THIS INDENTURE, made the 10th day of May, 2002

Avenue, Davenport, Florida 33897, as to an undivided % interest, party of the first part, and
CHARLES J. ZAHRA, residing at 1830 Pike Street, Mattituck, New York 11952, party of the second
part,
WITNESSETH, that the party of the first part, in consideration of TEN and 00/100---------------------------------------

valuable consideration paid by the party of the second part, does hereby grant and release unto the party of
the second part, the heirs or successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, situate, lying and being at Mattituck, in the Town of Southold,
County of Suffoik and State of New York, being more particularly bounded and described as follows:
BEGINNING at the northeast corner of premises herein to be described, distant the following 3 courses and
distances from the southwest corner of the land now or formerly of Zebroski:
1) South 35 degrees 19 minutes 00 seconds Wes 302.73 feet;
2) South 18 degrees 48 minutes 20 seconds West 106.14 feet;
3) South 71 degrees 11 minutes 40 seconds West 328.00 feet to the true point of beginning;
RUNNING THENCE from said true point of beginning, South 18 degrees 49 minutes 20 seconds East, 40.00
feet;
THENCE South 71 degrees 11 minutes 40 seconds West, 11.38 feet to James Creek;
THENCE along James Creek and along two tie lines the following courses and distances:
1) North 4 degrees 11 minutes 00 seconds West 2.55 feet;
2) North 27 degrees 26 minutes 40 seconds West 37.96 feet;
THENCE North 71 degrees 11 minutes 40 seconds East, 16.43 feet more or less to the point or place of
BEGINNING.
TOGETHER with all right, title and interest of grantor to a right of way from Camp Mineola Road, and any
other rights of way, including without limitation Kreh Road.
BEING AND INTENDED TO BE a portion of the same premises as conveyed to the party of the first part by
deed dated 4/3/59, recorded 4/7/59 in Liber 4608 page 219.
TOGETHER with all right, title and interest, if any, of the party of the first part in and tei any streets and roads
abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances and all
the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the
premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of
the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the
first part will receive the consideration for this conveyance and will hold the right to receive such consideration
as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same
first to the payment of the cost of the improvement before using any part of the total of the same for any other
purpose. The word "party" shall be construed as if it read "parties" when ever the sense of this indenture so
requires.
