A regular meeting of the Southold Town Planning Board was
held at 7:30 p.m., Monday, June 2, 1980 at thei~Town Hall, Main
Road, Southold, New York.
Present were:

7:30 p.m. Public Hearing on the question of the approval of the
minor subdivision of property of Ruth Cooke and Claire Emerson
located at Southold. Richard Lark, Esq., appeared.
Mr. Raynor read the legal notice of hearing and presented proof
of publication in the Long Island Traveler-Watchman.
Mr. Raynor: This is a minor and the final hearing. It is a two
lot subdivision. There is correspondence in the file. To date
we have not received the Suffolk County Planning Commission
recommendations and any action we may take would be subject to
their consideration. We have forwarded the requested documents
to them. There is a resolution for a public hearingi There is
correspondence from the applicant's attorney, letters out to the
various agencies in regard to the State Environmental Quality
Review Act saying the project is unlisted and asking for a response
time by March 29, 1980. There is a copy of the application in
duplicate with a metes~and bounds description. As there are no
public highways, there is nothing from the Superintendent of
Highways. As is the policy of this board, is there anyone who
would like to speak in opposition to the subdivision. Hearing
none, is there anyone present this evening that would like to
speak in favor of the proposed subdivision.
Mr. Lark: I have nothing more to add except to ask that the
board approve it as it has been presented. It is my understanding

if the board does approve it it will be subject to a condition
that the two women will sign a covenant on the property to the
north.
Mr. Raynor: Would you supply us with a copy of the proposed
covenant.
Lar. Yes.
Mr. Raynor: We want to make sure it is in conformity with the
town requirement. We have sent this out to the county but to
date we haven't received the recommendations back so it will be
subject to consideration of them. Is there anyone else that would
like to speak opposed to this minor subdivision. Is there anyone
present this evening that has any information the board should~be
aware of. Mr. Latham, Mr. Gordon, Mr. Wall, Mr. 0rlowski, do you
have anything. (All answered in the negative.) There being no
further questions we will declare the hearing closed.
Shipyard Lane project. Richard Lark, Esq., and Manny Kontokosta
appeared. The board received the inspection report from John W.
Davis, Planning Board Inspector, this morning and has not had time
to review same. Therefore, Mr. Raynor requested an extension of
time to have an opportunity to review the recommendations and
make comments. Another field trip will be made ~ith the inspector.
Mr. Xontokosta requested that he be notified of the time and date
so that he may attend also. Mr. Lark agreed to a thirty day
extension with an additional thirty day extension, if necessary.
Walter Gatz. Richard Lark, Esq., appeared. Mr. Lark presented
two copies of the map dated March 28, 1980. One will be sent to
Mr. Davis, Planning Board Inspector, for his comments and
recommendations as to conformity with his prior recommendations.
7:45 p.m. Public Hearing on the question of the approval of the
minor subdivision of property of Fishers Island Development
Corporation #184 (Fox Avenue business property). Richard Lark,
Esq., appeared~ Mr. Raynor read the legal notice of ~earing and
presented proof of publication in the Long Island Traveler-
Watchman.
Mr. Raynor: In the file wehave a resolution for lead agency.
There is no reason for road construction to the Board of Appeals.
This was referred to this board from them. We have the application
along with a check. As if the procedure of this board, we will
ask if there is anyone present this evening that would like to
speak in opposition to the proposed development. Hearing none,
is there anyone present who would like to speak in favor.

Mr. Lark: You have what is now the amended plan which is my
understanding complies with the existing zoning ordinance. The
board had a prior proposal when it was to be a smaller lot. What
is to be done there ~s construct a 32 x 35 foot building and
remove the old building where the existing upholstery shop is.
The lot lines have been drawn with the existing t~ography and
in addition taking into consideration the gun emplacement. What
you have in front of you is what the final proposal is.
Mr.,~Raynor. He is going to be in later for a site plan.
Mr. Lark: This is just to ask for approval of a one lot minor.
Mr. Raynor: Is there anyone else present that would like to
speak in favor of this proposed one lot minor. Hearing none,
to date we haven't gotten the county recommendations back on
this. It has to go to the Suffolk County Planning Commission.
It also has to go through the SEOR~ process. Do you have any
further questions on it, Jim?
Mr. Wall: No. Basically, the area lends itself to what they are
going to do down there. There is no doubt about it, the gun
emplacements are a mess.
Mr. Raynor: Does anyone else have any comments one way or another
regarding this subdivision. Mr. Gordon, Mr. Orlowski, Mr. LLatham?
(all negative) We will declare the hearing closed.
8:00 p.m. Public Hearing on the question of approval of the minor
subdivision of property of which Reynold F. Blum is the contract
vendee from Luglio and others located at Cutchogue. Lewis Edson
appeared~and B~nnett Orlowski, Sr.
Mr. Raynor called the hearing to order.
Mr. Gordon made a motion that if there was no objection that the
reading of the description be dispensed with because of its length.
There was no objection. Mr. Wall seconded the motion and it was
carried. Mr. Orlowski abstained from any action regarding this
subdivision because of his father's interest in the property. Mr.
Raynor presented proof of publication in the Long Island Traveler-
Watchman. The following letter from the Suffolk County Planning
Department was read into the minutes.
Dear Mr. Raynor:
The Suffolk County Plauning Commission at its regular meeting
on May 7, 1980, reviewed the proposed subdivision plat entitled,
"Minor Subdivision - Reyno~d F. Blum", referred to it pursuant to
Section 1333 of the Suffolk County Charter. After due study and
deliberation it resolved to approve said'map subject to the
following four conditions deemed necessary to help preserve the
traffic safety and carrying capacity of Main State Road in the
event that construction takes place along the road:

