Jr, Southold, N.Y. 11971 TELEPHONE 765 - 1938 A regular meeting of the Southold Town Planning Board was held at 2:00 p.m., Monday, June 16, 1980, at the Town Hall, Main Road, Southold, New York. Present were: Chairman Henry E. Raynor, Jr. Vice-Chairman Frederick E. Gordon Member Bennett 0rlowski, Jr. Dr. Lee Koppelman, L. I. Traveler-Watchman Michael Stahl, Suffolk Times On motion made by Mr. Gordon, seconded by Mr. 0rlowski, it was RESOLVED to set 7:45 p.m., Monday, June 30, 1980, at the Town Hall, Main Road, Southold, New York, as the time and place for a public hearing on the question of the approval of the minor subdivision of Richmond S. Corwin, located at Southold. Vote of the Board: Ayes: Raynor, Gordon, 0rlowski On motion made by Mr. Gordon, seconded by Mr. 0rlowski, it was RESOLVED to set 8:15 p.m., Monday, June 30, 1980, at the Town Hall, Main Road, Southold, New York, as the time and place for a public hearing on the question of the approval of the minor subdivision of Robert W. Brooks located at Fishers Island. Vote of the Board: Ayes: Raynor, Gordon, 0rlowski Planning Board .... -2- une 16, 1980 The Board met with Dr. Koppelman and Mr. Kunz to discuss the update of the Southold Town Development Plan amongst other items. In regard to the question of the water quality and quantity, Dr. Koppelman suggested that Holzmacher, McLendon and Murrell be consulted as they have done virtually all the water studies in Suffolk County. Most federal programs for planning are limited. Dr. Koppelman suggested that the town stay with the same consultant for the updating of the comprehensive plan. If assistance is desired a resolution should be made by the board requesting same. 701 funds is questionable but CD funds could be utilized. He commented that goals should be established of where the town is going over the next twenty-five years. He recommended that there be a citizens advisory committee to the Planning Board to under- stand the problems and goals of the community. The County Executive is talking about the feasibility of extending the Southwest Water Authority to the north and south forks. If the Board agrees with this they should write the County Executive and indicate their concurrence. Dr. Koppelmanfeels that cluster zoning should be at the pleasure and control of the town and not the developer. If you want to protect water and rural quality this is necessary. He has seen clustering up to one quarter of the property. He suggested if the town is dedicated to preserving agriculture they should go for two acre zoning on the farms. Two acre zoning has been upheld in court. In regard to an east-west road the town could adopt a town map showing same. Dr. Koppelman would like to see the location of the existing purchase of development rights of the farms. Dr. Koppelman will be sent a copy of the map Mr. Raynor has prepared. In regard to Fishers Island and the open development area, it should be covered by the same rules and regulations of the rest of the town. Mr. Raynor inquired as to the possibility of old big homes being made into dmplexes and restrictions that could be placed so it would not become a runaway use. Dr. Koppelman suggested an inspection process to protect the owner, tenant and town. It should only be those with a relationship to the Main Road with a relationship to transportation and shopping. Another restriction could be that the house be owner occupied. Wetlands were discussed. These have been identified in the Coastal Zone Management Program. Priorities of the area were discussed with the general feeling that tourism produces the most income with agriculture being the prime generator of private wealth. Commercial was considered by Dr. Koppelman to be fourth after marine uses. ]~une 16, 1980 Planning Board ~ -3- ,~j Gatz subdivision. Inspection Report #136 of John W. Davis, Planning Board Inspector, was reviewed. It was determined by the board that the following conditions have not yet been met. 2. That the cuts and fillsbe balanced. 6. That substantial stairs be provided to the beach area and that plans be submittedlfor review. 