possible within the actual area of the display. All conditions and laws of the State of New York and the Town of Southold regazding the firing of fireworks must be met by the permittee or their agents. Elizabeth A. If you look at last years permit, I believe that is what we put......
