A regular meeting of the Southola Town Board of Appeals was
held at 7:30 P.M., Thursday, January 4, 1973, at the Town Office,
Main Road, Southold, New Tork.
There were present: Messrs: Robert W. Gillispie, Jr., Chairman;
Robert Bergen; Charles Grigonis, Jr.; Fred Hulse, Jr.; SerEe Doyen, Jr.
Also present: Mr. Howard Terry, Building Inspector.
PUBLIC HEARING: Appeal No. 1701 - 7:30 P.M. (E.D.S.T.),
upon application of Roy J. and Helen Hansen, 4600 Westphalia
Road, Mattituck, New York, for a variance in accordance with
the Zoning Ordinance, Article III, Section 301, For permission
to divide property. Location of property: Lots #12, 13, 14 and
part of 15, Map of Tollewood, Mattituck, New York. Fee paid

F~. ROY NANSEN: We would like to improve the property. This
is our kitchen side of the house and we would like to put a patio
off the kitchen and build a garage.

THE CH~IRM~N: What is your lot number?
F~. HANSON: No. ll. I bought 161 Feet of property and I
would like to have 61 Feet so I can add on a patio and garage;
and I wish to sell the remaining 100 feet.
MR. ROBERT BErGeN: How wide is No. ll?
FA~. HANSON: 100 feet.
SiR. BP~RGEN: As I understand it y~ wish to make your lot
161 Feet wide and sell the remaining 100 Foot lot?
MR. HANSEN: Yes. I had to buy the whole piece. I want
161 Feet For m~self and have to sell the remaining 100 foot lot.
There are three people involved but I had to buy the whole thing
from one person.
THE CHAIR~N: You propose to leave a standard 100 Foot lot?
~. HANSEN: Yes. I would like to sell off 100 Feet and
retain 61 Feet For n~ use.
(There was a discussion as to the depth of the prope~y. It
was Found t~t it ranges from 210~ deep to 227~ deep).

After investiEation and inspection the Board finds that
applicant requests permission to divide property, Lots #12, 13,
l~ and part of 15, Map of TolleWood, Mattituck, New York. The
findings of the Board are that applicant is the owner of a lot
of approximately 100 Feet by 210 Feet at 4600 Westphalia Road,
Mattituck, and that the applicant has purchased Lots #12, 13,
14 and part of 15 (Lots 4 and 5' as described in the Van Tuyl
survey of September 27, 1971) adjacent to the westerly side of
his present lot. The house of applicant is located approximately
% feet from the westerly line and he wishes to increase the
westerly portion of his present house lot to 161 feet total road
Frontage on a line parallel with the present line. The effect of
this will be to add 61 Feet in width to his present lot size,
making the lot 161 feet wide by appr~ki~tely' 210 feet in depth.
This will leave a lot o£ approximately 100 feet in width by
approximately 227 feet in depth. The Board Finds that this will
reduce the projected density while increasing the size of the two
lots.

The Board finds that strict application of the Ordinance
would produce practical difficulties or unnecessary hardship;
the hardship created is unique and would not be shared by all
properties alike in the immediate vicinity of this property and
in the same use district; and the variance will not change the
character of the neighborhood, and will observe the spirit of
the Ordinance.

THE CH~IRM~N: This is an unusual piece of property, triangular
in shape, with the house situated on the westerly

THE CEAIRi~N: Is there anyone present who wishes to speak
for this application?
RUDOLPH H. BRUER, ESQ.: I believe the application pretty'
much speaks for itself. The property measures 72,031 sq. ft.
The applicant has his house and garage on the westerly portion
of the property and wishes to deed the remaining portion to his
daughter and son-in-law. The piece with the existing house would
be 32,031 sq. ft. and the portion to be deeded would be 40,000 sq. ft.

against this application?

