WITNESSETH, Ihal the party of the first part, by virtue of the power and authority given in and by said last

dollars, paid by the party of the second part, does hereby grant and release unlo the party oflhe second pan,
the heirs or succcssors and assigns of the party of the second part forever,
ALL that certain tract or pan:el of land lituate at Mattituck, in the Town of Southold, County of SutTolk
and State of New York, bounded and described as follows: Beginning at a point on ordinary high water mark
of the northeasterly shore of Deep Hole Creek, being 800 feet, more or less, westerly from the nearest poinl
in the center of a cenain gutter marking the easterly line of land of said Gildersleeve; running thence
northwesterly along said shore of Deep Hole Creek, 140 feet, more or less;
THENCE along other land of said Gildersleeve and passing through a stake near the shore of said creek,
North 29 degrees 37 minutes 30 seconds East 220 feet, more or less, to a stake on the southerly line of a
proposed highway;
THENCE easterly long said southerly line of proposed highway on a curve to the left whose radius is 330
feet, a dislance 01'78.0 feet on said curve;
THENCE along other land of said Gildersleeve and passing through a stake near the shore of said Deep Hole
Creek, South 16 degrees 05 minutes West 250 feet, more or less, 10 the point of BEGINNING.
TOGETHER WITH all right, etc., in Deep Hole Creek abutting the premises, also a right of way over said
proposed highway. 49.5 feel in width, northwesterly and then northerly from said premises to New SutTolk
Avenue over land ofsaid Gildersleeve.
BEING AND INTENDED TO BE tbe lame premises conveyed to James A. Torrey, now deeeased, by
deed dated-May 18, 1938 recorded in the omee oflhe Clerk oflbe County ofSuft'olk on June 6,1938

TOGETHER with all right, title and interest, if any, of the party of the Iirst part in and to any streets and
roads abutting the above described premises to the center lines thereof; TOGETHER with the
appurtenances.. and also all the estate which the said decedent had at the time of the dcccdcnt's death in said
premises. and also the estate therein. which the party of the first part has or has power to conveyor dispose
of, whethcr individual, or otherwise;
TO HAVE AND TO HOLD the premises herein granted unto the pany of the second pan, thc heirs or
successors and a.,.,igns of the party of the second pan forever.
AND the party of the firsl pan covenants that the party oflhe Iirst pan has not done or suiTcred anylhing
whereby the said premises have been incumbered in any way whatever. except as aforesaid.
AND THE pany of the flCSt part, in compliance with Section 13 of the Lien Law. covenants lhal the party of
the first pan will receive the consideration for this conveyance and will hold the right to receive such
consideration as a trust fund to be applied first for Ihe purpose of paying the cost oflhc improvement. and
will apply the same first to the payment of the cost of the improvCtncnt before using any part of the tOlal of
the same for any other purpose.