No lot shall be subdivided in the future without the
review and approval of both the Town Planning Board and
the Suffolk County Planning Commission.
Adequate drainage structures shall be provided on-site
to contain all the stormwater runoff resulting from the
development and improvement of the site to insure that
this runoff does not flow out into the state road.
A turnaround provision shall be provided on Lots i and 3
so that vehicles leaving these lots will not have to
back out into the traffic stream on the state road.
Points of access shall be restricted to no more than two
per cent for Lots I and 3 and shall be designed to
facilitate proper and efficient entry and exitingof
vehicles.

Mr. Raynor: There is the legal notice of public hearing and a
notice of disclosure from Mr. 0rlowski as his family has been
involved with this property, receipt of the fee paid, copy of the
applicant's application, short environmental assessment form,
resolution setting the public hearing, the SEORA had until May
9th to object, resolution of the Planning Board of lead agency,
correspondence with regard to roads, drainage and grading. As
there are no new roads proposed, there is nothing from the
Supt. of Highways. As is the procedure, we will ask if there is
anyone that would like to speak in opposition to this subdivision
of which Blum is contract vendee of Luglio and others. Hearing
none, is there anyone that would like to speak in favor of this
proposed subdivision. Hearing none, is there anyone present with
any information for the board with regard to this subdivision
that should come before this board at this time that the board
may or may not have knowledge of. Do you have anything, Mr.
Gordon, Mr. Latham, Mr. Wall. (all negative) There being no
further questions, we will declare this hearing closed and thank
you all for coming.
On motion made by Mr. Gordon, seconded by Mr. Wall, it was
RESOLVED that whereas, a formal application for the approval
of a subdivision plat, entitled Minor Subdivision of Reynold F.
Blum was submitted to the Planning Board on April l, 1980, and an
application fee of $30 was paid on April l, 1980, and
WHEREAS, a public hearing was held on the said subdivision
application and Plat at the Town Hall in Southold, New York, on
June 2, 1980 at 8:00 p.m., and
WHEREAS, the requirements of the Subdivision Regulations of
the Town of Southold have been met by said subdivision plat and
application,
Now, therefore, be it RESOLVED, that the application of
Reynold F. Blum for approval of said subdivision plat prepared by
Roderick Van Tuyl, P. C. and dated March 27, 1980 and amended
April 4, 1980 be approved subject to the following modifications
and that the Chairman of the Planning~Board be authorized to
endorse approval on said subdivision Plat upon compliance by the
applicant with such modifications as listed below.
Modification of said Plat to show the following conditions
of the Suffolk County Planning Commission:

The following declaration was introduced by Mr. Latham and
seconded by Mr. Wall:
Pursuant to Article 8 of the Environmental Conservation Law
State Environmental Quality Review Act and 6NYCRR Part 617, Section
617.10 and Chapter 44 of the Code of the Town of Southold, notice
is hereby given that Southold Town Planning Board as lead agency
for the action described below has determined that the project will
not have a significant effect on the environment.
DESCRIPTION OF ACTION
The minor subdivision of Reynold F. Blum is a three lot
of 5~3 acres, more or less, intended to be utilized for grape
farming located at Cutchogue in the Town of Southold.
The project has been determined not to have a significant
effect on the environment for the following reasons:
An environmental assessment has been submitted which
indicated that no significant adverse effects to the
environment were likely to occur should the project be
implemented as planned.

from the New York State Department of Environmental
Conservation it is assumed that there is no objection
nor comments by that agency.

The project will meet all requirements of the Code of
the Town of Southold Subdivision of Land Regulations.

Emerson is a two lot residential subdivision of 2.69 acres with

of non-significance has been made.