After investigation and inspection the Board finds that
applicant requests permission to divide property on the north
side of Leslies Road, Peconic, New York. The findings of
the Board are that this is an unusually shaped piece of
property which doesn't lend itself to any other division.
The Board agrees with the reasoning of tha~ applicant.
The Board finds that strict application of the Ordinance
would produce practical difficulties or unnecessary hardship;
the hardship created is uulque and would not be shared by all
properties alike in the immediate vicinity of this property' and

MRS. I~tEZ D. MOON: I am M~s. Moon. Mr. Cron was supposed
to have been here.
THE C~IRMAN: This was one of t?~ first actions that this
Board took, it was in April of 1957. Mm. Lister had a number of
lots. I believe we tried to achieve 12,500 sq. ft. which was the
maximum required at that time.
THE CHAiRI~EA~N: is there anyone present who wishes to speak
against this application?
~. ROBERT BOYD: Since that time all other lots in that area
have 150 to 155 foot frontage, at least a half acre. I speak
against the application.
MP~. MOON: Is there any possibility of getting iu touch with
~. Cron?
THE CHA/RF~N: We have to Conduct the hearings at the time
specified. ~ believe we understand your application. The situation
is that all of the lots in this block are of this size. Our
counsel, by whom we are guided, has indicated that court decisions
are in favor. This is a variance area. We are obligated to grant.
~. BOtnD: We bought seven or eight years ago and all those
lots were divided prior to that. They have been divided close to
ten years.
THE CHAIRFIAN: The courts have felt that this would be an
unusual hardship.
MR. BOYD: Is there any restriction as to the size of the
house that can be built?
THE CHAIR~N: Whoever buys this lot will have to put up
a house of 850 sq. ft. It used to be 600 to 650 sq, ft.
MR. BOYD: Most every other ho~se is 1,700 sq. ft. or more.
THE CHAIP~i~N: This goes back 25 years.
ROBERT BERGEN: The house on the corner is not so large.
~. BOYD: That was subdivided years ago.
THE CHAIRMAN: I don't think we have any choice.
Fd~. BOYD: I would like to see it maintained the way it was
established some years ago. It's Just a matter of opinion.
THE CM~IR~L~N: The two adjoining lots are under separate
ownership. Both of those can be built on.

~w4~. BO~D: They have roughly about a 90 foot frontage.
MR. ROBERT B~GEN: These are all set up for approximately
a 90 foot frontage.
MR. BOYD: Thatts not too bad, I don't object to that.
THE CHAIR2~N: Is there anyone else present who wishes to
speak against this application?

After investigation and inspection the Board finds that
applicant requests permission to divide property on the south
side of South Cross Road, Cutchogue, New York. The findings of
the Board are that at the time applicant took title to Lots 5
and 6 each was a valid, legal building lot; all of the lots iu
the subdivision are in single and separate ownership and are of
a similar size. The Board agrees with the reasoning of the
applicant.
The Board finds that strict application of the 0rdinauce
would produce practical difficulties or unnecessary hardship;
the hardship created is unique and would not be shared by all
properties alike in the immediate vicinity of this property and
in the same use district; and the variance will not change the
character of the neighborhood and will observe the spirit of the
Ordinance.

The findings of the Board
are that if the division of property were allowed there would be many
more requests for division. The Board agreed that the acre lot size
as required by the Zoning Ordinance should be upheld.

THE CHAI~W~N: There is an application for a Building Permit
with attached sheet diagramming the proposed construction, and
outlying boundaries of this unusually shaped lot. On the easterly
side of the property the lot extends two courses of 138.%0' and
34.99' on Central Avenue; on the southerly boundary it extends on
two courses of ~!0.88t and 79.35' in a generally westerly direction
and intersects with the back line of the property, or the westerly
line, which is a single course of 262.12t. The northerly boundary
proceeds on two courses of ll2~ and 130', approximately, back to
the point of beginning.
To the 'north, off Central Avenue, there is a house owned by
&hman. There is also a lot to the north which is vacant and has
the name of Boyd on the sketch. The water is in back of this
"C-l" Industrial zoned property, and the total acreage is 1.14
acres. & public right of way bi-sects the lot. Fishers Island
Utility has an easement right of w~v which roughly parallels
Central Avenue. It'is %0 feet, or more, fro~ Central &venue.
The proposed steel building of 120~ x' 100~ has been located, in
the sketch, behind and just to the west of the right of way. It
is I foot from the right of way; at the southwest corner it is
28 feet from the southerly boundary line and 31 feet from the
westerly boundary line; it is 2 feet from the northwest corner;
and the northeast corner of the building is 12 feet from the
adjoining property of Ahman, and 27~ Fe~t From the right of way.

