The Southold Town Board met at the office of Supervisor Norman E. Klipp~
at G~eenport~ on Tues.~ Sept. 19, 1950. The meeting w~s called to order
at 1.30 P.M.~ with the following present:
Supervisor Klipp; Justices Terry~ Tuthill~ Albertson and Clark~
Town Superintendent of Highways Price; To~ Attorney Terry .and
Town Clerk Booth.
The Minutes of the previous meeting were read and were duly approved as
read.
Moved by Justice Clark, seconded by Justice Terry:

esolved. That the regular monthly audit meeting of this Board will be
held at the office of Supervisor at Greenport, on Thurs.~ Oct.
at 1:30 P.M.
Unanimously adopted.
Moved-by Justice TuthilI, seconded by Justice Atbertson:
Res~ved: That the Town Assessors be authorized to attend the annual
'convention. of National AssoCiation of Assessing Officers to be held at
Atlantic City, N.J., on Oct. 8 to Oct. 12, 1950, Necessary expenses
incurred by the assessors attending this meeting is a proper charge
against the town.
Unahimously adopted.
The following Resolution offered by Superintendent of Highways Harold Price
and seconded by Justice Harry Terry was unanimously adopted by the
Town Board:

from our m~dst~ Jozef Kozlowski~ a faithful and conscientious employee
of the Sou~hol~ Town Highway Department for over twenty-two years~
Now ThereforeBe It Resolved: That we~ the members of the Southold
To%~a Board~ do hereby express our heartfelt sympathy to the members of
his family, and
Be It ~urt~e~r Resolved: That a copy of this resolution be spread upon
the Minutes of the To%~ Board~ and that the Town Clerk cause a copy
thereof transmitted to his family.

Be It Further Resolved: .That Joseph Sawiski be co~pensated for such
position at the rate of $ 6.~0 per day.

Resolved: That a public hearing will be held at the Village Hall,
Greenport, on Tuesday, October 3, 19~0, at 8 o'clock P.M.~ for the
purpose of eonsidering a proposed contract with the Village of Greenport
for the furnishing of fire protection to the East-West Fire Protection
Distr~ct ° ~

Resolved: That the street lighting contract betwwen the To~m of Southold
and the Long Island Lighting Company for the Mattituck Lighting District #I
be and hereby is approved by the ~own Board, said contrac~ is for a term
of five years an~ expires on SePt. 2~, 19~.

The hearing on the matter of purchasing machinery for the Town Highway
Dept.~ which was advertised in accordance with Section lk2 of the
Highway Law~ was duly opened at 2 o'clock P.M. No person appeared
before the Board to speak either for ar against this item mentioned
in the legal notice. The hearing was closed at 2:30 P.M.

Whereas~ t~ Town Superintemdent of Highways did~ on the 19th day of
Sept. ~ 1950~ duly recom~2end the purchase of certain (Machinery)
(equipment) pursuant to provisions of Section lk2 of the Highway ~aw~
and a notice of'such recommendation has been duly published as provided
in such section.
Now Therefore Be It Resolved that pursuant to Section 142 of the
Highw~ Law the To,sm Superintendent of Highways is hereby authorized ~
to purchase Trom M_~u~,~i~al Machinery Co. with the approval of the -
County Superintendent of Highways: ~-

A contract of purchase for the item purchase shall be du~y executed b

effective. When such contract has been duly executed and approved~
the Supervisor is authorized to complete such purchas$ upon delivery
of the item purchase8 in accordance with the terms of such resolution
and such contract~ and to pay the above amount(s) specified to be paid
by check or checks.

$ 7,500,
THAT WHEREAS tha Towr~oard of the Town'of Southold~ New York~
after due public notice~ by a resolution duly adopted on the 19th day ..... --~-
of September~ 19~0~ authorized the Town Superintendent of Highways t~-
purchase certain machinery for highway con$truction and maintenanc~
at a total cost of $ ~90~O. , subject to the aoproval of the ~ounty
'Superintendent ,of Highways and orovided that $],7~O of such cost was
to be paid from oroceeds of obligations to be issued pursuant to the
Local Finance La~ ard ~
~EREAS a contract of purchase for such machinery was duly entered
into by the Town Superintendent of Highways on the 19th day of September~
1950~ which contract has been duly aporoved by the County Superintendent
of Highways. '
NOW~ THEREFORE~ BE IT RESOLVED:
1. That the specific o~ject or purpose for which a capital note
is to be issued pursuant to this resolution is to finance the~ cost of
certain highway machinery known as a:-
Nelson Bucket Loader Model ~-iI wmta rotary screen and 12 inch pads.
~. The maximum cost of such machi~ery is $ 9040. ~ and the plan
of financing such cost is as foi~ows: By machinery traded in pursuant to
Section 142 of the Highway Law o~ the value of $,,1~40 . The balance~of
the cost is to be provided by the issuance of a capital note in the
amoun~ of $ 7500 ~ pursuan~o this resolution.
3o The following determinations are hereby made:
(a) The period of probable usefulness of such equipment
is five years.
Local ~' (b) The subdivision of paragraph afof Section 11.00 o£ the
~mnance Law which is applicable in the circumstances is subdivision "28
(c) The proposed maturity of the obligation authorized by
this resolution will not be-in excess of one year.
~. That~ e~cept as herein specifically prescribed~ said note shall
be of the date~ terms~ form~ contents and place of payment and at a rate
of interesz not exceeding TWO (2%) per centum per ann~m~ as may be
de~ermined by the Town Oupervisor~ consistent~ however, with t~e provisions
of the sRid Local Finance Law of the State of'New Yor~{ and shall be executed
in the name of the sR~d Town by its Oupervisor and the Seal of said Town
shall be attached thereto.
~ ~ That said note shall be sold at private sale by the ~own
ouperv~sor at a price of not less than par value and accrued mnterest~
if any~ and upon due execution and sale of said note the same shall be
delivered to the purchaser upon payment by him to the ~own -upervisor
of the purchase price ih cash$ and the receipt of such Supervisor shall
be a full acquitance to such purchaser who shall not be obliged to see
to the application of the purchase money. ·
6~. The full faith and credit of the Town of ~outhold~ New York~
are pledged to the punctual payment of orincipal ahd interest on said note