On motion made by Mr. Wall, seconded by Mr. Latham, it was
RESOLVED to approve sketch map dated October 1979 with
additions March 1980 of minor subdivision plan of property conveyed
to Robert W. Brooks located at Fishers Island.

On motion made byMr. Gordon, seconded by Mr. Latham, it was
RESOLVED that the Southold Town Planning Board declare itself
lead agency for the subdivision of property conveyed to Robert W.
Brooks located at Fishers Island. This project is unlisted and an
initial determination of non-significance has been made.

On motion made byMr. Gordon, seconded by Mr. 0rlowski, it was
RESOLVED to approve site plan dated April 17, 1980 or
cluster subdivision of Richmond Shores at Peconic as certified
by Building Inspector George H. Fisher May 14, 1980.

On motion made by Mr. Wall, seconded by Mr. 0rlowski, it was
RESOLVED that whereas, a formal application for the approval
of a subdivision plat, entitled Minor Subdivision of Fishers

Island Development Corporation~#185 was submitted to the Planning
Board on January 10, 1980, and an application fee of $40 was paid
on January 10, 1980, and
WHEREAS, a public hearing was held on the said subdivision
application and Plat at the Town Hall in Southold, New York, on
May 5, 1980 at 8:15 p.m., and
WHEREAS, the requirements of the Subdivision Regulations of
the Town of Southold have been met by said subdivision~i~plat and
application,
Now, therefore, be it RESOLVED, that the application of
Fishers Island Development Corporation #185 for approval of said.
subdivision plat prepared by Chandler, Palmer & King dated
November 30, 1979 be approved subject to the following modification.~
and that the chairman of the Planning Board be authorized to
endorse approval on said subdivision Plat upon compliance by the
applicant with such modification.
Modification of the plat to show the lot line between Lots
i and 2 being equidistant between the two buildings and at right
angles to Greenwood ROad.

On motion made by Mr. Gordon, seconded by Mr. Wall, it was
RESOLVED that the Southold Town Planning Board recommend to
the Southold Town Board release of the passbook in the amount of
$2,600 of CharlesRand for the subdivision B~onngloid-by-the-Sea
as Planning Board Inspector John W. Davis has submitted Report #
133 indicating that all required~!~improvements have been completed.

On motion made by Mr. 0rlowski, seconded by Mr. Gordon, it was
RESOLVED that the Southold Town Planning Board request from
the Southold Town Board a resolution classifying the property of
Thornton Smith located at Mattituck as being developed in the
cluster concept.

James Dean, requesting a modification, The board requests that
Mr. 01sen clarify the modification he is seeking.'

8:30 p.m. Public Hearing on the question of the approval of
the subdivision to be known as Bayview Woods located at Southold.
Howard Young smd Joseph Shipule appeared.
Mr. Gordon made a motion that due to the fact the metes and bounds
have been reviewed that the reading of the description of the
property be dispensed with. There being no objection, Mr. 0rlowski
seconded the motion and it was carried. Mr. Raynor presented proof
of publication in the Long Island Traveler-Watchman.
Mr. Raynor: This subdivision is outside the County jurisdiction
so there are no specific recommendations from them. It is beyond
500 feet. This has been reviewed by the Southold Fire Commissioners.
We have the recommendations of the Supt. of Highways and the
Town Engineer. We have a resolution concerning the screenings
and other engineering elements and we have correspondence from
the surveyor to this board. We have the application in duplicate
from the applicant and the metes and bounds description and more
correspondence going back through. The filing fee has been paid
by Mr. Shipule. On review of this, this applicatiOn does not
fall under the State Environmental Quality Review Act requirements
because it was started before SEORAwas enacted. Is there anyone
present that would like to speak in opposition to the proposed
subdivision entitled Bayview Woods~at Southold. Hearing none, is
there anyone present that would like to speak in favor of this
proposed subdivision.
Mr. Shipule: I am in favor of it because I am director of the
corporation and responsible for its development.
Mr. Raynor: Is there anyone else present that would like to
speak in favor of the proposed subdivision. Is there anyone
present with any information that the board should be aware of
at this time. Mr. Gordon, Mr. Orlowski, Mr. Wall, Mr. Latham.
(all negative) I have reviewed the maps and find they are in
compliance with the last inspector's report. There!~being no
other business, we will declare this hearing closed.
On motion made by Mr. 0rlowski, seconded by Mr. Latham, it was
RESOLVED that the Southold Town Planning Board ~drect the
Town Engineer, Lawrence M. Tuthill, to prepare a bond estimate
for the roads smd improvements in the subdivision to be known as
Bayview Woods.
Vote of the. Board: Ayes: Raynor, Gordon, Wall, Orlowski, Latham
Richmond Creek Farss. Pat Nest.i, attorney for the developer,
appeared. He indicated that Mr. Van Tuyl will show the open space
of 4.8 acres as park and recreation area. Mr. Raynor stated the
density had been calculated and the number of lots is proper.