We have received several eommmnications with regard to this
application. One is a telegram from Mrs. Thomas Russell, Jr.,
Pres!dent of Fishers Island Civic Association. It reads as
follows:

UNCERTAIN W~mATHER PREVENT ATTEndANCE BY MA2~Z INTERESTED PARTIES.
The following letter was received from Nancy B. Kelsey,
President, Island People's Project:
~The Fishers Island People's Project objects strenuously'
to the proposed construction of a store on land owned by Mr.
Henry Walsh on the north side of Central Avenuebetween property
owned by the Fishers Island Utility Company, to the west, and
Mm. Gordon Ahman to the east.
Dock Beach is on the south side of Central Avenue across
from M~. Walsh's property. Sheltered from wind and waves by
West Harbor, the 'shallow water of Dock Beach makes it the safest
beach for Fishers Island children and the best place to swim and
receive swimming instruction. Five days a week during the summer
more than 75 children and many adults visit Dock Beach as
participants iu the Island People's Project's organized Recreation
Program.
Central Avenue makes a reverse curve beginning east of Dock
Beach and finishing west of it in front of the power station. The
road is narrow and has been the scene of automobile accidents.
Our organization believes that the additional nmmber of vehicles
visiting the proposed store will create unnecessary traffic hazards
for visitors and sm~ll children as well as those riding bikes
en route to Dock Beach.
Our second objection is that garbage accumulated by a food
store will attract rats. The latter would be a source of danger
to children playing on Dock Beach as well as house owners near
the site.
Finally, we are apprehensive that a cesspool serving a
commercial establishment so close to Dock Beach Could contribute
to water pollution.
For the reasons put forth above, we urge that your Board deny
~Lr. Walsh's petition to modify Town zoning ordinances so that he
can construct the building he proposes on Central Avenue."

TITE C_w~.IR~T: We will open the hearing but may have to
recess in order to give the people on Fishers Island an opportunity
to be heard. This is a request for an area variance, not a use
variance. Does a.~gone representing ~lv. Zabohonski wish to speak
at this time?
STANLE~f g. CORWIN, ESQ.: I would like to correct the distance
you read as the back llne of the property. The 262.12 feet goes
to Madeline Avenue. You have to subtract 143 feet. So, you are
dealing with a distance of roughly 120 feet rather than 262 feet.
THE C~L~IR~N. (after study of survey) Let the record stand
corrected that the westerly line of the property is 119.12 feet.
(262.12 feet less 143 feet).
~. CORWIN: i am here as the attorney' for ~. Zabohonski,
known as ~Walsh~. If I shomld lapse into calling him M~ Walsh,
you will know who Iam talking about. ~. and Mrs. Walsh (Zabohonski)
are present~r the owners of a food stere on the Island not far dis-
tant'from the~proposed location. It has grown oveP the past years
and ~rned in~o a ~Mom~ and ~Pop~ stor~, it i~ ~ot an easy store
to handle. It doesn't have the facilities that the Island needs.
A great deal of shopDing is now done~in New London. The Zabohonski~s
wish to perform a better service (although he is 67 and she"is 69)
while they a~e still able. I am sure you are all aware that they
are cra~ed for space. The particular location which they are asking
for~in the area variance is the only spac~ on the Island where this
sort of thing is available. One member Of the Board lives on
Fishers Island and I would have no objection to anything he might
contribute. I am sure he can shed a lot o£ light ou it.
One of the difficulties we have encountered is that there is
an easement running t-brough this property. In order to PUt up a
building of this size we would cut into the parking facilities
that are available.
TH~ C~IRMAN: The size of the building is not adapted to the
land. It seems you are attempting to adapt ~he plot to the building.
The building could be decreased in over-all dimensions; 120' x lO0~
is a pretty large building. It could be decreased, thereby increas-
ing the sideyards.
~. CORWIN: We don't think that is feasible. If the Board is
aware of the physical location; there is amnle room for service
vehicles to ~et into the area on all sides.~ There will be suff~ent'~
light and air on the westerly side where they are particularly
cramped for space.
~-~. Walsh (Zabohonskf) has asked me to say to the Board t~hat
he is the owner of a parcel of land, about a half acre in area,
across the street.

