THIS INDENTURE, made the 21 st day of November, Two Thousand One
BETWEEN
WILLIAM H. CONNELL and SUZANNE CONNELL, husband and wife, residing at 145
Mitchell Road, Holliston, Massachusetts 01746,
party of the first part, and
VANCE COMERFORD, residing at 29 East Madison, Chicago, lllinois 60602
party of the second part,
WITKESSETH, that the party of the first part, in consideration ofTen Dollars and other valuable
consideration paid by the party of Ilhe second part, does hereby grant and release unto the party
of the second part, the heirs or successors and assigns of the party of the second part forever,
ALL 111at certain plot, piece or parcel of land, situate, lying and being at Mattituck, Town of
Southold, County of Suffolk and State of New York, bounded and described as follows:
BEGINNING at a point on the westerly line of a 25 foot right of way leading southerly from
New Sufolk Avenue, said point of beginning being about 2160 feet southerly along said 25 foot
right of way from New Suffolk Avenue and being also 168.10 feet southerly along said
westerly line of said 25 foot right of way from the southerly line of Kraus Road and being also
the southeasterly corner of land of William Kraus; from said point of beginning;
RUNNING THENCE along said westerly line of said 25 foot right of way, South 14 degrees
35 minutes East, ]24.50 feet;
THE]\'CE along land of Peter Kreh at right angles to said westerly line, South 75 degrees 25
minutes West, ]48.96 feet to land of Zebroski;
THENCE along said land of Zebroski, North 11 degrees 22 minutes 50 seconds East, 174.33
feet to said land of Kraus;
THENCE along said land of Kraus, South 80 degrees 39 minutes 10 seconds East, 79.45'feet
to the point or place of BEGINNING.
TOGETHER with an easement for ingress and egress over and upon the right of way 25 feet
wide, adjoining the above described premises on the east and as it leads southerly from New
Suffolk Avenue to Peconic Bay.
TOGETHER with the use in common with others of the following described parcel and the
proposed dredged canal adjacent thereto as a boat basin:
BEGINNING at a stake set on the westerly line of a 50 foot private road at the southeasterly
line of a dredged canal, said point of beginning being North 88 degrees 03 minutes West
174.75 feet from an iron pipe at the northwesterly corner of land of Rambo, said point of
beginning being also about 500 feet westerly from the westerly line of a 25 foot right of way
leading to New Suffolk Avenue; from said point of beginning
RUNNING southerly along said westerly line of said 50 foot private road, 60 feet to a stake;
THENCE southwesterly along land now or formerly of Peter F. Kreh, Jr., 10 feet;
THENCE northerly along the easterly edge of a proposed dredged canal 60 feet to said
southeasterly edge of said dredged canal;
THENCE northeasterly along said southeasterly edge of said dredged canal, 10 feet to the
point of beginning.
TOGETHER with an easement for ingress and egress over and upon the private road 50 feet
wide adjoining the above described canal and boat basin as it runs northerly and easterly to the
25 foot right of way leading to New Suffolk A venue and Peconic Bay.
BEING AND INTENDED TO BE the same premises conveyed to the party of the first part by
deed dated August 6, 1998, and recorded August 26, 1998, in the Office of the Suffolk County
Clerk in Liber 11913, Page 422, and by corrected deed dated November 28, 2000, and
recorded January 10, 2001 in the Office of the Suffolk County Clerk in Liber 12096, Page
130.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any
streets and roads abutting the above described premises to the center lines thereof; TOGETHER
with the appurtenances and all the estate and rights of the party of the first part in and to said
premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second
part, the heirs or successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered
anything whereby the said premises have been encumbered in any way whatever, except as
aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that
the party of the first part will rece:ive the consideration for this conveyance and will hold the
right to receive such consideration as a trust fund to be applied first for the purpose of paying the
cost of the improvement and will apply the same first to the payment of the cost of the
improvement before using any part of the total of the same for any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so
reqUIres.
IN WITNESS WHEREOF, the party of the first part has duly executed this deed the day and
year first above written.
