the party of the second part, the heirs or successors and assigns oflbe party of the second part forever,

dated Ol;tober 26, 2001 recorded in the Offiee of tbe Clerk oftbe County of Suffolk on July 9, 2002 in

TOGETHER wilb BlI righl.title and interest, if any, oflbe pany of the first part in and to any streets and
roads abutting the above described premises to the center lines thereof.
TOGETHER with the appurtenances and all the estate and rights of the party of the first pan in and to said
premises,
TO HAVE AND TO HOLD the premises herein granted unto the party ofthe second part. the heirs or
successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been incumbered in any way whatever, except as aforesaid.
AND THE party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party
of the first pan will receive the consideration for this conveyance and will hold the right to receive such
consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement, and
will apply the same first to the payment of the cost of the improvement before using any part ortbe total of
the same for any other purpose. The word "party" shall be construed as i fit read '"parties" wheneVl:r the

SCHEDULE A - DESCRIPTION

ALL that certain plot, piece or parcel of land, situate, lying and being at Mattituck, Southold Town,
Suffolk County, New York, bounded and described as follows;
BEGINNING at a concrete monument set on the Northwesterly corner of the premises herein
described as monument being on the easterly line of premises of land now or formerly of the Estate
of Alice H.W. Boutcher and also being South 57 degrees 51 minutes 40 seconds East 200 feet from
a point on the Southerly side of the Main Road marking the Northwest corner of land now or
formerly of the Estate of Alice H.W. Boutcher; from said monument of beginning;
RUNNING THENCE South 57 degrees 51 minutes 40 seconds East along land now or formerly of
Alan Cordnale, 150 feet to a concrete monument and the Northerly side of a right-Of-way 33 feet In
width;
RUNNING THENCE along the Northerly side of said right of way South 48 degrees 00 minutes West
75 feet to a concrete monument and land now or formerly of Deidre Mooney;
RUNNING THENCE along said land North 57 degrees 51 minutes 40 seconds East 146.39 feet to a
concrete monument;
RUNNING THENCE North 45 degrees 18 minutes 50 seconds East 74.09 feet to the concrete
monument at the pOint or place of BEGINNING.
TOGETHER WITH a right of way for access between said premises and the Main Road, said right
of way running along the Southerly side of said premises and In a Westerly direction and thence In
a Northwesterly direction and thence in a Northerly direction and 25 feet In width as it runs in a
Northerly direction; the Northerly and Easterly sides of said 33 foot right of way being described as
follows:
BEGINNING at a concrete monument at the Southeasterly corner of the premises herein conveyed
and running South 48 degrees 00 minutes West 655.16 feet along said land herein conveyed and
land of John W. Boutcher to a point;
THENCE North 57 degrees 04 minutes 40 seconds West 154.94 feet along said land of John W.
Boutcher to a concrete monument and the Easterly side of said 25 foot right of way; said 25 foot
right of way THENCE RUNNING between lands of John L. Sturges on the West and Clara Dale on the
East to the Main Road: IT BEING UNDERSTOOD however, that the party of the first part is under no
obligation or liability for keeping open or maintaining said right of way.
