HomeMy WebLinkAboutTB-07/27/1951 Meeting of July 27, 1951 The Southold Town Board met at the N~_uicipal Building at Green- port on Friday, July 27, 1951, for the purpose of holding a public hearing on'a petition for the establishment of a light district bounded as follows: on the North by Front ~Street; on the Ea~st by Village Line; on the South by Corwin Street; on the West by Nineth Street. Notice of said hearing was duly posted and published as required by laW. Supervisor Klipp ~pened the hearing at 7:30 P.M. with the fol- lowing present: Supervisor Klipp; Justice Terry; Tuthitl;~ Albertson and Clark; Town Attorney Terry and Town ClerkBeOth. The Supervisor read the call of the hearing, and called upon any person present that would like to speak either for or against the matter in question. Present were: Albert Martocchia; Albert 01se~, John Mazzaferro. All were in favor of the estab- lishment of ia light district. Moved by Justice Clark; seconded by Justice Albertson: W~_~REAS, a petition for the creation of a Lighting District to be known as the West Greenport Lighting' District in the Town of Southold, County of Suffolk, New York, the said petition being dated June l, 1951, was duly presented to this Town Board, and WHEREAS, an order was duly adopted by the Town Board on July lO~ 195i, reciting the filing of said petition, the improvements proposed, the boundaries of the proposed district, and the esti- mated expense thereof and specifying July 27, 195i, at 7:SC O'clock P.M. as the time and N~mfcipal Building in the VilLage of Green _ port in said Town of Southold as the place where the said B~ard would meet to consider the petition and to hear all person~ interested in the subject theresf, concerning the same, and WHEREAS, such order was duly posted, published and servedI as required by law, and WHEREAS, a hearing in the matter was duly held by the Boardon this 27th day of ~uly, 19%1, commencing at 7:~0 o'clock P.M., at the Municipal Building in the Village of Greenport in sai~ Town of Southold, and considerable discussion upon the matter having been had, andall persons desiring to be heard, having been duly heard, including~ameng others, Edward T. Costello,~ Esq., an attorney representing the petitioners, and various other. Persons speaking in favor of the establishment of the proposed district, and also NON~in opposition thereto; Now, upon the . evidence given upon such hearing,~and upon motion of Justice Clark and seconded by ~sticeAlbertson, it is RESOLVED AND DETEHi~INED that (a) the p~ition aforesaid is signed and acknowledged or proved as required by law, it ~duly complies with the requirements of Section 191 of the Town Law as to sufficiency of signers with respect to the bou~d- aries of the proposed district as herein approved and it is otherwise sufficient; (b) all the property and the property owners within the proposed district are benefited thereby; (c) all the property and property owners benefited are in- cluded within the limits of the proposed district; and (d) it is in the public interest to grant in whole the relief sought; and it is further RESOLVED AND DETERMINED that the establishment of a Lighting District as proposed in said petition be approved;~.~ that the service therein mentioned be provided for upon the re- ~ quired funds being made availab~e~or provided for; and that such ~district shall be ~esigmated and known as the West Gree~Pert Lighting District of the Town of Southoldand shall be b,umded and described as follows=- Begirming at a point on the northerly line of Fr~n~Street, at the southwesterly corner of land of Arthur A~-L~vine, distant, along the northerly line of Front Street, one hundred (100') feet from Sixth Avenue~ and running thence in a northerly direction along the westerly line ef said land of Arthur A.
