Klipp at Gree~ort, on Tuesday, March 20, 1951..The meeting was ~a}led to o~der at 1.30mp.M. with the following present, m Supervisor Kli~p, Justices Terry, Tuthill and Clark; Town Superintendent of Highway~ Price; Town Attorney Terry and Town Clerk Booth. The minutes of the previous meeting were read and were duly approved as read. Moved by Justice Tuthill; seconded by Justice ¢lark~ Resolved: That the regular monthly audit meeting of this Bo~'rd will be held at the office of the Supervisor at G~eenport, on Tuesday, April lO, 1951, at lz30 P.M. Unanimously a doptedo Ndcholas Kouros appeared before the Board requesting the BOard to take over a proposed road through his property at New Suffolk. Said proposed road will extend from New Suffolk Avenue, north to the property of HOWard Tuthill, thence west to Grathwchl Road, it being the inteEtion of Mr. Kouros to have this proposed road con~ructed this fall. Moved by Justice Tuthill; seconded by Justice Clark: Resolved: That when a strip ~O feet in width of the proposed road is cleared, plowed and harrowed, the Board will view same and if it is to the satisfaction of the Town Board, the Board will consider taking it over as a public highway. Unanimously adopted. ~ ~ Robeht Douglass appeared before the Board in behalf of James Douglass, requesti~g~ the Board to take over a proposed road through his property at Orie~t~' ~ Mo~ed By Justice Terry; seconded by Justice Tuthill: Resolved: That when a strip 30 ft. in width is cleared, plowed and har- rowed, the Board will view same and if it is to the satisfaction of the Town Board th& Board will consider taking it over as a public high- way. Moved by Superintendent of Highways Price; seconded by Justice Terry: Whereas, It seems for the best interests of the Town of Southold that any person or persons in the future who are desirous of dedicating real property to the Town of Southold for highway purposes and Whereas, Such highways should comply to specifications, Now Therefore Be It Resolved: That effective as of March 20, 1951, all persons dedicating real property to the Town of Southold for highway purposes shall abide by the following specifications. Vote Ayes- KlipP~ Terry, Tuthill, Price and Clark. ~ustiCe Albertson being absent. HIGHWAY SPECIFICATIONS Town of Southold l: Any person or persons desiring to dedicate real estate to'the Town of Southold for highway purposes must execute and submit to the Town Board the following docnments:- a. A duly acknowledged dedication and release. b. Proposed consent of the Town Board. c. Proposed order of the Superintendent of Highways. d. A survey map of the property. e. An Attorney's certificate of title or/and an abstract of title certified to the Town Board by an Attorney or a title policy issued in the name of the Town of Southold. The foregoing 'five documents shall be fastened together in one folder and the dedication and release shall include the signatures of all fee owners~ easement owners~ mortgagees, and so forth~ and the Attorney's certificate shall certify to such. f$ A bargain and sale deed in proper form for recording in the County Clerk's Office together with the recording fees. An additional survey map of the property, other than tke one contained in the folder, shall also be submitted. 2~ £ All highways accepted by the Town as town highways must be at least $9~ feet in width; such width hereinafter known as the bounds of the highway. All' proposed high~ys shall be properly surveyed~ mapped, and standard concrete monuments placed at the expense of the prop- erty owner or owners dedicating such highway. All highways terminating at water shall be a width of not less than 100 feet for a distance of 50 feet back from the mean high water mark. All d~adend highways must have a width of not les~ than 1OO feet for a distance of 50 feet back from such deadend or an equivalent thereof for a turnaround. 6= ~he mames of such highways may be chosen by the owner or owners ~f ~.o~prop~r~ dedicating such highway~ and th~ name of such highway shall be subject to the approval of the Town Board. 7~ 9~ A width of ~0 feet shall be hereinafter known as the ~ghwa~ area. All trees, brush, roots, rocks~ and so forth~ shall be thoroughly cleared from the highway area and all such material sSall be moved from the bounds of the highway. The portion known as the highway area shall be plowed~ disc- harrowed, property graded, proper drainage provided and shaped to the satisfaction of the Superintendent of Highways. 10: ~Highways accepted by the Town as town highways will not be ~rfaced ~til there exists at least $20~0OO.00 assessed valuation per mile of highway accepted, or fraction th~reof'~ or the cost of material needed for surfacing such.highway is paid for by the pr6perty owner or owners adjacent to'such highway. 