7. That additional park and playground area be designated. This information is to be forwarded to Mr. Lark, attorney for the developer. Adeline Lee minor subdivision. A letter has been received from Abigail A. Wickham, attorney for Ms. Lee, requesting an amendment of the boundary line between Lots 2 and 3 of 12 feet to the east. This would eliminate the encroachment of the driveway servicing Lot 2 and will bring the cesspool within the bounds of Lot 2. The Planning Board sees no objection to the proposed amendment as outlined by Ms. Wickham. Armaroy Acres (A.L.R. Francisco) minor subdivision. Covenants and restrictions were filed in the Suffolk County Clerk's Office stating amongst other things that (2) That only one private dwelling shall be constructed on each lot and (3) that the minimum size of the living area on the ground floor of said private dwelling shall be 1200 square feet. The applicant's attorney, Abigail Wickham, has requested a letter from the Planning Board indicating that the two above statements were not required by the Planning Board as a condition to their approval of the subdivision and that the Planning Board has no interest in enforcement of those statements, provided that any use of the property does not violate the zoning ordinance of the Town of Southold. The Planning Board sees no objection to the intent of the change and would like a revised list of the covenants and restrictions to fit the needs of the particular lot intended to be purchased by the Fanny Behlen Community Health Center. Cooke - Emerson minor subdivision. The Board reviewed and accepted the conditions of the Suffolk County Planning Commission and they are to be placed on the map. No new major structure or sanitary disposal facility shall be constructed within 100 feet of the shoreline of Richmond Creek. There shall not be any discharge of stormwater runoff resulting from the development or improvement of either lot directly into Richmond Creek. Plauning Board ~- -4- iune 16, 1980 A short radius curve having a minimum radius of 20 feet shall be required at the right angle bend in the proposed 15 foot right-of-way to i~sure access of emergency and service vehicles. On motion made by Mr. Gordon, seconded by Mr. 0rlowski, it was RESOLVED to rescind the following action taken at a regular meeting of the Southold Town Planning Board held April 7, 1980: RESOLVED to disapprove the sketch map of the minor subdivision of Anita McNulty and Helen McNul~ said map dated February 22, 1980 as this is a set off piece of property from a total of three plus acres and the Board considers the division of property an evasion of the Rules and Regulations fOr~he Subdivision of Land of the Town of Southold. Vote of the Board: Ayes: Raynor, Gordon, Orlowski Lloyd Terry minor subdivision. The Suffolk County Planning Commission will not review this minor subdivision until it has a satisfactory e~planation as to why it is not considered a major subdivision as it contains five lots. In conversation between the secretary and Charles Lind, Chief Planner, Mr. Lind indicated that a declaDation that the remainder of the proper~y will only come in as a major subdivision might be acceptable to the Commission. Mr. Terry will be requested to provide same or eliminate a lot. Cardinale. Catalano has made application to the Planning Board for a subdivision of lots for ~fnich the Zoning Board of Appeals previously granted area variances. In submitting the application to the Suffolk County Department of Health Services by the Zoning Board of Appeals as required by the State Environmental Quality Review Act, the Department of Health Services submitted the following: "Information indicates that the area has a history of a limited water supply. In addition, this Department does not recommend the creation of residential lots less than 40,000 square feet in areas where private wells and individual subsurface sewage disposal is planned." The Planning Board will hold this application in abeyance until such time as the subdivider can prove to the Board that adequate potable water is available. On motion made by Mr. Gordon, seconded by Mr. 0rlowski, it was Planning Board RESOLVED to approve sketch map dated June 12, 1980 of Robert W. Feagles for property located at Fishers Island. Vote of the Board: Ayes: Raynor, Gordon, 0rlowski On motion made by Mr. Gordon, seconded by Mr. 0rlowski, i't was RESOLVED to set 2:15 p.m., Monday, July 14, 1980, at the Town Hall, Main Road, Southold, New York, as the time and place for a public hearing on the question of the approval of the minor subdivision of Robert W. Fea~lss located at Fishers Island. Vote of the Board: Ayes: Raynor, Gordon, 0rlowski Dean Minor subdivision. Gary 01sen, attorney for Mr. Dean, has requested a modification of the setback line as required by the Suffolk County Planning Commission. The Board can see no reason to modify this line. It was the consensus of the Planning Board members that Fishers Island should revert from the open development and conform to the town ordinances. There being no further business to come, before the Board, Mr. 0rlowski made a motion, seconded by Mr. Gordon and carried to adjourn the meeting.
