HOLD the premist's herein granted unto the party of the second part, the heirs or su\.'Cessors and assigns of

AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of
the first part will receive the consideration for this conveyance and will hold the right to receive such consid-
eration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply
th(' same first to the payment of the cost of the improvement before using any part of the total of the same for
any other purpose.

LEGAL DESCRIPTION
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon
erected, situate, lying and being at Mattituck, Town of Southold, County of Suffolk and
State of New York more particularly bounded and described as follows:
BEGINNING at a monument set on the westerly side of a 25 foot right of way known as
Camp Mineola Road, distant southerly 757.60 feet from the corner formed by the
intersection of the southerly side of Kraus Road with the westerly side of Camp Mineola
Road:
RUNNING THENCE South 14 degrees 35 minutes East along said westerly side of Camp
Mineola Road 180.00 feet to land of J. Kreh;
THENCE South 81 degrees 05 minutes 30 seconds West along land of J. Kreh, 200.98 feet
to a monument;
THENCE North 14 degrees 35 minutes West, 160.13 feet to the southerly line of a 50 foot
wide private road;
THENCE along said private road, and land of Edwards, North 75 degrees 25 minutes East
200.00 feet to the westerly side of Camp Mineola Road and the point or place of
BEGINNING;
TOGETHER with the use in common with others of the following described parcel and the
dredged canal adjacent thereto as a boat basin;
BEGINNING at a point on the westerly line of a 50 foot private road distant North 88
degrees 03 minutes West, 174.75 feet as measured along a tie line from an iron pipe set at
the northerly line of land of Kupersmith, and the northeasterly corner of the parcel herein
described;
RUNNING THENCE southerly along said westerly side of the 50 foot private Road 60 feet;
THENCE southwesterly 10 feet;
THENCE northerly along the easterly line of the dredged canal 60 feet;
THENCE northeasterly 10 feet to the point or place of BEGINNING and use being
restricted to six (6) lot owners, this being the sixth (6'h) and final grant.
TOGETHER with an easement for ingress and egress over the private road, 50 feet wide, as
it leads from the above described premises first northerly and then easterly to said right of
way, 25 feet wide the easterly boundary thereof running parallel to and being distant 150 feet
westerly throughout from the westerly boundary of said right of way, 25 feet wide, and the
southerly side of said private road as it turns to run easterly, being parallel to and 320 feet
distant northerly throughout from the northerly boundary of said above described premises.
TOGETHER also with an easement over said 50 feet right of way southerly to the parcel
hereinafter described for access between said premises and said parcel.
SUBJECT to easements, restrictions and ordinances of record, if any, and such state of facts
as an accurate survey would show.
BEING the same premises as conveyed to the Grantors herein by Deed from Peter F. Kreh,
Jr. dated February 18, 1984 and recorded in the Suffolk County Clerk's Office on March 13,
1984 in Book 9526, Page 549.