11: Whemever in the opinion of the Superintendent of Highways he feels that for the best interests of the Town alterations or modifications should be made to the above specifications~ rules and regulations, such alterations or modifications may be made on'the recommendation of the Superintendent of High- ways; such recommendation being subject to the approval of the Town Board. Moved by Justice Terry; seconded by Justice Clark: Whereas, It is felt that the best interests of the To~ of Southold will be served in adopting new rules and regulations governing Southold Town Con~tables, NOW, Therefore Be It Resolved: That the present Rules and Re- gulations as approved by the Town Board under date of April 20~ 1958, be and hereby are declared null and void~ and Be It ~urther Resolved: That effective as of April l, 19~l, the Rules and Regulations governing the Southold Town Constables~ as approved by the Southold Town Board under date of March 20, 1951~ be and hereby are in full force and effect. Unanimously adopted. 339 RULES AND REGULATIONS GOVERNING THE SOUTHOLD TOWN CONSTABLES l: "SCHEDULE OF: WORK%- Monthly schedule of the hours of duty and time off for each Constable shall be placed upon the bulletin board at the Police Station at Peconic~ New York. This schedule may be altered from time to time upon the approval of the Chief of Police~ when in his opinion he considers such alteration to be for the best interest of the Town~ ConStable~ or Constables affected. 0therwise~the schedule as posted on the bulletin board shall be strictly adhered to. 2: "SICK LEAVE":- The amount of sick leave granted to any one Constable in any one calendar year without loss of compensation shall not bxceed 12 days~ unless upon recommendation of the Chief of Police. Such recommendation shall have the approval of the Town Board. Extension of sick leave may be granted only when in the opinion of the Town ~oard it is for the best interest of the Town. Such leave shall be granted only when it becomes necessary for the Constable to be confined or upon Doctor's orders. ~o~hing in this section shall be construed so as to lead any Constable to believe that such sick leave may be added to vacation leave. Sick leave mas b~ granted by the Chief Of Police at any ~time without the approval of the Town Board, providin~ that t~e aggregate amount of sick leave in any one c~lendar year for any Constable has not exceeded the 12 days provided. 3: "VACATION LEAVE": - Each Constable shall be granted not over l~ consecutive vacation days (including Sundays and/or Holidays) wit~ compensation in any one calendar year. Vacation leave can not be accumulated. Priority for such vacation leave shall be ascertained by whatever method the Chief of Police decides upon. Vacation leaves shall not be granted that include any legal holiday~ unless approved by the Chief of Police. The Chief of Police shall require certain Constables to work additional ttme during vacation leaves so that a fu~l contingent of Constables will be on du~y at all times. Vacation leaves granted other than those mentioned shall be recommended by the Chief of Police and shall have the approval of the Town Board. "INTOXICATING BEVEP~GE S',~" ~- No Constable shall drink intoxicating beverages of any kind during his hours of duty and no Constable shall be allowed to do his tour of duty while in an intoxicating condition. The Chief of Police shall have full power to determine the degree of intoxication. Constables shall not be compensated f6r any loss of time caused by drinking intoxicating ~e~erages~ and will be subject to further penalties as may be determined by Town Board. "TRAFFIC DUTY": - In order to c~tail speeding through the villages and along the highways throughout the Town~ each Constable shall from time to time in the various sections of the Town park the Police car along the curb or upon the sho~ulders of a highway and direct traffic on the highway. Before leaving the Police car~ he shall call the Police Station and give the exact location of the vicinity in which 340 he is directing traffic. Upon his return to the Police car, he shall call the Police Station and give whatever information may be required. At Least 2 hours of any day shift shall be used for this purpos.e~ and at least i hour of every night shift, unless in the :opinion of the Chief of Police this period of time allocated for the direction of traffic shall be increased or decreased. 6: "RA/)I0!!TRANSMtSSION"I:- NO message shall be transmitted over the radio system that is not in accordance with FCC regulations. Unnecessary remarks will net be tolerate~. 