southerly when measured along the westerly side of Deep Hole Drivl: (West Branch) from the comer
formed by the intersection of Deep Hole Drive (West Branch) with the southerly side of New Suffolk
A venue;
RUNNING TI-IENCE South 30 degrees 1 I minutes 20 seconds East along the westerly side of Deep Hole
Drive (West Branch) 100 feet to a monument and land now or formerly of Katherine Kennelly;
RUNNING THENCE South 59 degrees 48 minutes 40 seconds West along said last mentioned land 205.50
fcet to the highwater mark of Deep Hole Creek and the wL'Sterly side of a bulkhead;
THENCE North 20 degrees 07 minutes 00 seconds West along the highwater mark of Deep Hole Creek and
along the westerly side of said bulkhead 101.56 feet to the land now or formerly of Edmund Nash;
THENCE North 59 dcgrees48 minutes 40 seconds East along said mentioned land 187.75 fcct to the
monument on the westerly side of Deep Hole Drive (West Braneh) at the point or place of BEGINNING.
BEING AND INTENDED TO BE the same premises conveyed to the parties ofthe first part by deed dated
September I, 1999 recorded in the Office of the Clerk of the County of SufTolk on September 10, 1999 in
Liber 11988 at page 341.
BEING AND INTENDED TO BE the same premises conveyed to the parties of the first part by deed
dated November 3,1986 recorded in the Offiee of the Clerk oftbe Count)' of Suffolk on Deeember3,
1986 in Liber 10182 page 134,

TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and
roads abutting the above described premises to the center lines thereof.
TOGETHER wiLh the appurtenances and all Lhe estate and rights of the party of the first part in and to said
premises.
TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or
successors and assigns ofthc party ofthc second part forever.
AND Lhe party ofLhe first part covenants that the party of the lirst part has not done or suffered anything
whereby the said premises have been incumbered in any way whatever, except as aforesaid.
AND THE party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party
of the first part will receive the consideration for this conveyance and will hold the right to receive such
consideration as a trust fund to be applied first for the purpose of paying Lhe cost of Lhe improvement. and
will apply the same flI'St to the payment of the cost of the improvement before using any part of the total of
the same for any other purpose. The word "party" shall be construed as if it read "parties" whenever the
sense of this indenture so requires.