THE CHA!RMA/~: ~ Is that directly across the street?
MR. SERG~ D(rfEN: It's not directly across the street because
that's where the water is. (Mm. Doyen pointed out to the Board
the location of the other parcel on the survey).
MR. CORW~: He would use it for parking.
~. DOYEN: I do not quite understand the point you made
about the age of 2@, Zabohonski. is he trying to reduce or
increase the size of his operation?
MR. CORWIN: He feels that what he proposes to do is a
service.
MR. DOY~N:~ The% as I understand it, he wants to increase
the size of his operation.
THE CHAIR~N: He has another operation in to%rn.
2&q. CORWIN: That would be discontlnued. Zf we are talking
about over-all traffic, he doesn't intend to maintain the other
one. If you are going to ~djouru for further deliberatious on
the Island and if there are answers you want me to get, I will
be glad to do so.
T~ C~AIR~N: What does the right of way actually consist
~. CORWiN: It's a pole line, Fishers Island Utility Telephone
Company.
THE CHAIR~N: What proportion of the bu_idzng would be used
for storage, and what proportion for sales area. The formula for
parking is based on sales area.
]~. GORDON AHLERS: (acting for ~. Zabohonski) The building is
12,000 sq. ft., 120~ x 100~. The area used for storage and other
uses, such as toilet areas, is 3,0~0 sq. ft. which leaves an area
available for sales of 8,950 sq. ft. One parking space of 350 sq. ft.
for each 100 sq. ft. of sales area is a considerable amount of parking
space. We are talking about 90 cars and I daresay that is more cars
than have been on the Island since it was populated.
~. ROBERT B~RGEN: How many' homes are on the Island?
TM~ CHAi~_~I~L~N: t belieVe a population figure would. ~e more

MRo DO~EN: In the winter, the total population counting
babies would not be more than 350 people. Transient population-
work force- would be l~0 people at its peak. These people
travel back and forth. I doubt if the summer population is more
than 2,000 people.
TH~ CPL~IRMAi~: I don't think we can vary parking spaces.
This now comes under County review and they never, in my experience,
have permitted a reduction in parking area so it may well be that
the full amount of spaces would have to be provided.
MR. HOWgRD TERRY_, Building Inspector: You would have to
provide for 89 parking spaces.
MR. CORWIN: There is three quarters of an acre for parking,
alone.
~. HUYLSE: You would have to disregard this easement.
T~ CHAIR~N: You said that the building would be accessible
for trucks, etc. but it looks as if the only side that would be
accessible would be the southerly side.
~. CORWIN: I ~uow that one of the things that Boards concern
themselves with is whether or not there is room to get in with fire
apparatus. I would agree that according to the plot plan it wo~ld
certainly have to be from the south or east.
MR. AHLERS: Deliveries will be made in the northeast corner.
That is &hman's backyard.
~. ~HIERS: The idea would be to keep traffic patterns away
from the nearest house. I would like to answer some questions
that were raised by ~s. Kelsey. It is planned to have am interior
garbage room where everything is kept in a masonry lined room.
There will be no garbage outside, even in containers, and when it
is removed it will be done by trucks backing up to the building.
As far as rats a~e concerned, everything is being done to prevent
anything like this fr~m happening. As far as sewage disposal is
concerned, this would have to be passed by the Suffolk Department
of Health and situated in such a manner so as not to pollute or
drain into nearby waters.
THE CPL~IRMAN: If this were to be granted, you would have to
have a site plan.
MR. AHLERS: Test borings would be ~de.

TP~E CH&IB~N: I am looking at the Bulk Requirements under
"C-l" General of the Zoning Ordinance, a~d see that the minimum
is 200,000 sq. ft., lot width is 300 ft., Front yard- 150 ft.,
one sideyard 50 ft. both 100 ft., rear ya_a 100 ft The uses
proposed fall under a less heavy classification. I presume all
these uses would be permitted in ~ Light Industry. The "B"
Light industry lot area requirement is 20,000 sq. ft lot ~dth-
60 ft', front yard 35 ft., side yards- 2% ft. and 50 ft., rear
yard 35 feet. Iu other words, your proposal is to use ~'C-1'~
Heavy Industrial zoned property for a lighter business use.
~L~. &HLEHS: We would be perfectly willing to take a condition
or a restriction to be confined to a lighter use.
F~. CORWIN: There is ~ery little on the Island t~t can be
made to comply with ~C-1'~ use.
THE C~IRMAN: ~at is the actual operation going to be?
~q. AML~S: Strictly a supermarket, food.