On motion made by Mr. Gordon, seconded by Mr. 0rlowSki, it was
RESOLVED to approve the sketch plau of Subdivision t~ be
known as Richmond Creek Farms dated July 14,1978 and amended
May 14, 1980, subject to open space being.designated as park and
playground (4.8 acres on Southeast corner). The maps wil~ be
sent to the Supt. of Highways Raymond Dean, Town Engineer~Lawrence
Tuthill and Planning Board Inspector John W. Davis for comments
and recommendations on roads and drainage.
Vote of the Board: Ayes: Raynor, Gordon, Wall, 0rlowski, Latham
C~arles P. Simmons minor subdivision. Attorney Pilzer represented
the developer. The Planning Board will be meeting on J~ne 16th
with Dr. Lee Koppelman of the Suffolk County Planning Commission
and he will be consulted with regard to this subdivision. There
is a possibility that~he Planning Board would designate this
area for an extension bf Aldrich Lane, said road to be built to
town specifications. Because of the unique location and if it is
determined that a north-south artery is necessary it will have to
be built. Mr. Pilzer mildly objected to the financial burden
being placed entirely on Mr. Simmons. He also indicated the cost
would have' to be 'looked into; he felt such a road would be out of
keeping with the rural nature of the area; if the road is made a
requirement he feels there will be an objection lodged.
Harbor Lights Section IV. Messrs. Latham, Gordon and 0rlowski
will make a field inspection of this property to be presented at
the meeting of June 30th.
Macari. Supt. of Highways Dean was to contact Town Attorney
Tasker regarding his opinion on whether curbing and fencing could
be waived for the natural recharge area. The board would like
Mr. Dean to report in writing on this.
Forquer minor subdivision. A letter from Richard Cron, Esq. was
read in whichMr. Cron requests that this matter be treated as a
hardship as it is the setting off of a parcel of property with a
residence and barn already erected. Mr. Cron is to be advised to
submit the request with maps in proper form and the matter will
be handled as quickly as possible. A copy of Mr. Cron's letter
will be forwarded to Mr. Tasker with a cover letter stating that
the board feels adamantly that some type of mechanism should be
granted for relief in this situation and for him to delineate
what procedure we can use.

On motion made by Mr..~ Latham, seconded by Mr. Wall, it was
RESOLVED to table any further action on the minor subdivision
of McNulty until such time as the board has an opportunity to meet
with the town attorney.

On motion made by Mr. Wall, seconded by Mr. Lath~m, it was
RESOLVED that as a result of the action of the Zoning Board
of Appeals in 1975, the Planning Board is forced to give approval
to the sketch map of the property of Stanley A. Chase located at
Mattituck. The Board is not in agreement with this poorly planned
subdivision.

On motion made by Mr. Orlowski, seconded by Mr. Latham, it was
RESOLVED that the Southold Town Planning Board declare itself
lead agency for the subdivision of property of Stanley ~. Chase
located at Mattituck. This project is unlisted and an initial
determination of non-significance has been made.

On motion made by Mr. Gordon, seconded by Mr. 0rlowski, it was
RESOLVED to set 8:00 p.m., Monday, June 30, 1980, at the Town
Hall, Main Road, Southold, New York, as the time and place for a
public hearing on the question of the approval of the minor
subdivision of propertyof Stanley A. Chase located at Mattituck.
Vote of the Board: Ayes: Raynor, Gordon, Wall, 0rlowski, Latham
It appears that the property is owned presently by a corporation
and, if so, a disclosure statement is in order.
Peter Ku~awski .minor subdivision. Maps were distributed to the
board and the subdivision will be reviewed at the next meeting.
East-West road. Mr. 0rlowski andthe board reviewed the proposed
east-west road as delineated by Mr. Van Tuyl. The road should be
redirected south of Birch Hills~
Mr. Gordon made a motion, seconded by Mr. Latham and carried
to approve the minutes of the meeting of May 5, 1980.

Mr. 0rlowski made a motion, seconded by Mr. Latham and
carried to approve the minutes of the meetings of March 10, 1980;
March 24, 1980; April 7, 1980; and April 21, 1980.
Mr. 0rlowski made a motion, seconded by Mr. Wall and carried
to authorize the chairman to explore the possibility of the
Planning .Board securing the services of their own attorney.
Sterling Forest. The report of.Mr. Davis, Planning Board Inspector,
will be sent to Mr. Reese for clarification of the drainage plan.
There being no further business to come before the board,
Mr. 0rlowski made a motion, seconded by Mr. Latham and carried to
adjourn the meeting. Meeting adjourned at 10:40 p.m.