7: "~CCIDENTS": - In cases of accidents which require the services of a wrecker~ the Constable covering such accident shall call the nearest available wPecker, unless it is the desire of the party involved in such accident to do otherwise. 8:- "CARE OF POLICE CARS AND ?REVEN~IVE MAINTENANCE":- EVery Constable shall be required to completely fill out a before operation check sheet at the start of each tour of duty. Check sheet will consist of the following: 1. NAME. Each Constable shall print his name in this space. 2. SHIFT. Each Constable shall fill in the hours of each shift. 3. DATE. Each Constable shall fill in the date. MILEAGE. Each Constable shall fill in the speedometer reading at the start and end of the shift. TIRES. Each Constable shall be required to check each tire, including the spare for the following~ ¢ondi~io~ of tread~ bruises~ cuts and visual inflation. Any de£&cts shall be noted under "remarks" and reported to the Chief of Police. 5 GASOLII~. Each Constable shall be required to fill the gas tank at the completion of his tour of duty and note the numberof gallons necessary to fill such tank. .7. OIL. Each Constable shallcheck the crank case oil level at the start of his tour of duty, and each Constable who is on duty when it becomes necessary to change the oil~ shall make a note in the "Temarks" column when such oil was changed andthe speedomete~ reading at the time. WATER. Each Constable shall check the radiator water level and rubber hose connections. INSTRUMENTS. Each Constable shall durir~g his tour of ~uty be required to ascertain whether or not the dashboard instruments are in order, and any defects shall be noted under "r~marks" and reported to the Chief 6f Police. 10. 10. CLEANLINESS. Each Constable shall at the completion of his tour of duty sweep out the interior of the car and clean the windows and the rear view mirror. ll. EQUIPMENT. Each Constable shall at the start of his tour of duty ascertain that the~ following equipment is in the Police Car: 12 flares~ one fire axe~ one full C0~ fire e~t~pguisher, one wrecking bar, Jack bolt,cutter,-one shovel, z b±ankets, one accident board, at least 6 accident report blanks and one resistance belt. 12. ME~NIC~L~.DEFECTS. Any mechanical defect noted during the tour of duty shall be reported in the "remarks" column to the Chief of Police. !3.-CONDITION OF ROADS, Each Co~stable shall note the condition ef the road - dry, wet~ slippery, icy,~snow. Snow tires shall be put on whenever in the discretion of the Constable he-deems it necessary, and it shall be noted in the "remarks" column when such snow tires are pus on. Periodic che~ks of the Police Cars and the condition of same shall be made by the Chief of Police. At least $ such checks shall be made each month. Periodic checks of the Police Cars and the equipment of same shall be made by the Police Committee of the Town Board. At least one such check shall be made each month. 9. "ENFORCEMENT":- It shall be the duty of the Chief of Police to enforce all Rules and Regulations herein contained. lO. "'CHANGES:- Changes, deletions or additional rules and regulations governing the operation and conduct of Constables may be made by the Town BOard upon a majority vote of such Board, and such changes~ deletions and additions will become effective or void after they have been posted upon the bulletin board and each Constable has been served with a copy thereof. 11.- "EFFECTIVE DATE": - These Rules and Regulations shall take effect immediately, and a copy of same shall be posted upon the bulletin board and a copy delivered to each ConStable for his information~ guidance and action. 12. "PENALTIES~:- Eny Constable Who, without a legitimate excuse for so doing, fails to or refuses to abide by the Rules and Regulations and the schedule of work as posted upon the bulletin board by the Town Board, shall be subject To reprimand~ suspension~ or both; the period of suspension as may be determined by a majority vote of the Town Board. Moved by Justice Clark; seconded by Justice Terry~ Whereas, it has been recommended by the Commissioners of the Fishers Island Ferry District that James Walter Gordon, residing at Fishers Island, New York~ be appointed as Purser fo the Fishers Island Ferry District. Now~ Therefore Be It Resolved: Tha is appointed as Purser of the Fishe salary of Three Thousand Dollars ($ Be It Further Resolved: That Jame: amount, payable in regular monthly Be It Further Resolved. Moved by Justice Tuthill; seconded ,y Justice Clark: Resolved, Town Clerk be and hereby is directed to request the Long I~and that the Lighting Co. to transfer the aerial street light from Pole #13~ to pole #133, on the Main Rd. in front of the Presbyterian Church in the Cutchogue Lighting District.
